Caitlin Crowe, Land Development Services Coordinator, provided the following 
background: 
  
The subject parcel is a 0.34-acre lot on the western side of Concord Approach Way in the 
Concord Grove at the Covered Bridge subdivision. The subject parcel and adjacent 
parcels to the north, east, and west are zoned RDA while the adjacent parcel to the south 
is located in Unincorporated Cobb County; all are occupied by single-family detached 
residences. 
  
The property is currently occupied by a two-story single-family home, built in 2003. The 
applicant is proposing to construct a new 428 square foot in-ground swimming pool with 
an accompanying 150 square foot pool house to provide bathroom and entertainment 
space while using the in-ground swimming pool. The 50-square-foot bathroom and 
storage closet will be enclosed with a lap siding façade, and a 100 square foot covered 
patio will be attached to serve as the entertainment space. Since the accessory structure 
ordinance allows one accessory structure or use per lot, a variance is required to have 
both the swimming pool and pool house. Since the swimming pool and pool house offer 
complimentary uses for the property, the variance is not self-created. 
  
Due to the size of the lot and the placement of the structures, no other variances for 
setback reductions or impervious surface area increase are required. An existing 6-foot 
wooden fence blocks the rear yard from view, so visibility to the structures will be limited. 
Strict application of the ordinance would deny the applicant any ability to have any 
detached structure or use on the property once the swimming pool was installed. At the 
time of this report, Community Development has not received any opposition to the 
variance request. 
  
The applicant is requesting to deviate from the development standards established by the 
City for the maximum number of accessory structures. According to Section 1403 of the 
Zoning Ordinance, variances must be reviewed under the following standards: (1) 
Whether there are unique and special or extraordinary circumstances applying to the 
property; (2) Whether any alleged hardship is self-created by any person having an 
interest in the property; (3) Whether strict application of the relevant provisions of the code 
would deprive the applicant of reasonable use of the property; and (4) Whether the 
variance proposed is the minimum variance needed. After a review of the standards 
above, Community Development believes that the variances will not adversely affect 
surrounding residents; therefore, staff recommends approval of the requested variance 
with the following condition:  
 
1. Approval of the requested variance is conditioned upon substantial compliance 
with the site plan and elevations submitted with the variance application. 
 
A representative came forward in place of Alexandra Hallacy and stated he and the 
homeowner understand and agree to the standard condition read into record.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item. The public hearing was closed.
