2. A Stormwater Inspection and Maintenance Agreement shall be completed and 
recorded with the Cobb County Superior Court prior to issuance of the building 
permit. 
3. A stormwater as-built certification statement shall be submitted to Community 
Development for approval prior to issuance of the building permit Certificate of 
Occupancy. 
4. The accessory structure shall not be permitted to have an oven or stove on either 
level without obtaining an additional variance for a second kitchen. 
5. The proposed accessory structure shall not be rented or occupied for gain, except 
as permitted in Article IX of Chapter 22 as it pertains to the operation of short-term 
rental units. 
6. These conditions shall run in perpetuity with the property and as such are also 
applicable to any future owner. 
 
Board Member Jones asked Ms. Crowe what is considered a secondary structure? Ms. 
Crowe stated that an accessory structure in section 501 of Smyrna’s code says that 
structures that are for use are accessory structures. Since the pool is used, it is 
considered a secondary or accessory structure. Board Member Jones also asked about 
the pervious pavers and whether or not something else could be used instead of a dry 
well. Clara Hodges, Plan Reviewer, stated that they would need to put more gravel 
storage underneath the pervious pavers to suffice.  
  
Benjamin Bell, applicant, stated that behind his property is where the future Baptist 
Church will build. Because the trees between in property and the church property are 
coming down, the structure will help with privacy. Mr. Bell stated he understands and 
agrees to the six stipulations read into record.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
 
Board Member Bo Jones made a motion to approve item V25-073; seconded by Board 
Member Andrea Worthy. 
 
The motion to approve carried with the following vote:

No further information was provided. Mr. Bell stated he understands and agrees to the six 
stipulations read into record.
