found out they were expecting. They began looking at this property as something more 
long-term to expand the family. Mr. Shoemaker was not anticipating anything larger than a 
garage. There is no basement. Back has a covered patio at 12 x 16. The family may 
consider adding a pool later. The family thinks this is something that would meet their 
future requirements. Mr. Shoemaker mentioned a couple different properties that have 
had somewhat similar variances approved, so he feels there is precedence set to approve 
this one. The house next door sits 20 ft. off the property line, and this house would sit 8.7 
ft. off the property line, so there is still plenty of space.  
  
Board Member Randall stated that circumstances on the other cases mentioned are 
viewed on their own merits. Do those variances reflect the same situation where an old 
home was cleared, a new home was built, etc? Mr. Shoemaker stated that all previous 
cases got approval when they were in the initial development stage. Part of why he did not 
want to move it over 2 ft. is because he was thinking long-term for other developments 
around this property. This is a 5-bedroom/5-bath house at 4,200 sq. ft. The added portion 
would not be living space, it would be recreational space.  
  
Chairperson Garland asked what the width of the room proposed would be. Mr. 
Shoemaker stated it is 12 ft. 9 in. from the current structure to the setback line. They are 
proposing that the room be 14 ft. wide. Mr. Garland asked what are alternatives if this is 
not approved? Were other areas considered? Mr. Shoemaker stated that other areas do 
not conveniently allow for this build landlocking some areas, closing windows off, etc. 
Other areas also encroach on setbacks.    
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
  
Board Member Randall stated that he understands the issues, but it sounds like there is a 
lot going on with a property that is already substandard. The Board relies on the planning 
staff to determine what is appropriate and what sets precedent. 
 
Board Member Eric Randall made a motion to deny item V25-112; seconded by Board 
Member Andrea Worthy. 
 
The motion to withdraw carried with the following vote:

background: 
  
The subject parcel is a 0.7-acre lot on the north side of Church Street. The subject parcel 
and adjoining parcels to the south, east and west are zoned R-15 and are all occupied by 
single-family detached residences. The property to the north is zoned RM-12 and is 
occupied by the Madison at Village Green condominiums.
