Princepal Singh Virk – agent – stated he is the owner and is present Fri-Sun. The training 
consists of checking ID, making sure they do not sell upon fake ID production, they 
currently have no Sunday sales, they check cameras for theft. His previous experience is 
being an agent in California.   
  
Board Member Randall asked how long their security camera recording are kept. Mr. Virk 
stated it is kept for 180 days. And he stated that they have not developed a training 
program but will soon. This is a new business. 
  
Chairperson Garland stated that the Smyrna Police Department takes alcohol sales 
seriously, and noted that they will perform compliance checks any time.   
 
Board Member Andrea Worthy made a motion to approve item LIC2025-045; seconded by 
Board Member Eric Randall. 
 
The motion to approve carried with the following vote:

Land Lot 485 - 3240 King Springs Road - William Cope

Caitlin Crowe, Land Development Services Coordinator, provided the following 
background: 
  
The subject parcel is a 0.32-acre lot on the west side of King Springs Road in the 
Cottages at King Springs subdivision (see Figure 1). The subject parcel and adjoining 
parcels to the north and south are zoned RDA whereas the adjacent parcels to the east 
and west are zoned R-15. All adjacent lots are occupied by single-family detached 
residences, with the exception of the parcel to the east, which is occupied by the City’s 
Brinkley Park. 
  
The property is currently occupied by a two-story single-family home, 84-foot shed, and 
112 square foot in-ground swimming pool in the rear of the property. The swimming pool 
was permitted in 2020 with the stipulation that the shed in the rear would either be 
removed or a variance would be acquired for a second accessory structure. The applicant 
has since submitted an additional permit application (RBP-25-470) to extend the patio roof 
at the rear of the home. During plan review, it was discovered that the shed and pool are 
both still remaining on site without the proper variance. Once the applicant was alerted to 
the code violation, the variance application was submitted for the second accessory 
structure. 
  
The applicant is proposing to retain the shed and in-ground swimming pool in their current 
locations. Since the accessory structure ordinance allows one accessory structure or use 
per lot, a variance is required to have the second structure. Since the swimming pool and 
shed offer different uses for the property, the variance is not self-created.
