Strict application of the ordinance would deny the applicant any ability to have any detached structure or use on the property due to the existing shed. At the time of this report, Community Development has not received any opposition to the variance request. The applicant is requesting to deviate from the development standards established by the City for the maximum number of accessory structures. According to Section 1403 of the Zoning Ordinance, variances must be reviewed under the following standards: (1) Whether there are unique and special or extraordinary circumstances applying to the property; (2) Whether any alleged hardship is self-created by any person having an interest in the property; (3) Whether strict application of the relevant provisions of the code would deprive the applicant of reasonable use of the property; and (4) Whether the variance proposed is the minimum variance needed. After a review of the standards above, Community Development believes that the variance will not adversely affect surrounding residents; therefore, staff recommends approval of the requested variance. William Cope – applicant – has owned the property since 2017. He had no further information to add. A public hearing was called, and no one came forward in favor of or in opposition to this item. Board Member Andrea Worthy made a motion to approve item V25-100; seconded by Board Member Eric Randall. V25-104 Public Hearing - Variance Request - V25-104 - Reduce the front setback for a shed - Land Lot 417 - 892 Wayland Court - Igors Stepanovs This request is to be withdrawn Ward 5 Councilmember - Susan Wilkinson Caitlin Crowe, Land Development Services Coordinator, provided the following background for items V25-104 and V25-105: The subject parcel is a 0.2-acre corner lot on the northwest intersection of Wayland Court and Frances Drive. The subject parcel and all adjoining parcels are zoned R-15 and are all occupied by single-family detached residences. In October 2025, the applicant replaced a 35 square foot shed with a 211 square foot shed on the southwestern side of the property without obtaining a building permit or variance. Code Enforcement subsequently issued a notice of violation to the subject property for working without a permit. After being alerted to the violations, the applicant moved forward with the variance application later that month to retain the shed in its current position. The existing home sits catty-corner on the corner property, pushed to the rear of the property with a large front yard. The existing home, originally built in 1953, is currently
