Due to the existing footprint of the home, the most logical area to construct the home addition is within the streetside setback and to decrease disturbance to the subject property and surrounding neighbors. Strict application of the ordinance would deny the applicant the ability to add any square footage to either the home or the garage due to the nonconforming setback and size. Community Development does not foresee any negative impacts to adjacent properties should the variances be approved. At the time of this report, Community Development has not received any calls in opposition to the request. The applicant is requesting to reduce the streetside setback and increase the accessory structure size at 280 Concord Road. According to Section 1403 of the Zoning Ordinance, variances must be reviewed under the following standards: (1) Whether there are unique and special or extraordinary circumstances applying to the property; (2) Whether any alleged hardship is self-created by any person having an interest in the property; (3) Whether strict application of the relevant provisions of the code would deprive the applicant of reasonable use of the property; and (4) Whether the variance proposed is the minimum variance needed. After a review of the standards above, Community Development believes that the encroachment and size will not adversely affect surrounding residents; therefore, staff recommends approval of the requested variances with the following conditions: 1. Approval of the requested variance shall be conditioned upon substantial compliance with the site plan and elevations submitted with the variance application. Harold Singer, applicant, stated he understands and agrees to the standard stipulation read into record. A public hearing was called. Charles Tucker, 357 Lynhurst Rd., expressed a concern that when this property at one time hosted a large party or event, there were several vehicles parked on the road which made it difficult to navigate / somewhat impassable. He also mentioned that in years past, an attempt was made to place a fence near the street which is a concern for visibility and safety. Nigel Ingleton, homeowner, explained that the party mentioned was his wedding for which many family members from England came to attend. He had inquired about needing a permit, and he was told by the city it was not needed. Board Member Eric Randall made a motion to approve item V25-088; seconded by Board Member Andrea Worthy.
