 E. V25-090 Public Hearing - Variance Request - V25-090 - Reduce the northern side setback 
from 12 feet to 8 feet - Land Lot 556 - 3357 Pretty Branch Drive - Nick Vinson

Caitlin Crowe, Land Services Development Coordinator, provided the following 
background for V25-090 and V25-091: 
  
The subject parcel is a 0.50-acre lot located on the east side of Pretty Branch Drive. The 
subject parcel and all adjacent parcels are zoned R-20 and are occupied by detached 
single-family homes. 
  
The applicant is proposing to demolish the existing single-family home and build a new 1 
½ -story 3,745 square foot home; when completed, the home will have 4 bedrooms and 3 
bathrooms on the lower floor and a home theater on the second floor. The home will be 
accessed from the existing curb cut off Pretty Branch Drive, which will be greatly 
reconfigured as part of the project. The existing one-story home is 1,326 square feet, 
which is below the minimum house size of the R-20 zoning district of 2,100 square feet. 
With the new construction, the home will be 3,745 square feet, bringing the property into 
compliance with the R-20 zoning district floor area requirement. 
  
The existing home, originally built in 1955, is currently encroaching into the 12-foot 
northern side setback by 8.3 feet. The applicant is proposing to keep as much of the 
existing footprint of the home to reduce land disturbance, so any expansion in line with the 
existing home would require a setback variance. However, to eliminate fire retardant 
requirements and to minimize the variance request, the applicant is shifting the home to 
the south by 4.3 feet so the total encroachment for the new home will be 4 feet. Since the 
encroachment previously existed on the property, the hardship is not self-created. 
  
To make way for the new home and the proposed side entry garage, the applicant will 
completely reconfigure the existing drive to run the length of the southern property line 
rather than slant towards the middle of the lot as it exists today. In order to create the 
necessary turning radius to access the side-entry garage, the applicant is proposing a 3-
foot reduction to the driveway setback. The applicant has minimized the variance request 
as much as possible by reducing the driveway to a one car driveway until it enters the 
two-car garage at the home.
