CONCESSIONS AGREEMENT This Concession Agreement is entered into this 18th day of July, 2025, by and between CITY PARK Concessions, LLC, (DBA Premier Events), and Client, below, for food and beverage concessions management at the stated event: “Client”: The City of Smyrna “Event”: Smyrna Birthday Celebration and Culture & Spirit Festival Event “Date(s)”: October 4th, 2025 Event “Location”: Downtown Smyrna and Atlanta Road In consideration of the mutual promises and covenants contained herein, the receipt and sufficiency of which are hereby acknowledged, CITY PARK CONCESSIONS, LLC (DBA Premier Events), and Client hereby agree: 1. Concessions Agreement. CITY PARK CONCESSIONS, LLC shall serve as Client’s official and exclusive concessionaire for the Event at the specified location and date(s). CITY PARK CONCESSIONS, LLC shall be responsible for managing all aspects of beverage sales for the Event. Beverage sales shall include all alcoholic beverages, carbonated soft drinks, sports and energy drinks and bottled water. Food vendors may sell certain beverages as agreed under the Food Vendor Management section or in Special Stipulations. Client will grant no other vendor or entity the right to sell or sample any beverage of any type unless stipulated in Special Stipulations. 2. Licenses & Permits. Unless otherwise agreed under Special Stipulations, CITY PARK CONCESSIONS, LLC shall be responsible for obtaining all necessary City, County & State alcoholic beverage permits for the event, under Client’s Festival/Event Permit. The client agrees to name CITY PARK CONCESSIONS, LLC as the Event’s concessionaire and specify agreed event times to facilitate alcohol sales in the Event Permit. CITY PARK CONCESSIONS, LLC agrees to assist Client as necessary in the provision of any documentation or assistance necessary in the application for the Event alcoholic sale permits. CITY PARK CONCESSIONS, LLC will be responsible for obtaining any additional permits required for its operations such as business licenses or other special permits, and Client agrees to assist CITY PARK CONCESSIONS, LLC as necessary in the provision of any documentation or assistance necessary in the application for such permits.
