2 Actual License will be held in the name of CITY PARK Concessions, LLC, Robert Frazer Licensee and Client is requested to facilitate this name be used in any local permitting to match up with State Alcohol Accounts and Licenses on file. 3. Compensation. CITY PARK CONCESSIONS, LLC will pay for all products, sales staff, support staff, equipment, taxes, insurance, and any other costs associated with the beverage operation. Compensation will be paid to Client on the following scale: (Net Revenues are defined as Gross Revenues less applicable City and State Sales and other taxes and fees including License Taxes, server permit fees, or other regulatory taxes or fees) Paid on the Net Revenues for all Beverage sales from $0 to $50,000: 25% Paid on the Net Revenues for all Beverage sales from $50,001 to $75,000: 30% Paid on the Net Revenues for all Beverage sales from $75,001 and Above: 35% Compensation shall be subject to the deduction of expenses billed to client such as ice used, beverage product delivered to Client for its own use, and other expenses as agreed under Special Stipulations. Compensation shall be paid within 14 business days following the conclusion of the Event Date and will be accompanied by a detailed event sales report. 4. Discounts. Certain discounts on sales may be granted by CITY PARK CONCESSIONS, LLC or requested by Client during the event. Discounted sales, Drink Tickets, or coupons will not be included in sales revenue for the purpose of calculation of the commission. Drink tickets or coupons redeemed by Client or distributed by Client to sponsors, VIPs, and guests and then redeemed at CITY PARK CONCESSIONS, LLC locations will be billed back to Client at cost as specified in Special Stipulations. CITY PARK CONCESSIONS, LLC will retain all tickets or coupons redeemed as a record of such redemptions. 5. Food Vendors Beverage Sales. CITY PARK CONCESSIONS, LLC and Client agree that no vendor will be permitted to sell any alcoholic beverages, carbonated soft drinks, bottled water, sports drinks, or energy drinks unless such products are specifically approved in writing with each applicable vendor with the event.
