Robert Harrison is requesting a rezoning from R-15 to MU- Conditional (Mixed Use) to maintain the existing residential and church uses, and also to allow artist studios in the accessory buildings. If approved, the only permitted use of the property will be to allow a church, single-family home, and artist studios; all other permitted uses in the MU zoning district will be prohibited. The Planning & Zoning Board recommended approval by a vote of 6-0 at the February 10, 2025 meeting. RECOMMENDATION / REQUESTED ACTION: Community Development recommends approval of the rezoning from R-15 to MU-Conditional at 1464 Spring Street with the following conditions: 1. Approval of the subject property for the MU-Conditional zoning district shall be conditioned to permit the following uses in Sec. 720.2: · Dwelling, detached, attached, multifamily, townhouse, and condominiums. · Institutional uses such as churches, synagogues, Sunday school buildings, community recreation centers, libraries, museums, theaters, and art galleries, police and fire stations, public and private elementary and high schools. · Studios for artists; designers; photographers; musicians; sculptors; gymnasts; potters; wood and leather craftsmen; glass blowers; weavers; silversmiths; and designers of ornamental and precious jewelry.Sales of items produced on the premises shall be allowed twice a year. Colleges; universities, commercial schools; schools providing adult training in any of the arts, sciences, trade and professions; and dormitories for students or staff for hospitals.shall be permitted on an intermittent basis. 2. The following uses in Sec. 720.2 shall not be permitted on the subject parcel: Day care centers, nursing homes, rest homes and homes for the aged.
