Hussein Kafaei, applicant, stated he understands and agrees to the stipulations read into record. A public hearing was called, and no one came forward in favor of or in opposition to this item. V25-044 Public Hearing - Variance Request - V25-044 - Reduce the western side setback from 10 feet to 3.2 feet - Land Lot 688 - 1958 Oakdale Court - Filippo Moneti Ward 7 Councilmember - Rickey N. Oglesby Jr. Caitlin Crowe, Planner I, provided the following background: The subject parcel is a 0.05-acre lot located on the south side of Oakdale Court, at the termination of the road. The subject parcel and adjacent parcels to the east and on to the north are zoned R-15 and are occupied by single-family detached homes. The adjacent parcels to the north and south are zoned OD (Office-Distribution) and are occupied by the truck turnaround for Extra Space Storage and vacant, respectively. The adjacent parcel to the west is zoned OI (Office-Institutional) and is occupied by an office building with a variety of businesses. The subject property is currently occupied by a 976 square foot single-family home. In October 2024, Code Enforcement issued a notice of violation to the subject property for working without a permit, as a deck was replaced on the side of the home without obtaining a building permit or variance. The applicant submitted the permit application in November 2024 and moved forward with the variance application in April 2025. The 128 square foot deck was encroaching into the side setback by 7.7 feet prior to its removal. Staff were unable to locate a permit for the original deck or variances to account for the location but can confirm via aerial imaging that the original location of the deck occurred at least prior to 2006. The applicant is proposing to retain the replaced deck in the same location with a new 128 square foot deck. The existing home abuts the front and western side setbacks, so any expansion on this side of the home would merit a variance. Thus, the hardship is not self-created.
