Clara Hodges, Plan Reviewer, stated it stops short of the property line on either side, and she added that no work is proposed anywhere near the piped area. Board Member Moore noted that the cement pad underneath the shed is to be removed as well when removing the structures. John Bradford, applicant (contractor/owner), confirmed work will not be near the pipe. He stated he understands and agrees to the stipulations read into record. A public hearing was called, and no one came forward in favor of or in opposition to this item. Board Member Mary Moore made a motion to approve item V25-046; seconded by Board Member Bo Jones. V25-047 Public Hearing - Variance Request - V25-047 - Allow second accessory structure - Land Lot 592 - 1543 Roswell Street - Mitchell Scott Ward 3 Councilmember - Travis Lindley Caitlin Crowe, Planner I, provided the following background: The subject parcel is a 0.72-acre lot located on the north side of Roswell Street. The subject parcel and adjoining parcel to the east are zoned RDA, the adjacent parcel to the west is zoned FC (Future Commercial), and the adjacent parcels to the south are zoned RMC-8; all are occupied by single-family detached residences. The adjacent parcel to the north is considered City right-of-way and is vacant. The subject property is currently occupied by a 3,234 square foot single-family home and a 148 square foot shed in the rear of the property. The applicant is proposing to erect a 169 square foot pergola over an existing patio in the rear of the home to provide shade and a covering for inclement weather. Since the accessory structure ordinance allows one accessory structure or use per lot, a variance is required to build the second structure; since the pergola and storage shed offer different uses for the property, the variance is not self-created. A patio was installed within roughly 5 feet of the property line in 2020; patios that are flush to the ground are not required to meet building setbacks nor obtain a building permit. However, once the pergola is added over the patio, the structure will encroach into the rear setback by 4 feet. Due to the existing patio location, the most logical area to construct the pergola is within the setback. The eastern side of the property in line with the patio, which has a 5-foot side setback and would not have required a variance, is occupied by the community’s shared driveway and thus cannot be obstructed.
