Strict application of the ordinance would deny the applicant any ability to modify any 
portion of the deck since the existing deck was fully within the side setback. At the time of 
this report, Community Development has not received any calls in opposition to the 
request. 
  
The applicant is requesting to deviate from the development standards established by the 
City for the R-15 zoning district, which requires a side setback of 10 feet. According to 
Section 1403 of the Zoning Ordinance, variances must be reviewed under the following 
standards: (1) Whether there are unique and special or extraordinary circumstances 
applying to the property; (2) Whether any alleged hardship is self-created by any person 
having an interest in the property; (3) Whether strict application of the relevant provisions 
of the code would deprive the applicant of reasonable use of the property; and (4) 
Whether the variance proposed is the minimum variance needed. After a review of the 
standards above, Community Development believes that the variances will not adversely 
affect surrounding residents; therefore, staff recommend approval of the requested 
variance with the following condition:  
 
1. Approval of the requested variance is conditioned upon substantial compliance 
with the site plan submitted with the variance application. 
 
Filippo Moneti, applicant, stated that he understands and agrees to the standard 
stipulation read into record.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
 
Board Member Mary Moore made a motion to approve item V25-044; seconded by Board 
Member Bo Jones. 
 
The motion to approve carried with the following vote:

 D. V25-045 Public Hearing - Variance Request - V25-045 - Reduce the side setback from 
12 feet to 5 feet - Land Lot 599 - 3721 Hickory Circle - Christopher Spears

Caitlin Crowe, Planner I, provided the following background: 
  
The subject parcel is a 0.60-acre lot located on the western intersection of Hickory Circle 
and Hickory Place. The subject parcel and adjacent parcels to the east and west are 
zoned R-20 and are occupied by single-family detached residences. The adjacent parcels 
to the north and south are zoned R-15; the property to the north is occupied by a single-
family detached residence whereas the property to the south is occupied by the Vinings 
Glen subdivision amenity area. 
  
The applicant is proposing to replace an existing 480 square foot two-car carport with a 
900 square foot three-car garage on the side of the existing home. As part of the 
construction effort on the property, the applicant will also be adding a 177 square foot 
front porch to the front of the home.
