Approval of the requested variances is conditioned upon substantial compliance with the site plan and elevations submitted with the variance application. 2. A Stormwater Inspection and Maintenance Agreement shall be completed and recorded with the Cobb County Superior Court prior to issuance of the building permit. 3. A stormwater as-built certification statement shall be submitted to Community Development for approval prior to issuance of the building permit Certificate of Completion. 4. Any damaged or broken curb caused during construction shall be replaced prior to issuance of the building permit Certificate of Completion. Joel Powell, 1152 Bank Street, stated the current houw is a small house with a growing family living there. There is a detached two-car garage. They are trying to get it into compliance as much as possible. He stated he understands and agrees to all stipulations read into record. A public hearing was called, and no one came forward in favor of or in opposition to this item. Board Member Andrea Worthy made a motion to approve item V25-054; seconded by Board Member Bo Jones. The motion to approve carried with the following vote: Aye: 3 – Chairperson Garland, Board Member Jones, Board Member Worthy Nay: 0 – None Recuse: 0 – None D. V25-055 Public Hearing - Variance Request - V25-055 - Reduce the northern side setback from 10 feet to 5.1 feet - Land Lot 449 - 2721 Fraser Street - Fairbanks Construction Services Ward 3 Councilmember - Travis Lindley A public hearing was called, and no one came forward in favor of or in opposition to this item. Board Member Bo Jones made a motion to approve item V25-055; seconded by Board Member Andrea Worthy.
