Walter McDonald, 1284 Kingsview Cir, stated this property has come up for review 
several times. It is heavily wooded and encroaching on the creek is going to be invasive. 
Wants to understand why suddenly development can happen now when it was not able to 
be developed previously. Wants to know where to find site plans. The lake in 
neighborhood is full of silt. Concerned if disturbance on this property will create more silt 
issues.  
  
Mrs. Crowe explained:  
• This is the first time a variance has come before the License and Variance Board. 
If there were previous sales, the city would not be involved. 
• The engineer who designed the plan is in chambers and can answer questions 
about the gorge, runoff, etc. 
• Site plans can be found on the city website or they can reach out directly to 
Community Development. 
 
Louisa Perkins, 1288 Kingsview Circle, came forward and stated she had emailed Mayor 
Pro Tem Tim Gould. She said that the spring-fed creek has a lot of runoff because of the 
slope of the property. There is runoff from Forest Hills that enters that creek. Because the 
property is covered with trees, building a home would mean cutting the trees down. She 
stated she does not understand how a house can be built there, and she is alarmed that 
there are plans to build a swimming pool. She does not understand why the city would 
deviate from guidelines, and she does not want to see the back of someone’s house. She 
would like to see a environmental impact study.  
  
Sean Murphy – 3282 Lee Street – Landscape Architect / certified arborist working on this 
property stated that the property layout does come to a V shape. Joe Heller is the current 
owner. There are state buffers on either side at 25’ – Nothing is being done within these 
buffers. The city has an additional buffer and impervious buffer which is what these 
variances are for. The creek flows from north to south, and another branch comes from 
the other side of the street and then they join. The creek on the property will not be 
disturbed. A silt fence will be installed below the project. They will be cutting into grade to 
build a basement. A few trees will be removed, but tree removal will be minimal. The pool 
will be supported by a retaining wall. There are two BMP’s (Best Management Practice) to 
address storm water runoff. This development will actually enhance the buffer – they will 
plant native trees, shrubs, herbs, etc. 
 
Board Member Andrea Worthy made a motion to approve item V25-052; seconded by 
Board Member Bo Jones. 
 
The motion to approve carried with the following vote:
