 D. ORD2025-010 Approve an amendment to Section 6-125 of the Smyrna Code of 
Ordinances dealing with the elected or appointed officials holding a license to sell 
alcoholic beverages. 
Citywide 
 
Councilmember Rickey N. Oglesby, Jr recused himself from this item and exited the 
meeting at 8:39 PM. 
  
Mike Jones, City Administrator, provided the following background: 
  
Section 6-125 of the Smyrna Code of Ordinances prohibits elected or appointed 
officials from holding a license to sell alcoholic beverages or having an interest in a 
business that has a license. This provision is outdated and limits potential restaurants 
within the city. This amendment revises this ordinance and allows these officials to 
hold such a license or have an interest in a business holding a license, in certain 
circumstances provided that they publicly declare that interest and do not participate in 
official city action regarding the license.    
  
Councilmember Rickey N. Oglesby, Jr. reentered the meeting at 8:41 PM.  
 
Mayor Pro Tem / Councilmember Tim Gould made a motion to approve item 
ORD2025-010; seconded by Councilmember Charles Welch. 
 
The motion to approve carried with the following vote: 
 
Aye: 6 –  Councilmember Pickens, Councilmember Hines, Councilmember 
Lindley, Councilmember Welch, Councilmember Wilkinson, Mayor 
Pro Tem / Councilmember Gould 
Nay: 0 –  None 
Recuse: 1 –  Councilmember Oglesby  
 
 E. ORD2025-011 Authorization for approval of ORD2025-011 an ordinance amending 
section 66 of the Smyrna Code of ordinances to add section 66-6, Petty Trespass and 
authorize the Mayor to sign and execute all related documents. 
Citywide 
 
Mike Jones, City Administrator, provided the following background: 
  
This ordinance prohibits anyone from entering premises for an unlawful purpose, 
entering premises after being told not to do so, or remaining on premises after being 
told to leave. Representatives of the police department have requested that an 
ordinance dealing with Petty Trespass be adopted.  
 
Councilmember Rickey N. Oglesby Jr. made a motion to approve item ORD2025-011; 
seconded by Councilmember Travis Lindley.
