They have listened to the recommendations from the State and City and have met or exceeded those recommendations. A public hearing was called. Kemi Ijitimehin, 6216 Ocmulgee River Lane, stated she wanted to make sure that the Council does not take action on the fuel storage tank. Mayor Norton confirmed that the State decides and approved that, and the Council is only taking into consideration the temporary modular building. Kyler Wilson, 1704 Trout Lily Place, asked if the modular office is temporary. Mr. Martin stated that it will be a temporary use on the site and will have to come back every two years for approval. The understanding is that the area is going to be redeveloped. The property owner is actively marketing the property for sale. Unnamed resident – She asked if there is any idea when it would be turned over and how long is temporary. Mr. Martin explained that three years ago made a rezoning request for the 20 acres just south. In addition to that, the City is updating the Comprehensive Plan by 2027. Now that this area has been annexed from Cobb County, the City can plan for improvements. Jason Kay, Riverview communities, thanked Mayor and Council for meeting with them. During the Planning and Zoning Commission hearing, there were questions specifically about the fuel tank which led to confusion. Many residents felt that their concerns were dismissed and that they did not do their due diligence before buying in that community. He questioned the City’s priorities and wondered if the City is for residents and small businesses, or for private equity firms that own Arrow Waste. Cody Hugley 1641 Flint River Place, read a letter from Chattahoochee River Keepers. Councilmember Latonia P. Hines, in speaking to the applicant, stated that maintaining a clean area is helpful. She then asked if they decided to do a permanent structure, are they allowed to do. Mr. Martin confirmed that yes, there would be no necessity to go through this process if it were permanent provided it meets all the zoning requirements. Councilmember Susan Wilkinson asked that because it is temporary, it would need to be re-voted on in two years. Mt. Martin stated that yes, it is temporary and already on site, so this is just to clear up the code violation. A permanent structure would never have had to come before Council. Councilmember Charles Welch stated that though he sympathizes with the residents whose property is adjacent to the property in question, the Council is not there to rezone this property. The property owner has a right to use this property to its best use. Councilmember Charles Welch made a motion to approve item Z25-013; seconded by Mayor Pro Tem / Councilmember Tim Gould.
