Sec. 22-85. - Location. 
No licensed location for a pawnshop or broker or a pawn for title establishment or any 
other business coming under this article shall be located closer than 1,000 feet to any 
similarly licensed location, or any church, school, public building, or library after 
October 1, 1991. 
  
The subject location is approximately 790’ from another pawn broker located at 2481 
Cobb Parkway. The city code requires a minimum separation of 1,000’ between pawn 
brokers. 
  
The applicant has submitted a survey showing the separation between the pawn 
brokers as 1,044’, but the surveyor used the nearest path of travel method for the 
measurement, which is not contemplated in the City’s Pawn Broker Ordinance. A 
literal reading of the ordinance would use a straight-line method of measurement. 
  
Autumn McClellan, applicant, stated that the code is ambiguous and does not define 
the path that is permitted – Straight line, path of travel, door to door? The survey 
company, United Land Survey, used their assessment of the path and 
measured 1,044 ft from TitleMax. Atlanta Title Pawn has been in business for 15 years 
in Marietta.   
  
A public hearing was called, and no one came forward in favor of or in opposition to 
this item.   
 
Councilmember Glenn Pickens made a motion to deny item LIC2025-039; seconded by 
Councilmember Travis Lindley. 
 
The motion to deny carried with the following vote:

Conditional for a mixed-use development with 250 multi-family units and 2,500 sq. ft. 
of retail - 6.73 acres - Land Lot 681 & 688 - 0 Highlands Pkwy - WP South 
Acquisitions LLC.

Mike Jones, City Administrator, provided a brief background: 
  
The applicant is requesting a rezoning from OI to MU-Conditional for a mixed-use 
development with 250 multi-family units and 2,500 s. ft. of retail. The future land use is 
Industrial, and a land use change to Mixed-Use is required. The Planning and Zoning 
Commission voted to deny the request by a vote of 7-0 at the August 11, 2025, 
meeting.  
  
Russell Martin, Community Development Director, provided the following background: 
  
Community Development is not supportive of the change in zoning from OI to MU-
