Community Development has not received any calls in opposition to the requests. The applicant is requesting to deviate from the City’s R-15 Zoning District and substandard lot requirements. According to Section 1403 of the Zoning Ordinance, variances must be reviewed under the following standards: (1) Whether there are unique and special or extraordinary circumstances applying to the property; (2) Whether any alleged hardship is self-created by any person having an interest in the property; (3) Whether strict application of the relevant provisions of the code would deprive the applicant of reasonable use of the property; and (4) Whether the variance proposed is the minimum variance needed. Community Development has reviewed the request and believes that the variances will not adversely affect surrounding residents since a house previously occupied the property. Therefore, staff recommends approval of the requested variances with the following conditions: 1. Approval of the requested variances shall be conditioned upon substantial compliance with the site plan and elevations submitted with the variance application. 2. An as-built survey shall be submitted prior to foundation pour due to the proximity to the setbacks. 3. A Stormwater Inspection and Maintenance Agreement shall be completed and recorded with the Cobb County Superior Court prior to issuance of the building permit. 4. A stormwater as-built certification statement shall be submitted to Community Development for approval prior to issuance of the Certificate of Occupancy. 5. The existing 12-inch Reinforced Concrete Pipe (RCP) must be replaced with 18- inch RCP prior to issuance of the Certificate of Occupancy. 6. A drainage easement must be provided and completed prior to building permit issuance. Once the easement is signed, it must be recorded with the Cobb County Superior Court. Sandy Steichen (400 Belmont Place), applicant/owner, stated she understands and agrees to the six stipulations read into record. Mark Wolff, City Engineer, stated this has been reviewed by Engineering. Mitigation requires an inspection maintenance agreement. A public hearing was called, and no one came forward in favor of or in opposition to this item. The public hearing was closed. Board Member Andrea Worthy made a motion to approve V26-049; seconded by Board Member Dustin Davey.
