The approximate mixture of unit types shall consist of the following: sixty-four percent (64%) one bedrooms, thirty-four percent (34%) two bedrooms, and two percent (2%) three bedrooms. 36. A minimum of 10% of the multi-family units will be designated as work-force housing affordable to households earning between 80% and 120% of the area median income, with rents capped at 30% of monthly income. 37. Approval of the subject property for the MU-Conditional zoning district shall be conditioned upon the development of the property in substantial compliance with the site plan submitted February 2, 2022 December 29, 2025, and created by Kimley-Horn Foresite Group and all zoning stipulations above. 38. The applicant shall be bound to the restaurant conceptual elevations submitted on December 3, 2021 September 17, 2025, and the townhome conceptual elevations submitted in February, 3, 2026. Approval of any change to the elevations must be obtained from the Director of Community Development. 39. The townhome elevations are required to meet the regulations established in Section 515. 40. All structures on the subject property shall be demolished within nine (9) months of approval by the Mayor & Council. 41. The use of a drive-thru restaurant is permitted in the MU zoning district. 42. The drive-thru facilities and associated queuing lanes may be located between the building and the adjacent street. 43. An additional accessory structure is permitted for the restaurant. 44. A garbage dumpster visible from the public street shall be allowed, provided there is a three sided brick enclosure and it is screened from view where allowed. 45. The developer shall replace any existing curb in the city's jurisdiction with high back curb and gutter and install new where not installed. 46. The developer shall provide documentation of conditions of storm drain systems that are being tied into. Rehab of existing CMP may be required once evaluated. 47. A 10’ landscape buffer is required for the restaurant along Oakdale Road and a 5’ landscape buffer on S Cobb Drive. 48. Any townhome elevation visible from a public right-of-way shall not utilize hardy plank siding. 49. The developer shall design and install a marked pedestrian crossing and Rectangular Rapid Flashing Beacon (RRFB) system across Oakdale Road at a location approved by the City of Smyrna and Cobb County. Councilmember Rickey N. Oglesby, Jr. asked if the current Chick-Fil-A on S. Cobb Drive has any deed restrictions. Mr. Martin stated he does not have an answer to that, but the applicant might be able to answer. Councilmember Oglesby asked where the crosswalk will be located. Mr. Martin stated that they will do sight distance studies during planning. Councilmember Charles Welch asked what the approximate distance is from the Chick-Fil-A exit on Oakdale to S. Cobb. Mr. Martin estimated it may be 200 ft. Councilmember Susan Wilkinson asked if the townhomes will be gated and if they will have an HOA. Mr. Martin stated that there is a stipulation that says they cannot be gated. There will be an HOA associated with the development. Councilmember Wilkinson asked about sidewalks. There will be a signalized crossing on Oakdale Rd. on the east side.
