The applicant is requesting a variance to reduce the western side setback for 3489 
Vinings North Way from 12 feet to 7 feet for the construction of a two-car garage. 
According to Section 1403 of the Zoning Ordinance, variances must be reviewed under 
the following standards: (1) Whether there are unique and special or extraordinary 
circumstances applying to the property; (2) Whether any alleged hardship is self-created 
by any person having an interest in the property; (3) Whether strict application of the 
relevant provisions of the code would deprive the applicant of reasonable use of the 
property; and (4) Whether the variance proposed is the minimum variance needed. After a 
review of the standards above, Community Development believes that the encroachment 
will not adversely affect surrounding residents; therefore, staff recommends approval of 
the requested variance with the following conditions:  
 
1. Approval of the requested variance shall be conditioned upon the development of 
the property in substantial compliance with the site plan and elevations submitted 
with the variance application. 
2. Gutters and downspouts shall direct stormwater as such that runoff is contained 
wholly on the subject property without adversely impacting adjacent properties. 
3. A building permit application must be submitted for the accessory structure in the 
rear prior to permit issuance for the garage addition. The Certificate of Completion 
for the garage shall be held until the accessory structure permit has been 
completed. 
 
R. Tiller, in place of applicant Keisha Chambers, came forward and stated that 
understands and agrees to the three stipulations read into record.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item. 
 
Board Member Bo Jones made a motion to approve item V25-063; seconded by Board 
Member Mary Moore.

background: 
  
The subject parcel is a 0.4-acre lot located on the southeastern intersection of Dunn 
Street and Collier Drive. The subject parcel and all adjacent parcels are zoned R-20 and 
are all occupied by single-family detached residences (with the exception of the property 
to the east, which is currently under construction). 
  
A building permit was recently issued in February 2025 for an interior renovation and new 
roof extension over an existing patio. After the permit was issued, the applicant went
