Caitlin Crowe, Land Services Development Coordinator, provided the following 
background: 
  
The applicant received approval from the License and Variance Board in April 2025 to 
reduce the northern side setback from 10 feet to 7.1 feet, allow a second accessory 
structure, and increase the impervious surface area from 35% to 41.7% (Variance Cases 
V25-036-037 and 048). The applicant is requesting to further increase the maximum 
impervious surface area and thus amend the previously approved variance area in order 
to build an addition and an inground swimming pool in the rear of 4107 Antler Trail. The 
maximum impervious surface area is associated with Section 801 of the Zoning Code. 
  
The subject parcel is a 0.49-acre lot located on the east side of Antler Trail in the 
Deerwood subdivision. The subject parcel and all adjacent parcels are zoned R-15 with 
the exception of the parcel to the rear, which is zoned R-20; all are occupied by single-
family detached residences. 
  
The property is currently occupied by a one-story 3,367 square foot single-family home 
with a finished daylight basement and a 645 square foot detached garage. The original 
variance application intent remains the same, with the applicant proposing to completely 
remodel the main floor of the home, leaving the basement as-is. The applicant is 
proposing to replace the existing 484 square foot rear deck with a 1,655 square foot 
addition, install a 1,050 square foot inground swimming pool, and remodel the existing 
detached garage to create a pool house. The addition will consist of a new master suite, 
laundry room, dining room, and 572 square foot covered patio. The remodeled pool house 
will transition the garage into a bedroom, bathroom, and kitchenette and is to be used by 
the applicant’s family members and guests who are visiting or using the adjacent 
swimming pool. 
  
After the addition of the swimming pool and building addition, the previous variance 
application contemplated an increased impervious surface area of 41.7% (or 4,127 square 
feet). Although the addition and swimming pool surface area square footages have 
remained the same, the pool deck, pool retaining wall, and stairs leading to the pool deck 
have increased by a total of 233 square feet to accommodate a larger distance between 
the home and garage foundations and the swimming pool. Additionally, the pool deck, 
which was previously in part made of pervious pavers (at 840 square feet), will now be 
completely impervious so the previously proposed infiltration gravel would not become a 
maintenance nuisance. Thus, the impervious surface area will be above the allowable 
41.7% (as approved by Variance Case V25-048) by an additional 5% (or 1,073 square 
feet). To offset the additional increase in impervious surface area, the applicant is 
proposing three dry wells in the rear of the existing accessory structure. The Engineering 
Department has reviewed the application and is supportive of the proposed mitigation 
method with the stipulation that a Stormwater Inspection & Maintenance Agreement be 
recorded prior to pool permit issuance.
