would deprive the applicant of reasonable use of the property; and (4) Whether the 
variance proposed is the minimum variance needed. After a review of the standards 
above, Community Development believes that the encroachment will not adversely affect 
surrounding residents; therefore, staff recommends approval of the requested variance 
with the following condition:  
 
1. Approval of the requested variance shall be conditioned upon substantial 
compliance with the site plan and elevations submitted with the variance 
application. 
 
Chairperson Jones asked if the fence was a four-foot fence, extending it out to the same 
place they are currently proposing would still not require a variance? Ms. Crowe confirmed 
that is the case. The variance is only required in this situation because they want to install 
a six-foot fence. Ms. Crowe also stated that Mark Wolff, City Engineer, has reviewed this 
application and has determined there are no sight distance issues.  
  
Vincent Price, applicant, stated that the HOA has approved the fence with minor 
stipulations, including painting it the same color as the trim of the house and planting tea 
olive bushes along the fence. He stated he understands and agrees to the standard 
stipulation read into record. 
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item. The public hearing was closed.  
 
Board Member Carson Haynie made a motion to approve item V26-071; seconded by 
Board Member Mary Moore. 
 
The motion to approve carried with the following vote: 
 
Aye: 3 –  Chairperson Jones, Board Member Moore, Board Member Haynie 
Nay: 0 –  None 
Recuse: 0 –  None

Board Member Mary Moore made a motion to approve item MIN2026-141; seconded by 
Board Member Carson Haynie. 
 
The motion to approve carried with the following vote:

Nay: 0 –  None 
Recuse: 0 –  None
