The problem with the setback of five feet is it obstructs the view. A reduction in size of garage would be difficult because he owns a larger truck. He stated he understands and agrees to the three stipulations read into record. Board Member Worthy stated that she would like Mr. Maryland to acknowledge that should the city need to make any improvements on that road, because their property abuts the right-of-way, they risk losing even more property. Chairperson Jones added that if the city needed to improve the entrance into Brinkley Park, it could impact his building. Mr. Maryland stated he understands. Chairperson Jones asked what kind of garage door he would have. Mr. Maryland stated the garage door would be automatic. Chairperson Jones asked that the garage door being automatic be added as an additional stipulation. Chairperson Jones also stated he would like to stipulate that an additional survey be completed for the slab and it be staked before any concrete is poured. Mr. Maryland stated he is in agreement with the additional stipulations. A public hearing was called for items V26-027, V26-028, and V26-059, and no one came forward in favor of or in opposition to these items. The public hearing was closed. Board Member Andrea Worthy made a motion to approve item V26-027; seconded by Board Member Dustin Davey. The motion to approve carried with the following vote: Aye: 3 – Chairperson Jones, Board Member Worthy, Board Member Davey Nay: 0 – None Recuse: 0 – None B. V26-028 Public Hearing - Variance Request - V26-028 – Reduce the streetside setback from 23.3 feet to 0.5 feet - Land Lot 523 – 3062 Dunn Street – Albert Maryland Ward 6 Mayor Pro Tem / Councilmember - Tim Gould Board Member Andrea Worthy made a motion to approve item V26-028; seconded by Board Member Dustin Davey. Let it be noted that the motion to approve is in opposition to staff recommendation for denial. The following stipulations shall be added: • Garage door(s) must open electronically. • Prior to foundation pour, the corners of the detached garage shall be staked and an as-built survey shall submitted and approved. The motion to approve carried with the following vote: Aye: 2 – Board Member Worthy, Board Member Davey Nay: 1 – Chairperson Jones Recuse: 0 – None C. V26-059 Public Hearing - Variance Request - V26-059 – Increase the maximum accessory structure height from 15 feet to 16 feet - Land Lot 523 – 3062 Dunn Street – Albert Maryland Ward 6 Mayor Pro Tem / Councilmember - Tim Gould Board Member Andrea Worthy made a motion to approve item V26-059; seconded by Board Member Dustin Davey.
