8. A letter of no conflict from Cobb Water & Sewer shall be submitted prior to the 
issuance of the land disturbance permit.  
9. Curb and gutter shall be installed along Cooper Lake Road for the development.  
10. Approval of the subject property for the TD-Conditional zoning district shall be 
conditioned upon the development of the property in substantial compliance with 
the site plan submitted 9/5/2025 and created by Woodruff Design Associates. and 
all zoning stipulations above. 
11. Approval of the subject property shall be conditioned upon substantial compliance 
with the elevations submitted on 8/14/2025. 
 
Chairperson Powell asked the applicant to provide an overview of the request. Mr. 
Mahony came forward on behalf of the applicant and briefly described the property. 
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item. 
 
Commission Member Earl Rice made a motion to approve item Z25-011; seconded by 
Commission Member Michael Seagraves. 
 
The motion to approve carried with the following vote:

Commission Member Ostrzega

 B. Z25-012 Public Hearing - Zoning Request - Z25-012 - Allow rezoning from R-15 to R-10-
Conditional for the development of four single-family homes at a density of 2.61 units per acre 
- Land Lots 445 & 446 - 1.53 acres - Brookwood Home Designs - 0 Belmont Circle 
Ward 5 Councilmember - Susan Wilkinson 
 
Joey Staubes, Planner II, presented staff recommendation for the rezoning request at 
Belmont Cir. The request is to be heard by Mayor and Council on October 20, 2025. The 
request is to rezone the current parcel from R-15 to R-10-Conditional to allow for four 
single-family homes. The future land use map will not change. The applicant will need to 
relocate the existing public pet-service container. No variances are being requested. 
  
Staff is recommending approval with the following conditions: 
 
Standard Conditions  
1. The composition of the homes in a residential subdivision shall include a mixture of 
elements including; but not limited to: brick, stone, shake, hardy plank and 
stucco.  No elevation shall be comprised of 100% hardy plank siding.  The 
residences whose lots abut external roadways shall not be permitted to utilize 
hardy plank for any elevation facing these roads. 
2. All utilities within the development shall be underground.  
3. The developer shall be responsible for any traffic improvements (including 
additional right-of-way dedications) deemed necessary by either the City or the 
County during construction plan review.  Sidewalks shall be provided by the 
developer inside the subdivision and outside the subdivision adjacent to any public 
right-of-way consistent with city's requirements for the extent of the development.
