building previously used for an office. The applicant has no plans to redevelop the 
property and will utilize the existing building and parking facility as-is. 
  
Community Development recommends approval of the rezoning from OD to GC at 
2351 Benson Poole Road with the following conditions:  
1. The following uses shall be prohibited:  
• (710.2.1) Automobile Broker Office.  
• (712.5) Auto Parts and Tire Stores.  
• (712.6) Automobile Repair (Major and Minor).  
• (712.7) Automobile and Truck Sales and Service.  
• (712.8) Automobile Wash Services.  
• (712.15) Drive-thru restaurants.  
• (712.26) Motorcycle Sales and Service.  
• (712.29) Package Stores for the sale of alcoholic beverages.  
• (712.43) Service Stations.  
• Hookah Bars.  
• Vape Shops.  
• Parking and storage of commercial vehicles, semi-tractors, and trailers.  
• Impromptu Weekend Markets within the parking lot.  
• Adult Entertainment and Adult Novelty Shops as defined by the City of    
  Smyrna’s Code of Ordinances. 
2. The following uses shall be conditional:  
• Event facilities shall only operate between the hours of 8:00 am and 10:00 
pm.  
• Restaurants shall only operate between the hours of 8:00 am and 10:00 pm.  
• Laundry and Dry cleaning shall be pick-up and drop-off only. 
3. All businesses shall comply with Sec. 46.1 Noise Regulation in the City of 
Smyrna’s Code of Ordinances. 
 
Alejandra Sanchez, applicant, stated the property has been vacant for over a year. 
She wants more opportunities for different tenants. She has no objections with the 
restrictions.  
  
A public hearing was called, and no one came forward in favor of or in opposition to 
this item.  
 
Councilmember Susan Wilkinson made a motion to approve item Z25-009; seconded 
by Councilmember Glenn Pickens. 
 
The motion to approve carried with the following vote: 
 
Aye: 7 –  Councilmember Pickens, Councilmember Hines, Councilmember 
Lindley (virtual), Councilmember Welch, Councilmember Wilkinson, 
Mayor Pro Tem / Councilmember Gould, Councilmember Oglesby
