Mr. Martin also added that if this were to get approved, it would also go through the civil 
plan process. Once they have substantially installed all infrastructure, that is when we 
could subdivide the property. Prior to the final approval for the final plat, the City requires 
an as-built certification from the engineer of record to say it has been done per plan. 
Chairperson Powell also confirmed that the pond would need to be in place prior to 
construction commencing on the property. The City also requires an Inspection and 
Maintenance Agreement on the pond. 
  
Commission Member Howard clarified the posting requirements. Mr. Staubes said that it 
was updated April 22, and Mr. Martin said that the next hearing will also be posted in the 
MDJ prior to Mayor and Council.    
  
Commission Member Carter thought the delay was going to be the elevations but does 
have concerns about the side setback variance since it looks like it does not quite match. 
  
Chairperson Powell said a few words regarding traffic and how it is always an issue and 
mentioned how there is a sidewalk that wraps around the property and should help. 
 
Commission Member Walter Kolis made a motion to deny item Z26-004; seconded by 
Commission Member Jill Gordon-Evans. 
 
The motion to deny carried with the following vote: 
 
Aye: 5 –  Commission Member Howard, Commission Member Rice, Commission 
Member Gordon-Evans, Commission Member Carter, Commission 
Member Kolis 
Nay: 0 –  None 
Absent: 2 –  Commission Member Twomey, Commission Member Bentley

Commission Member Earl Rice made a motion to approve item MIN2026-085; seconded 
by Commission Member Walter Kolis.
