April 08, 2026 10:00 AM City of Smyrna License and Variance Board Meeting 2800 King Street SE Council Chambers Page 11 of 15 Board Member Worthy asked why is there a difference in impervious surface requirements for this item versus one that will be heard later in this meeting even though they are just down the street from each other. Ms. Crowe explained that when this property was rezoned in 2015, it was rezoned to RDA which has a maximum of impervious surface of 45%. The other one is zoned R-15 with a maximum impervious surface of 35%. Impervious surface requirements are zoning district dependent. Vice Chair Garland asked if there is a requirement to plant additional landscaping efforts, and Chairperson Jones asked about the stormwater structure. Clara Hodges, Plan Reviewer, stated as the property currently stands, with the addition of the pool, they will move the backyard water quality pit further away from the house and enlarge it to account for the overage of impervious surface. As far as landscape plans, final stabilization is required prior to permit close out. It would need to be as close to original condition as possible. Chairperson Jones asked if they would need to apply to the state for a variance. Ms. Hodges stated that even if they needed to move the quality pit, it would need to be far enough from the 25-foot buffer to be able to install a double silt fence and any other erosion control as necessary. Jacob King – applicant – stated he understands and agrees to the six stipulations read into record. A public hearing was called for V26-034, V26-032, and V26-33, and no one came forward in favor of or in opposition to these items. The public hearing was closed. Board Member Richard Garland made a motion to approve item V26-031; seconded by Board Member Andrea Worthy.
