The existing sidewalk shall be reestablished once the driveway has been removed. 3. A Stormwater Inspection and Maintenance Agreement shall be completed and recorded with the Cobb County Superior Court prior to issuance of the building permit. An as-built certification statement shall be submitted to Community Development prior to issuance of the Certificate of Occupancy. 4. Any damaged or broken curb or sidewalk caused during construction shall be replaced prior to issuance of the Certificate of Occupancy. V26-030 Public Hearing - Variance Request - V26-030 - Reduce the western side setback from 10 feet to 5.6 feet - Land Lot 262 - 4304 Fawn Lane - Cameron Brown Ward 4 Councilmember - Charles 'Corkey' Welch Caitlin Crowe, Land Development Services Coordinator, provided the following background: The applicant is seeking a variance to reduce the side setback from 12 feet to 5.6 feet to retain a room addition at 4304 Fawn Lane. The side setback is determined by Section 801 of the Zoning Code. In Spring 2025, an addition and deck replacement were constructed on the rear of the property without obtaining a building permit or variance. Once notified, a permit application and variance application was submitted in June 2025. The subject parcel is a 0.51-acre lot located on the north side of Fawn Lane in the Deerwood subdivision. The subject parcel and all adjoining parcels are zoned R-15 and are all occupied by single-family detached homes. A stream runs behind the property with a small portion of the rear yard encumbered by the City’s 75-foot impervious surface setback. The applicant is requesting to retain the new 144 square foot addition on the rear of the house; the replaced deck may remain without the need for a variance. The existing home, built in 1973, currently encroaches into the western side setback by 4.4 feet. (Note that the applicant has measured the distance from the side property line at 12 feet. However, without a survey to confirm, the applicant has chosen to pursue a variance to encroach into the setback based on Smyrna GIS Aerial measurements.) The new addition is in line with the existing rear of the home, which will continue the encroachment. However, since the home is currently 5.6 feet from the western side property line, the hardship is not self-
