 A. ORD2026-004 ORD2026-004 for a Code Amendment to Chapter 22 - Businesses, Article VIII, 
of the Smyrna Code of Ordinances, Mobile Food Vendors, Section 22-300 regarding the 
requirements for processing applications for Mobile Food Vendors licenses and appeals for 
application denials and Section 22-303 regarding suspension and revocation of Mobile Food 
Vendors licenses and authorize the Mayor to sign and execute all related documents.

Councilmember Wilkinson mentioned that the ordinance meets the requirements as they 
were when it was originally passed, but there are some conditions that are not being 
enforced. One condition is that food trucks are supposed to be temporary and removed.  
  
Scott Cochran, City Attorney, stated that this is an enforcement issue. He wanted to clean 
up this ordinance so that any business that gets a license in Smyrna that the vehicle for 
denial, suspension, and appeals are the same – the process is standardized.  
 
 B. COW2026-026 Personnel Discussion – Carol Sicard 
 
Carol Sicard, Human Resources Director, explained that In December 2019, twelve 
employees reached the maximum of their designated pay ranges. At that time, the Council 
authorized “top-out bonuses” equal to the amount exceeding the pay range maximum, 
distributed quarterly. These payments were issued in March, July, and October 2020, and 
January 2021, after which they were discontinued. Following completion of the UGA Class 
& Compensation Study, it was confirmed that employees who reach the maximum of their 
pay range—regardless of pay plan adjustments — are considered topped out. This practice 
has been consistently applied since that determination.
