Board Member Randall asked if there is a specific plan for the undisturbed buffer portion 
to be stabilized. Mrs. Crowe stated that a plan of that nature has not yet been submitted 
but will be with the building plan.  
  
Joel Powell, applicant, came forward and had nothing further to add. He answered Board 
Member Randall’s question and stated that he expected the area to be sodded and used 
as a yard. Mr. Randall suggested that they look into a suitable ground cover to be used as 
a yard, and that Bermuda sod is not the best option. Mr. Powell stated he understands the 
stipulation read into record.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
 
Board Member Eric Randall made a motion to approve item V25-012; seconded by Board 
Member Bo Jones. 
 
The motion to approve carried with the following vote:

Board Member Bo Jones made a motion to table item V25-013 to the February 26, 2025 
License and Variance Board meeting at the request of the applicant; seconded by Board 
Member Eric Randall. 
 
The motion to table carried with the following vote:

 C. V25-014 Public Hearing - Variance Request - V25-014 - Allow encroachment into the City's 50-
foot undisturbed stream buffer - Land Lot 628 - 3262 Millwood Trail - Dwight Robinson

Caitlin Crowe, Planner I, provided the following background: 
  
The subject parcel is a 0.18-acre lot located on the east side of Millwood Trail within the 
Heritage at Vinings subdivision (see Figure 1). The subject parcel and adjacent parcels to 
the north, east, and west are zoned RDA whereas the parcels to the south are zoned R-
15; all are occupied by detached single-family homes. 
  
The rear yard and a majority of the existing home itself is greatly encumbered by the 
State’s 25- foot undisturbed buffer, the City’s 50-foot undisturbed stream buffer, and the 
City’s 75-foot impervious surface setback, with no section of the rear yard untouched by 
stream buffers. The applicant is proposing to replace the existing two-story deck on the 
rear of the home with a new screened-in porch and small 80 square foot deck addition.
