2. Any portion of the southern shed wall that encroaches closer than 5 feet to the rear 
property line must be painted with fire-retardant paint, or as deemed necessary by 
the Chief Building Official prior to pool permit completion. 
 
Chairperson Jones asked if the existing structure is in violation of the existing setback. Mr. 
Staubes stated it is, but they were not required to submit permits for the shed because it 
was less than 200 sq. ft.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
 
Board Member Andrea Worthy made a motion to approve item V26-009; seconded by 
Vice-Chair Richard Garland. 
 
The motion to approve carried with the following vote: 
 
Aye: 3 –  Chairperson Jones, Vice-Chair Garland, Board Member Worthy 
Nay: 0 –  None 
Recuse: 0 –  None 
 
 C. V26-010 Public Hearing - Variance Request - V26-010 - Allow second accessory structure - 
Land Lot 701 - 3373 Campbell Road - Newsom Reaves 
Ward 1 Councilmember - Glenn Pickens 
 
Joey Staubes, Planner II, provided the following background: 
  
Because there is a shed already in the backyard, the pool is considered a second 
accessory structure resulting in the need for this variance. The same two conditions read 
into record for V26-009 apply to this variance as well.  
  
Reaves Newsom, contractor/applicant, stated he and the homeowner understand and 
agree to the two conditions read into record for both V26-009 and V26-010. 
  
Chairperson Jones asked what the purpose of the shed is. Mr. Newson stated that it is for 
storage of gardening tools.  
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.  
 
Vice-Chair Richard Garland made a motion to approve item V26-010; seconded by Board 
Member Andrea Worthy. 
 
The motion to approve carried with the following vote:

Nay: 0 –  None
