self-created by any person having an interest in the property; (3) Whether strict application 
of the relevant provisions of the code would deprive the applicant of reasonable use of the 
property; and (4) Whether the variance proposed is the minimum variance needed. After a 
review of the standards above, Community Development believes that the variance will 
not adversely affect surrounding properties; therefore, staff recommends approval of the 
requested variance with the following condition:  
 
1. Approval of the requested variance shall be conditioned upon substantial 
compliance with the site plan and elevation submitted with the variance 
application. 
 
Ehab Jaleel, Executive Director of Amana Academy, came forward. Board Member 
Randall asked about gates, where they were located, and if they would be open or closed 
during school hours. Mr. Jaleel stated that they currently have a functioning gate that 
remains open during school hours. The school is a K-8 school with the gate installed on 
the actual driveway. The facility is monitored also by a full-time resource officer who is 
also a licensed police officer. The gate is closed when school is not in session. Mr. Jaleel 
stated he appreciates the partnership with Community Development and staff, and he 
understands and agrees to the stipulations read into record.   
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item. 
  
 
Board Member Eric Randall made a motion to approve V24-004; seconded by Board 
Member Andrea Worthy. 
 
The motion to approve carried with the following vote:

 C. V25-005 Public Hearing - Variance Request - V25-005 - Allow second accessory 
structure - Land Lot 484 - 1143 Pinedale Drive - John Martucci 
Ward 3 Councilmember - Travis Lindley 
 
Caitlin Crowe, Planner I, provided the following background: 
  
The subject parcel is a 0.3-acre lot located on the north side of Pinedale Drive (see Figure 
1). The subject parcel and all adjacent parcels are zoned R-15 and are all occupied by 
single-family detached residences. 
  
The property is currently occupied by a two-story single-family home, completed in 2023, 
and a 154 square foot shed in the rear of the property. The applicant is proposing to 
construct a new 576 square foot inground swimming pool and accompanying pervious 
paver deck to be situated between the existing home and shed. Since the accessory 
structure ordinance allows one accessory structure or use per lot, a variance is required to 
have the second structure. The applicant is proposing to retain the shed to be used as a 
storage shed for pool and lawn equipment; since the swimming pool and storage shed 
offer different uses for the property, the variance is not self-created.
