V25-080 Public Hearing - Variance Request - V25-080 - Reduce the rear setback from 15 feet to 11.1 feet - Land Lot 380 - 544 Cresentry Brook - Jacob Barker Ward 3 Councilmember - Travis Lindley Caitlin Crowe, Land Services Development Coordinator, provided the following background: The subject parcel is a 0.13-acre lot located on the southeastern side of Cresentry Brook. The subject parcel and all adjoining parcels are zoned RDA and are occupied by single- family detached homes within the Logan’s Walk subdivision, with the exception of the parcel to the northwest, which is occupied by the subdivision’s open space. The applicant is proposing to cover the existing concrete patio with a 168 square foot roof to enjoy the outdoors even in inclement weather. Patios that are flush to the ground are not required to meet building setbacks. However, once the roof is added over the patio, the roof will encroach into the rear setback by 3.9 feet. Due to the existing patio location, the most logical area to construct the roof is within the rear setback. The subject property is currently buffered from adjacent properties by an existing wooden privacy fence so impact to neighboring properties would be minimal.
