The staff certainly wants to support its future land use plan and we understand that. Uh but this area when you look along Highlands Parkway, it's an area that's developed actually as a very much a mixture of use. It's a mixeduse parkway. Highlands Parkway is it's zoned and used for office uses, extensive office uses. It's also has some industrial uses that are distribution and office industrial types of uses. But importantly, directly across Highlands Parkway, there's significant commercial, retail, and restaurant offerings and uses that are right there on Highlands Parkway. And there's also residential on Highlands Parkway there at Lakeidge. Exactly. Those uses are all on Highlands Parkway. That's a mix mixture of uses if I've ever seen one, along Highlands Parkway. Our proposal, we believe to reszone this seven acres uh is consistent though with that mixture of uses. It adds to the mixture that's already there. This area is not dominated by one particular use. It's dominated by the variety of uses that are along Highlands Parkway and therefore we believe this proposal by Wood Partners adds to doesn't take away and certainly is not inconsistent with that mixture. Moreover, as a community and as a region, from that perspective, it's undoubted unquestioned that there is a housing shortage and we need housing, especially in areas that are in close proximity to major employment centers like Highlands Parkway is a major employment center with the offices that are there and located. It's a great location given its proximity to South Cobb Drive and 285, its proximity to East West Connector through Highlands Parkway. That connectivity and that proximity again has an opportunity here to place housing in an area that can access those types of major roadways and short distance and can access those types of employment centers and the mixture of uses that are there.

that we also update the residential zoning classes and requirements that we concurrently and preemptively upzone these areas to match the future land use map uh to facilitate development as well as provide uh opportunities for missing middle housing options. I have this report that I'd like to submit to the clerk for distribution if that's possible. Uh yes, there should be a copy there for him as well. Okay. Sorry. Yep. Thank you all. Thank you. Thanks very much. Thank you. Any uh anybody else like to speak? All right. Seeing that we'll close the portion of the public hearing. There's no vote required on this and unless anybody on council has any other comments or questions. We'll move on. Okay. Thank you very much. Thanks, Rusty. Thanks, Kyle. And for whatever reason, the city did not divide that into two separate parcels at that time with two separate tax IDs. The sister kept both pieces under one tax ID. And that's why we have a situation where we're really looking at two separated pieces of land that are all under one parcel and one tax ID. And that's why we're not reszoning them separately. We have to treat them as one per what we understand from the city. Um, this site is uh currently mostly wooded site and the house that's in the middle of it is quite nicely maintained. And uh what we've seen over the years and I think some staff can attest to this is that the fronts of this property is a dumping ground for the people that walk back and forth from the apartments and they throw their trash and all that. There's even a small trash can that somebody put out there at some point. And I I questioned during the the during the uh planning and zoning, why is there a doggy pot trash can out here in front of this project? And no one could really explain it, but it turns out it may be because there was a bunch of liquor bottles being thrown in front of these lots. So, our hope is that in doing this, we're going to do nothing but improve the neighborhood. We're uh you guys have seen myself and Rick here many times. I think we've built like what do we say 18 homes now in the city of Smyrna? I'm over 30. Over 30. Okay. So, um And I know that this is the 13th time and I 13th together. That's right. So you you all know what we build and uh we generally build a pretty nice product and uh we're pretty much looking at the same types of houses here.

Corki was asking about sprinklers in the house, and Joey's answer was if it's it's 10 feet, so they don't need to be sprinkled. Okay. Well, I guess mine would be uh the width is 49 and a half, you said, correct? And the is that enough room to build the the what's in the um the renderings of the elevations the width with the Yes. I mean that's 50 minus 10 is 40t wide to build a 40 foot wide house. And these are conceptual elevations. It's not exactly the lot, the the width or the the roof angles. It's just conceptual. It'll it'll be this type style of house when they get built. Are the um the variances that are being requested are they um the same variances that have been approved for other That's correct. developments on that same street. Okay. Thank you. is the applicant here. You'd like to come up and tell us a bit about the project, please. Good evening, Mayor Prom and council members. I'm David Woodbury for the applicant. Um almost exactly a year ago, this council approved the adjacent development that u that this property will be a phase two for. And as as Joey mentioned, the stipulations, the conditions, the lot sizes are basically all identical. Um, and we're going to tie into that same storm water system. We were able to get that to public works before construction started so that it could be enlarged to handle the additional water runoff here. Um, the lot widths are the same. All those lots along Bell Drive are 100 feet wide. And basically what these the plan last year and this one does is just divides it in half. Um and the homes that are on the elevations are the stylistic u the details the widths are all fit within those lots but the you know the exact detail and the exact architecture um finishes will uh you know are in design plan right now.

You don't want to see them. The number of accidents there are huge. It It's one of the most dangerous intersections in Cobb County. I'm you have probably heard things about this intersection before. Um so our safety is a big concern. Um and our home values were concerned about that. Although 700 800,000 is not where I would be able to go either. So, but um because of the traffic we and and and the other issues, we believe it could decrease our home values because nobody will want to come down there. So, that is my short presentation. I appreciate your your um attention and I don't know if you want to ask any questions or anything, but I appreciate it. Thank you. Sean Murphy, 3282 Lee Street, Forest Hills. Um I think my uh I'm generally in support of this uh project and I think uh when you look at the site um there's a medical office building across the street and for some of the same reasons she just said she's concerned about traffic. Well, if we don't zone it residential for 13 town homes, what's it going to be? It's going to be something commercial. that means it's going to be another retail building or an office building or something that's going to generate far more traffic than 13 town homes would. So, I would argue actually that town homes is probably the least amount of traffic you're going to get if you develop something on that corner. Um, the other thing is it's it just makes sense as a step down zoning. We're going from office, we've got a daycare, we've got a fire station, and then all around it, we've got fairly high density or moderate density uh very small lot residential developments except for the one house that's to the north. And so this these town homes, which in a town home sense, it's not even a very dense town home development.

And the plan that you currently have reflects uh that's been replaced with a ride in ride out. And that right in has a right turn storage of about 150 feet plus another 100 feet or so of taper to provide additional stacking. Um, and I mentioned that it was looked at two different ways. Well, the property is already zoned and it's currently zoned for about 20,000 square feet of commercial and 163 multifamily housing units. So the other way they looked at this was they did what's called a trip generation comparison. How many trips would that development generate versus what is currently being proposed? And what is currently being proposed is reducing the family housing units from 163 to 45 and reducing the square footage on the commercial from 20,000 to 5,000. Now, that's not apples to apples because the trips generated from the 20,000 square feet of commercial as it's zoned is not quite as intense as what would be permitted under this proposed plan. But the net of those two is a reduction of about 164 trips a year between what is currently allowed that zoned versus what is being proposed. So, it would change about a 12% reduction based on what you could do versus what they're proposing to do. So, that in a nutshell is the um the summary of what was presented last Thursday. Thank you, Mr. Jones. Um, council, you have heard extensive testimony from residents. You heard from the applicant. You now have the results of the of the traffic study. Um, I'd open it up to y'all for any questions that you have of our staff or any comments that you'd like to make. Uh, now this is in ward seven. Mr. Oglesby. Yeah. Thank you, Mr. Mayor. Uh, first of all, I want to thank everyone that has come today and and obviously uh exercising their rights as citizens to display their uh their disregard and obviously want for us to deny this this uh motion.

Appreciate it. I think we got him. I think he really was surprised. 100%. All right. Now, we're going to go on to the rest of our agenda. We have number seven is community development items. We have one item here that needs to be withdrawn at the uh request of the applicant. This is item A, zoning request Z25-014. I'll need a motion approve the withdrawal. Motion by Councilman Lley, second by Mr. Pickkins. Everyone, please vote. And I should note that Councilwoman Hines is joining us virtually this evening. How do you vote, Miss Hines? In the affirmative. And Mr. Welch is obviously not here. He had And that's approved 6. All right. Item B, this is a public hearing Z25-016. Allow reszoning from LC to R15 conditional for the development of one single family home.57 acres landlock 592 uh 1521 Roswell Street in Ward 3. I'm sure Travis is going to want Joey to present everything. Yes, sir. I'm Joey Stabs, planner 2 in the community development department. This is uh zoning case C25-016. The applicant is Eric Nice. The planning and zoning commission heard this on November 10th and they recommended approval 6. Subject property is 1521 Roswell Street, a little over half an acre in W three. There was previously a house on this lot that was demolished. It's got a limited commercial zoning currently. So, it needs to be reszoned residentially to rebuild a house on the property. So, that's what they're requesting reszoning from LC to R15. As you can see on the zoning map, several of those properties on Roswell Street have commercial zoning. They'll all have to come through whenever they get redeveloped. The future land use is moderate density residential. That will not change. This is the proposed site plan. Um it'll have the R15 setbacks except they're requesting a reduction on the east side.

Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM
Summary in the published minutes, not a verbatim quotation.
A. COW2025-003 Review of the January 6, 2025 Mayor and Council Meeting Notice and Agenda Z24-016, ORD2025-002: Russell Martin, Community Development Director, provided the following background: WSE Development LLC. is requesting to rezone 9.8 acres of assembled properties at the north eastern intersection of Dixie Avenue and Windy Hill Road. 0.2 acres is zoned HI (Heavy Industrial) in Cobb County, and the remainder is zoned GC (General Commercial) & LI (Light Industrial) in Smyrna. Maple Drive and Park Drive will be abandoned and incorporated within the proposed development. After abandonment and dedication the development is approximately 10.3 acres. The applicant is proposing to demolish the existing church and parking lot to construct the mixed-use development. The proposed mixed use development includes one four-story building, one four-five split level building at the interior of the property, two garage units at the western perimeter, two four-unit buildings at the northern perimeter, and a two-level parking deck at the north eastern perimeter. The multi-family units will include a pool, amenity area, and fitness facility. The mixed-use development will house 295 multi-family units at a density of 29 units per acre and 30,000 sq. ft. building for civic uses. A central road will connect the multifamily and civic building and incorporate the two uses as a cohesive development. The proposed development will be accessed by two access drives on Davis Road, one access drive on Dixie Avenue, and one access drive on Hillside Drive. The proposed development will have 472 total parking spaces for the multi-family units and 141 spaces for the civic building. The majority of the parking for the development will be surface parking and 146 within a two-level parking deck. There will be two underground stormwater detention facilities planned for the development. Community Development has reviewed the proposed plan against the zoning requirements of the MU zoning district (Section 720 of the Zoning Ordinance) with regards to setbacks, building height and building separations.

The use and everything that they're proposing with respect to the credit union is allowable under the mixeduse uh zoning classification. Um, so at this point we're just we're we're dealing with zoning stipulations on the on the original zoning request. Um, and like I said before, due to its location in the downtown area, that requires that it be uh reviewed by the Urban Design District, and that was done on uh September 19th. This request is really applying to the Ken's Corner Grill property and the vacant lot uh in between Ken's and the office building. Um the office building property will remain mixed use. Um if they decide to redevelop that property at a later date, then um that'll come back through uh the zoning process to do that. Did you say when they wanted to redevelop that or if when or if when? Um so at that point they'll come back and and reszone that property that's not part of this uh reszoning or zoning amendment at this point. So the property is going to remain mixed use with respect to this zone zoning action. The future land use has a mixeduse uh future land use designation that is remaining unchanged as part of this as well. Here's the site plan. So, um we're looking at about a 3600 foot building that'll front on uh Atlanta Road and Church Street with the entrance being at the intersection of Church Street and Atlanta Road. Um you'll have uh a front set back of zero feet, a side set back is zero, and a rear set back of 20. These are in compliance with the mixeduse uh zoning district. No variances needed here. Um obviously it's a 3600 square foot building with a covered ATM and Taylor access for drive up uh service. There are 25 parking spaces on the property.

All right. We'll move on now to the rest of our agenda. First, uh, under item seven, community development items. I think this is the only one. Yes. Uh, Z, this is item A, Z25-015. This is a a public hearing zoning amendment Z25-015. Request to modify the site plan, elevations, and zoning conditions of Z21-014, land lot 751 and 752. Um this is a zoning amendment case to a previously uh approved reszoning of the property. Um this is zoning case Z25-015. He uh SimRNA is the the applicant. Um this went before the planning and zoning board on uh January 5th and it received an approval of 3 to two um with a recommendation for approval of 3 to2. The subject property is located on the northeast uh corner of the intersection of South South Cobb Drive and Oakdale Road. Um it's approximately uh seven acres in size. Um, it's currently a vacant assemblage. It's a wooded lot. There used to be an old uh church building there, but that's since been demolished since the the last resoning. Um, the applicant is proposing 45 town homes and uh 5,000 square feet of uh drive-thru restaurant. Um I'll go through what was previously approved and then what they're what what they're proposing now. Um the zoning of the property will remain um mixed use conditional conditional with this request and there'll be no changing.
