Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM
Summary in the published minutes, not a verbatim quotation.
All appointees were present except one who had a death in the family. The next meeting is scheduled for April. Over the next ten months they will work on a concept they will present to Council before the end of the year. City Administrator Joe Bennett reviewed the recent meeting with Cobb County regarding discussion on the HB489 agreements. Cobb said we owed them $95,000.00 for traffic signals and wanted us to maintain our portion of the East -West Connector, however we have no agreement related to East – West Connector and offered to take back our traffic signals and maintain them. The County declined our offer. Mayor Norton spoke about the Red Light Cameras and requested the collections numbers for the past year as well as statistics as to whether they have changed behaviour. Deputy Chief Mark Binicewicz was present and stated he would generate a report he would share. Councilmember Oglesby wants the cameras to remain as the area is a raceway in the areas of the cameras. It was noted by the other members we have flock cameras all over the City to help combat racing. Councilmember Wilkinson would like to see before and after accidents in those camera areas as well. Mr. Bennett discussed the Ga Power street light replacement project. The Smyrna Hill beaver damn was resolved. No input regarding the status of the beaver. Councilmember Oglesby remarked about the crosswalk status update and that one of them had been repainted possibly and sealed. The RFQ is out for painting the fire hydrants. He attended the Cobb County Commission meeting where they spoke about upgrades to Oakdale Road. Councilmember Glenn Pickens had a meeting with the newest House Rep which went well. He lives in Glenn’s ward. Councilmember Hines attended the Cobb annual dinner where Ron Newsome was recognized. Black History Month program tickets are available for the February 28th activities.

Approval of the July 20th pre-consil meeting minutes. And approval of the July 20th mayor and council meeting minutes for the mill rate public hearing number three. Thank you, Mr. Jones, and thank you for wearing a coat tonight. Very distinguished. May I have a motion to approve the consent agenda? So, moved by Mr. Pickkins, second by Miss Hines. Everyone, please vote. Mr. Lindley in the affirmative. And the consent agenda is approved. 6. We're now to the citizen participation portion of our meeting. Uh, we have three people signed up for public comment this evening. The first one is Chris Nave, 1100 South Marietta Parkway. Welcome. Hello. Thank you. All right. Five minutes, correct? Three. Oh, okay. All right. Um, so today I'm talking about Flock. Um, so Smeirina is one of the biggest cities I've seen for Flock. Um they have a 5.7 million contract that's paid out over the next 10 years or starting in 2025 for 75 plus cameras. Those include the normal ALPR license plate reading cameras as well as the contour tilt pam and zoom cameras as well as two drones. Um the reason I want to talk to that is because of both um how bad flock can be as a company, how bad the people who have access to that surveillance can be but also uh constitutionally that they violate fourth amendment or are starting to work that way. Um legally we have US versus Porter that came up couple years ago. It was about ALPR cameras and they within themselves did not violate any fourth amendment as long as they remained intermittent surveillance of locations which is what every camera does. It intermittently captures a short period of time. But the problem is in US carpenter the privacy within a whole of movements um is considered privacy under the fourth amendment even if each little movement is in public such as driving a car to different locations.

Imagine my disappointment and betrayal when I learned that this government has entered into contracts with the immoral company of Flock. Flock allows the highest bidder to buy their what their cameras collect. From unconstitutional and terroristic ICE raids to here in Georgia where multiple cops have been caught using the cameras to stalk their exes. You have created a deep distrust between this council and Smyrna citizens. Within a mile of my home alone, 37 cameras are collecting my data. Not only is this an egregious betrayal of my civil liberties, but it is also an illegal act. Federally, the Fourth Amendment states, "The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures shall not be violated, and no warrant shall be issued, but upon probable cause supported by oath or affirmation and particularly describing the place to be searched and the persons or things to be seized." More locally, Georgia's ALPR statute code 35122 states that law enforcement agencies may collect data and share data with other law enforcement agencies for law enforcement purposes only and that that data shall be destroyed no later than 30 months after collection. Block is a private company whose data is consistently used for non-law enforcement purposes, which this council has allowed disregarding the legality or morality of its actions. You have failed at your job of protecting smartest citizens. You have disrespected our constitutional rights and our privacy. The only solution is to cancel the flock contract and remove the cameras. I leave you with this George Orwell quote. In the past, no government had the power to keep its citizens under constant surveillance. Now, private life came to an end. Every citizen could be kept for in fear for 24 hours a day under the eyes of the police. Thank you.

We will coordinate these reviews and make sure we're trying to address everything in in the best possible way as as we can. And if any of those entities say, "Hey, this entrance or this um this entrance on our jurisdiction is not appropriate. We need to limit it." The zoning stipulation says they have the authority to tell them no. So if they say, "Hey, we're not going to do a left out at this entrance on the Oakdale Road. It's only going to be a ride in ride out." They have that authority to do that. They have the authority to make those changes according to the plan. But okay, but we have we have the ability now to make that change on if we were going to. I I'm a little uncomfortable just honestly with the traffic. Maybe it's because I don't have enough uh has been presented to me on the on the previous plan that was approved here. Was there traffic study done versus the traffic study on this site? What what and if so, what were those findings with this use? I understand that that the signal can be changed. I I get the timing and all that kind of stuff, but just the general anticipated traffic coming through there. Maybe this isn't a question for you. Maybe this is a question for the applicant what this you know what the what the effect is going to be the backups and the anticipated there's probably a better question for the yeah I'd like to know just kind of what what has been done on the front end on the traffic side of things. So if there's somebody on the applicant side that can answer that question any kind of study that's been done or any kind of um I' I'd like to I'd like to know a little bit more about that. Yeah, sure.

I know I moved here because I wanted to be back in Smyrna. So, I appreciate the fact that you all are going to meet with us and hear our concerns and hopefully we'll get it resolved. So, thank you. Look forward to that. Be the last speaker. A lot of pressure. End with a end with a bang. Um Tina Gory, 1532 Purple Cone Flower Avenue. I'm here from Riverview Landing with all of my neighbors. Um thank you for taking the time and meeting with us. We really appreciate it and it's hopefully a good step forward. Um, I just had one question or something to bring up. When we first moved into the neighborhood about two and a half years ago, we did go to um, Mr. Oglesv's uh, councilman meeting and we talked a bit about potentially the traffic and the safety at Riverview and Veterans Memorial. Um, more specifically potent like having a traffic light there. Now that there are so many more of us in that neighborhood, I mean, I drive that way to work every day. It terrifies me to make a left onto Veterans Memorial from Riverview. Um, you have you have cars coming this way, you have a turning lane, you have cars coming this way. It's a nightmare. The traffic is awful. And I just think that it's a very dangerous intersection. And now that we do have more people on that road, um, and potentially if there's going to be more residential, I think it'd be important to consider something there. I just looked over and our city administrator is making notes and I'm I bet those notes say get with the get with the city engineer and traffic folks. Yeah, I mean the traffic is awful there. It gets backed up. It could potentially cause more traffic. I don't know. I don't know all the logistics, but safety wise, I know it's it's scary.

Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM
Summary in the published minutes, not a verbatim quotation.
The Council asked if the Village Property owners had been notified of this change and Paul explained that he had been in contact with the HOA Mnaager for the properties and she was aware of the change over. Additionally the City is working with Ga Power to insure that there is no lapse in service during the change and noted the HOA will have to start new service with Ga Power. Paul assured the collective that the property owners will be notified prior to work beginning. 2025-070: Dat Luu, IT Director, spoke about the next four items as it relates to adding servers and cameras: The city has several upcoming projects requiring a new video management and access control system, as the current system has reached full capacity and cannot be expanded. After evaluating various options, the IT Department has determined that the Genetec platform is the optimal solution for integrating the city's security cameras and door access controls into a unified, centralized platform. Staff recommends approval to award the purchase of Genetec Central Database Servers to NetPlanner (3145 Northwoods Parkway, Suite 800, Peachtree Corners, GA 30071) in the amount of $23,182.50 on Georgia State Contract (99999-SPD0000172-012) to be paid from the 2022 SPLOST Downtown and Splashpad projects. 2025-063: After review, NetPlanner was chosen by Parks & Recreation and IT to facilitate the install of cameras, access control doors and lock hardware at the Village Green Playground/Restroom facility, using State Bid pricing. Parks and Rec as well as IT recommend approval to award the purchase and installation of security cameras and access control systems for the Village Green Downtown Playground/Restroom Facility to NetPlanner (3145 Northwoods Parkway, Suite 800, Peachtree Corners, GA 30071) in the amount of $64,547.20 on Georgia State Contract (99999- SPD0000172-012) to be paid with 2022 SPLOST Downtown project funds. 2025-065: Security cameras and an access control system will be installed at the new River Line Park Splash Pad for security purposes.

All right. Uh item C. This is uh Z25-015. This is a continuation of zoning amendment request to modify the site plan elevations and zoning conditions of Z21-014. Land lot 751 and 752 6.9 acres 4941 4999 and 5041 South Cobb Drive 4960 4970 4980 and 5000 Oakdale Road Harris Smyrna LLC um we did a public hearing extensive discussion of this last I guess it was a month ago two meetings ago and at that meeting. What I asked for was a traffic study. There had been no traffic study done. We have that now. And Mr. Jones, would you like to comment or or staff, however you'all want to do it, but uh on some of the findings and Yes, sir. Mayor, um at [clears throat] your request, the developer uh hired a company called Kimley Horn, very very well known with this type of work. Um they did the traffic pattern assessment for the battery familiar with the firm. Uh and they looked at this from two different two different ways. Uh one of them they looked at was no development of the site versus the site being developed. They looked at it present conditions and then what it would look like 10 years from now in 2037. And the net result of that, as we went over it last Thursday with the presentation of the traffic report, was about an 8sec additional 8-second delay. South Cop Drive is already failing. It's a it's a it's a system um problem that we have on South Cop Drive. Uh but um this would add about 8 seconds of delay there. Uh, one of the the things that were looked at uh during between the last time this was brought forward and and what we have in front of you tonight is there was a full access onto Oakdale Road. And that full access has been removed from the plan.

I don't know how long a traffic study takes if that's what it is. Yeah, and that's what I was I was um um starting to talk to. I'm not saying this will work at all, but I want more information. And we, Mr. Mr. Mayor, uh, Councilman Oglesby, we would be open to that to deferring so that we can do the traffic study and provide the information which usually is provided later, but we're happy to provide it now if it's going to help you all make a make an and I'm not trying to add expense to what you're doing and I'm not trying but I but I do feel a responsibility to to be thorough in in making sure this is going to work for the people that live next to it. So, is that what you'd like to do? make absolutely and I don't know. So the motion needs to say table until what? Scott, we need to table it to a specific date and probably just for safety probably just run an ad again before that hearing. But how long would it take you to get traffic study? You think it could take as short as 30 days, as long as as long as two months. Um, how could we could we defer for 30 and if if we're not done, defer for another 30? Would that be acceptable? Mr. How was the ad be? Because I we probably want to run the uh Well, no, since we've convened this, we don't have to run another ad necessarily until what? April 6 is 45 days. And you can meet all the if you had to you'd meet all the advertising deadlines and all. Okay. Does that that sound okay? Okay. Can we do before? Can we do one before April 6th? We do the 30 days.

Each little short burst of camera capturing that little movement is in public. But overall, where you travel and where you wind up is considered private because no one person can figure out every single place you've been. It's called a mosaic. Each little instance builds up a big picture and gets your mosaic of where you traveled. With these cameras and drones, Flock and the police and the cities are able to build that mosaic and without any warrant to access that information and that data that becomes a fourth amendment violation. Um as well as that under US first carpenter users do not willingly choose to transmit data when data is autoolcted. This was in terms of phone usage and geo fencing and was reinforced with chattery verse the United States but also applies with driving. Um when I'm driving it is in public but that does not mean that I am willingly consenting to auto collection of my license license plate and the data of my car when I drive around the city. So it's still it should still be considered as under USB carpenter. And in Chattery it reinforces that with another uh Supreme Court decision of privacy of move of your entire movement being under the fourth amendment and it pushes that into the digital information realm which include which is what flock does. flock deals with the digital tracking of persons and their vehicles and creates a mosaic of information that becomes a fourth amendment violation. We'll have to wrap it up. Your time is expired. Thank you. Thank you. Thank you for being here tonight and expressing your concerns. Uh next we have Anastasia Pixler, 2642 Park Road Southeast in Smyrna. Hello. Good evening. My name is Anastasia Pixler and I have lived in Smyrna for three years. Up until recently, I've been a very proud resident, always talking about how great the community is and how fun the events are.

And then the last one you see here, 237 for traffic improvement, roadway maintenance. This is just the general fund. It's kind of putting all everything that we're spending in these different places all together uh for things like pavement markings, general repairs, maintaining roadways, traffic detection cameras, and then on top of this, we also have about seven a little under 800,000 in splass for FI25 and FI26 that we'll have to put towards track traffic improvement, traffic calming, things like that. Going through a few of our funds really quickly here as I've mentioned these before. The first one is our E911 fund. So the city operates its own E91 call center. So if you make an emergency call within the city, it gets routed to our dispatchers. The top revenue source there, E91 fees from phone companies. These are collected from tele telecommunication providers within the city. Uh this number stayed pretty steady the last few years. that had a bit of a drop off a few years ago. Um, all these numbers aside from the transfer from the general fund are the same um as they were budgeted in 25. The only difference is the transfer from the general fund is actually a little less. We actually had an employee move location, had an employee retire that position fit uh better within the IT department than it did E911. So, uh, that was less and that transfer from the general fund is a supplement that is required to balance the E911 fund, uh, from what we get in the general fund. This has historically been a little low and we're certainly hoping it will be lower this year as well, but we wait till the end of the year to see what the number uh, the fund needs is. And then you'll see the salaries and operating expenses at the bottom there. It is balanced.

Um, again, you you mentioned this is a 10-year contract and that the city does reserve the right to terminate if it chooses not to appropriate uh at any time during the course of this agreement. We strongly recommend approval and endorsement of both the fire department and the police department. And we're excited about getting started. And this is not only the license plate readers that that catch the bad guys that are either in our town or come through our town from somewhere else, whether it's a incident in Atlanta that we've all experienced where they end up up here and they they the camera triggers a red flag and it goes to goes to PD. But it's also been explained to me that this is a force multiplier for our for our uh public safety personnel. For instance, if there's a wreck at Atlanta Road and Concord Road, uh they send a drone to see if that's a a fender bender or if it needs more attention rather than sending two police cars, a fire engine, a ambulance, and everything else. So, without having to use all of those resources, just being smarter with our with our resources uh and quicker to respond. They said those drones can get to those incidents in less than three minutes anywhere in the city. It's incredible. We'll have one located on the north part of the city and one on the south part of the city. And and the way these things are used, it just it it it continues to impress um how program could be rolled out. Uh we get Amber alerts on our phones, our cell phones all the time. This is an additional 71 eyes that do nothing but look for those things. And uh it doesn't matter what what the issue is, they're always watching. You put that data in there.
