Mr. Robinson, any background, please. At the request of the Cobb Marietta Coliseum and Exhibit Hall Authority, the city previously approved an amended and restated funding and operating agreement. As the Cob Marietta Coliseum and Exhibit Hall Authority prepares its financing, the city needs to update its ordinance dealing with the imposition and rate of hotel motel tax so as to update the ordinance consistent with state law and allows the levy through the term of the previously approved contract. This amendment extends the authorization of the levy from December 31, 2028 to December 31st, 20 203 as allowed by state law. Staff recommends the approval of ordinance 2025-005 for an amendment to section 94-52 of the Smyrna code of ordinance dealing with the imposition in rate of hotel motel tax. And the reason that they're doing this, the timing of this is the authority is going through a major renovation where they're adding uh more facilities and a hotel and with participating cities, these agreements are being um are being updated. Nothing else. Huh? Thank you, Miss Robinson. Uh, do I have a motion to approve the consent agenda? So, moved by Mr. Lindley, seconded by Miss Hines, this is working again. All those in favor, please vote. And that is approved. 6. Uh, now we're to the citizen participation portion of our meeting. Uh we have uh one citizen who's waited very very patiently to speak this evening. Elizabeth Hardy, come on up. Um you really picked a long one to sit through to to get to your comments. So I really appreciate you waiting. State your name and address for the record, please. All right. My name is Elizabeth Hardy. My address is 861 Daniel Drive. Um, as many of you know, I manage the Stout Brothers up in Market Village. Um, in 2020, my sister and I moved from Forest Hills to Daniel Drive, which is about 2 miles north from Smyrna Market Village. Um, we really saw this area as uh have a lot of potential for growth. It's kind of in a sweet spot. It's three miles from downtown Marietta, two miles from downtown Smyrna. There's the Mountain to River Silver Comet Connector Trail that runs right in between there. Um, so Recently, we got the addition of Smarter Coffee. So, that kind of helped this area go in the in the direction that we want to see it go in. Um, unfortunately, we recently learned that there's going to be a a gas station food mark combination thing at the top of our street. Uh, this property is properly zoned as general commercial, so that allows for this type of building. Um, and so while our neighborhood has changed for the better in our time here, um, we still have several challenges such as homeless encampments that have happened on the edge of this property.

Um, if you take the time to drive north on Atlanta Road from here, about 1.5 miles north of this gas station property, there are three of these same things. Um, they're awful. There's people hanging out outside of them. and they're filled with like drug paraphernalia selections, um, gambling machines. A lot of the food marts on the side sit empty. Um, it's just I really hate to see something like the fourth one coming in this little bit of stretch of road here. Um, in addition, there's uh on the site plan there is an entrance for this gas station that comes onto my street on Daniel Drive. U, there's not a lot of room right here. Um, so we're concerned for the safety of this of this access point. Um, I did speak with Rusty and Mark and he they said that someone is making an exception for this for this access point on our neighborhood. Um, from what I understand, it doesn't meet the the distance requirements per DOT. Um, and we learned that because a gas station was proposed on the adjacent corner, which is the county side. Um, and that access has been denied there for any proposed developments. Um, so you just try to imagine like coming off Atlanta Road and no one's going to use it just as a right exit. They're going to come in and out right there. The entrance for Daniel Drive is on an incline. It's not great the way it is. Um, so I just wanted to come and advocate for my neighborhood and for the city and, you know, hopefully it might make a difference. I don't know. Um, but thank you so much for your time. I don't get to see you guys all in one place all the time. Thank you for your Thank you for your time. I appreciate it. Waiting tonight.

I I question for Scott. Uh, I don't remember this having come before us. Uh, and does that require a reasonzoning for that parcel? So, we'll we'll take a closer look at that. Okay. Okay. That's what I thought. Okay. Yeah. From what I understand, it's properly zoned, but we're hoping for some kind of variance where the neighbors can come and speak up. So, okay. Thank you. Thank you very, this is in W five. Uh this is property that uh is in W five and it is uh zone general commercial. So, it may not even come to us unless they uh ask for a variance or something. But Rusty did tell me earlier this evening that this issue that you've spoke about with the the entrance uh on Daniel and how close it is to um Atlanta road, it will be reviewed by the county also because uh I guess Daniel is in the county and and Atlanta that part of Atlanta road where the dividing line. So, this also keep in mind is the very first property of the city of Smarter. So, if you're coming down Atlanta Road, this is the first thing that we're going to see right here. Um, right. It is the first one right there in the city. Thank you for coming. Thank you. Bye. That was the only person signed up tonight. Is there anybody else who had any comment they wanted to make this evening? Okay. All right. We'll move on now to ward and staff reports and we'll start tonight with Miss Antonia. Had the opportunity with uh Mayor Pro Tim uh Tim Gold and the chair of the Fanny Williams Legacy Project to be at the uh Cobb Landmarks um presentation of um in recognition of our efforts on behalf of that and um which is really nice.
