12 is a min minimum driveway length of 22 feet. 13 is a condition regarding the sidewalk. 14 is the sewer for lot four will connect to the sewer line from the easement in the sideyard. 15 uh they'll be responsible for any water and sanitary sewer improvements. 16 they'll have a maximum height of 35 ft. 17 and 18 tie this to the elevations and the site plan submitted with the application. I'd be happy to answer any questions. Any questions of Joe? Miss Wilson. Um well, I just want to ask about uh I believe it's lot number one which setbacks for audience is saying they can't hear you, Miss Wilkinson. And can you speak directly into your microphone? Sorry. Um so I'm asking about uh lot number one uh which is the uh unusual situation property ID lot is uh between two R15 zone lots and I'm just clarifying that that um their plan uh requirements for an R15 even though They are showing the R10 setbacks, but the location of the home as they're showing it does meet the R15 setbacks of 35 foot front setback and 10 foot side setbacks. And then this is also in substantial. That's correct. Okay. Any other questions? I'd like to invite the applicant up. Welcome back up. Good evening. Sean Murphy again, 3282 Lee Street, representing the applicant, Rick Cob and his partner. Um, just first to talk a little bit about the history how we ended up here. Uh, this site from I'm not a 100% certain of this. Okay, so this is coming from the neighbor and the seller, but it was all one piece at one time. And when they inherited it, there was a brother and sister involved. And the brother got one piece in the middle which was parcled out and sold. And what was left was two pieces.

We will coordinate these reviews and make sure we're trying to address everything in in the best possible way as as we can. And if any of those entities say, "Hey, this entrance or this um this entrance on our jurisdiction is not appropriate. We need to limit it." The zoning stipulation says they have the authority to tell them no. So if they say, "Hey, we're not going to do a left out at this entrance on the Oakdale Road. It's only going to be a ride in ride out." They have that authority to do that. They have the authority to make those changes according to the plan. But okay, but we have we have the ability now to make that change on if we were going to. I I'm a little uncomfortable just honestly with the traffic. Maybe it's because I don't have enough uh has been presented to me on the on the previous plan that was approved here. Was there traffic study done versus the traffic study on this site? What what and if so, what were those findings with this use? I understand that that the signal can be changed. I I get the timing and all that kind of stuff, but just the general anticipated traffic coming through there. Maybe this isn't a question for you. Maybe this is a question for the applicant what this you know what the what the effect is going to be the backups and the anticipated there's probably a better question for the yeah I'd like to know just kind of what what has been done on the front end on the traffic side of things. So if there's somebody on the applicant side that can answer that question any kind of study that's been done or any kind of um I' I'd like to I'd like to know a little bit more about that. Yeah, sure.

R15 zoning district, 5.08 acres, landlock 530 to 400 4100 King Springs Road, Smyrna Preparatory School. This is in Ward 6. Uh, and I think Rusty Martin is going to give us the background here. Good evening. Rusty Martin, community development director for the city of Smyrna. Um the request is for Sarna Preparatory School uh to move from their location here in the Market Village down to uh Life Church off of uh King Springs Road. Uh the property is zoned R15. The city's zoning ordinance under the R15 zoning category requires that all schools be approved by the mayor and council. Um so their request today is to um allow them the opportunity to move into uh that location and uh this is only to give them the ability to to move in. They still have to work through um making sure the egress and the fire safety requirements all met and that will be done prior to issuing a uh business license for them to operate in that location. With that, I'll be happy to answer any questions. So I think uh the applicants here as well and uh they can answer any specific questions you have with respect to the school. No, I just I know it's been a lot of work, Rusty, for your department and other other agencies and really appreciate you all trying to make it happen and work with Pastor Osbun and and uh and Scott and Kristen Carl will make it happen. So we hopefully hopefully it takes place. All right, I see the Carla's here. Is there anything y'all want to say? Nice to see y'all. anything y'all want to may not need to, but I just Okay, we'd like for it to happen. I just wanted to say we appreciate all the work the city's done.

I believe that it's uh it's not an appropriate building to put in our community. I'm directly one of four homes on the west end on the border of this property of this project that is directly that excuse me that is directly affected uh and impacted by this project. We would prefer to hope to see similar uh homes built there, whether it's a culac with a four or whatever is appropriate as Dylan was expl explaining as the norm. And again, I just want to make sure I sign this. I've spoke a lot more fluently in other meetings. I'm on the board. I apologize. as I'm not as uh um prepared tonight, but uh a lot of my um my my fellow neighbor uh neighbors have spoke well. I know that our uh I've gotten some texts as I' I've been sitting here of our um HOA president, Zead, those may know who he is, and he speaks very fluently, and I know he'd be here uh beating a drum and in hopes to protect our community as well, but he's not unfortunately here today. So, I I can't speak for him, but I just There's a there's a a lot of support and we're not all here representing today, but um in in other uh planning board meetings, we were all here and we all communicate and we talk about this and um and we're very um concerned and there's a lot of answers. I'm on the west end. I'll just go as far as to say again with the drainage and and and the elevation, we're all concerned if this project were to be uh uh approved that the west end because of drainage would have to be built up and I'm not sure if that was um discussed about how much dirt would have to be pushed in and for those who have our borders and our property lines if that dirt is pushed in then there's retainment required.

Part of the parking in that sanitary sewer easement will be gravel. They've requested a variance for that. There'll be a full access drive in the front of the property and at the back of the property. They'll have five foot sidewalk and two foot grass strip around the property. And we're asking for rideaway improvements on that alleyway to make it a little wider. The dumpster enclosures in the back of the property. And again, they are requesting three variances. The maximum front setback from 20 ft to 85 to allow parking between the building and the public rideway and to allow gravel parking service. These are some renderings of the property of the proposed building. The front is basically brick uh different color brick and accent color. And this would be the rear of the property from looking from the back. These are the floor plans. Again, the office units are at the front and then the garages are in back and then two levels of residential above. This is the subject property as it is today. Some pictures of adjacent properties and this is the property behind the subject property. Community Development recommends approval of the reszoning from general commercial to MU conditional for mixeduse building with 1680 square foot of office space and three multif family units at a density of 10.7 units per acre with the following conditions. Standard conditions regarding the no hardy plank um utilities have to be underground and they have to meet the tree ordinance. I've consolidated our other conditions to the the main points which is the front setback um variants. They're responsible for fire, water, sewer, and storm water improvements. They will install the sidewalk. They'll have a minimum of seven commercial spaces and three maximum three multif family units with two-car garages. Air conditioners and and dumpster will be screened.

one of the two of the things that we jumped out at us was that Activity Center should be a priority to re for redevelopment and that's what this will be it'll be a clear Activity Center really literally across from Belmont which is a good activity center and then uh get rid of some unincorporated Islands again which this this project is doing encourage uh intensity of housing uh in activity centers which we're we're asking for and then have opportunities for organized Recreation again the project does that all right subject property history I thought I'd take you through some pretty fun three Quick photos history in the 80s this is what the property was the the parcel lines are the parcel lines that we've we've collected and you can see Maple and park and what was there there was nothing there in the 90s iigo came came along and developed the church and you can tell at that time it was really just the corner surrounding Landscapes wasn't there there was another facility that's on the project which you'll see in a second and then all the lines that you see on there are really the Alleyways of the parking that's in there now and today this is what the property looks like is IO grew it needed more parking the facility is a 42 or 3,000 square foot building um and it had a pretty good crowd that was there and then surrounding Landscapes bought that the house that sits there and made it into a business and then the church expanded and built a little building it's a little school building out there on the top of that hill hill along Davis Drive um and so over time it the church had started to it's its membership started to decline and then covid hit and really devastated the church from in many ways as we've seen a lot of churches including people going online and not showing up to going to other churches and so the church's board got together and made the decision that it was time to find a new home which I will tell you I think I can say this out loud in on the record they have found a new home still in Smyrna that they're going to go to so they're not leaving the city they're just relocating and this was an opportunity for them to harvest this land into something in higher better use than what they were using it for and so that's where the opportunity came from um couple of things about this that you can tell that Davis Davis over there is buried in the

um in terms of uh overall new challenges and this is a very dynamic time as I mentioned there's a lot of fluidity and a lot of the trends that we're going to study whether that has to do with land use or the users of that land the office market retail market even residential uh there's been a lot of changes that have come uh to this region uh postcoid planning is a almost entirely different animal so as we think about looking at you from the top down couple things that we want to do one is get our arms around what those major your trends are where there's flux and movement. We want to understand what's pivotal in that data and then we want to seize on the opportunities that exist while also mitigating some of the challenge that might come up. So a big word that we're going to be using a lot in this has to is usually started with the word re whether it's about reuse, revision, redevelopment, whatever that might be. Not saying that that's a prescription for everything, but being a community like you are kind of locked in your size. That's going to be a major topic that comes up in our conversation. And a big part of this is about anticipation of community needs uh and and ranking and prioritizing those needs as we move forward. Some major outcomes uh that we're hoping um I think to address in this and have already began to have discussions on in our committee community outreach and engagement talking about downtown talking about issues related to housing also thinking about village green park reinvestment recreation the word comprehensive we really do mean it.

Um we held two meetings with them to get their ideas and you know look at the proposals and um you know they expressed what they had concerns with and expressed what they wanted to see addressed and um we tried to work with the applicant to address those with respect to um amending the stipulations and that's those meetings were specific to these changes. Yes. And this, if I remember right on your slide, this was first reszoned in 21. 21. Okay. And I would imagine there was some meetings. Yeah. Then even though it was a little bit tougher. Yes, there was there was meetings with that as well. I just want to make sure the community was reached out to and engaged. Mr. Lynon, anything else? Any other questions of Rusty? Thank you. I'd like to invite the applicant up. Good evening, Mr. Mayor. Uh, council members. Kevin Moore here on behalf of Triton Homes. Also have with me here tonight, uh, Mr. Cliff Poston, who's a principal and owner of, uh, Triton Homes as well, uh, who can also answer any questions if if if I cannot. I appreciate the time here tonight. uh and want to take a just a a brief opportunity so I wouldn't forget towards the end of my remarks, but I really wanted to extend um a heartfelt thanks and appreciation to Mr. Martin and Mr. Stabs in how they handled this particular application. It's it is a minor proposal, a change uh from the original resoning. Uh but uh they had some some true engagement with the community. I was able to see um because you Mr. Martin provided me those uh copies of emails uh where he was responding him and Mr. Stabs were specifically responding to questions from the community and they were very technical you know detailed questions that were being asked uh and they provided a level of response not advocating a position but simply providing facts um in a detailed responsive manner uh that provided information to the community that I think led to a much better understanding.

It's just a logical uh improvement. Oh, I'm sorry. This uh I spoke I spoke to the the the pastor at the church across the street and and his wife and and they were they were very much in favor of of the improvements. They were as they were with the the last petition just contiguous and to the north of this at 2571. This of course being 2583. But yes, they were they were very much in favor of of these improvements to the area. Uh the price, you're asking me what I expect the prices to be. Is that your question, ma'am? The prices on these homes would be uh north of 600,000. Any other questions for the applicant? Thank you. Thank you, sir. All right. This is a public hearing. Is there anyone who's here tonight who wishes to speak for or against this item uh to please come up now? Seeing none, we'll close the public hearing and we will turn it over to Miss Hines. Um not seeing any objection. I haven't heard any. And um anytime we're able to get more single family homes in an area, that's always a good thing and it's going to improve the area. And Davenport needs some help. And um so if that'll be something that'll help, then I make the mo the motion to uh approve. Motion to approve. Do I have a second? Second by Mr. Lindley. Everyone, please vote. Wilkinson. Wilkinson is having technical difficulties and I should mention that um Mr. Pickkins is not with us this evening. He is traveling so there's just six this evening and that is approved 6. Thank you for investing in our city. Appreciate the good work you're doing. Thank you. Thank you, council.

So that's where that why that driveway is shown where it is really just because there are utility requirements we have to deal with. Thank you. I appreciate that. So, uh, that's all right now for me. If anyone else has questions, I don't know as much of a question as much as I'm I'm happy you consulted the neighbors. Um, if there's anything that makes this process um I think better for all of us is when you're having these types of projects to definitely reach out to the neighbors because even though it might be a good project to you, the impact to the neighborhood people who've been living there for a long time. Um, so thank you for taking those efforts. Appreciate when y'all do developments here. You got a long history of doing it that you take into account the tree canopy and I know that's a passion of y'all. So, any other questions or comments before we open up public here. I was going to ask uh about the price point. That would uh be well hopefully low low 600s. That's what we're shooting for, but you know, market conditions, you know, what they are, we'll have to But that's what that's our plan. Thank you. Like I said, thank you for um Okay. Thank you. This is a public hearing. If there's anybody who wants to speak for or against this item, please come up and be sworn in. Seeing none, we will turn it over to Miss Wilkinson. This is in W five. At this uh time I would like toe 7 C 5-0112. Do I have a second? Second by Mr. Pickkins. Everyone please vote. Mr. Lindley. I vote yes. Okay, that's approved. 70. Thank you, gentlemen. Thank you very much. Item eight is privilege, lies, and show cause hearings. We don't have any.

definitely the response time. Um the next day as we drove by a lot of neighbors were pulling together but there was like no coverage I guess you know media coverage is not always good not always bad but it's there's no awareness to the situation. Um, we didn't see any police presence even throughout the day like drivebys. Even today as I kind of took a couple walks around, didn't see the same thing. And I think that's very important because everyone looks towards HOA or leaders of the community to kind of fix it or do something about it. And as much as we can do, we can also do little, right? Um, some of the neighbors that did have bullet holes, and I'm not sure if uh one of our neighbors was able to speak, but they were luckily out of town when they came home. They saw a hole right above a five-month-old crib that shot through their home. Um, I don't know if those houses the doors was knocked, people were checked on to see if they're alive. I can imagine living single and some happening to me, maybe not having the awareness there. Um, but I know there was a lot of surveillance footage and this kind of streamlines into a little bit of my next point and I'll watch my time, but in living here for about two years, my interaction through a lot of situations that we've had in our neighborhood such as multiple incidents of car break-ins where we were we put in the report, we have v video footage because our neighborhood has cameras everywhere. Um, and we'll put the report in, but there's never like an aftermath. There's no heightened patrol. There's nothing that we visibly see happening after these reports are put in. Um, we've called for non-residents, teenagers hanging between our residents.
