And so, you can always reach out to him. And then there are people within like the DA's office or the solicitor's office and we can make sure you have those numbers that if you want to be able to call and say, "Hey, I I'm one of the neighbors who was out there and I'm just wondering what's happening with this case." They should be able to tell you to a certain degree. Or you can even go on the clerk's office site to see what's happening with the case. Yes. And I let me make sure I clarify for our city clerk. That would be the Cobb County clerk's office. And if it's Yeah. And and and a major defense will be able to tell you whether or not if it's a misdemeanor, then it's going to be the state court clerk's office. If it's a felony, then it's going to be the um uh superior court. And it sounds like from what we're hearing, this probably would be something that would go to the DA's office, the district attorney's office that deals with felonies. Thank you, Miss Hines. Appreciate that. Um, next on the agenda. All right, last public comment. Go ahead, sir. Sorry to share my experience. Sorry again, I didn't know how to register and talk about that. So, I'm the neighbor from the Woodbury Town House. Could you say name and name and address, please? Um, yeah, Vin. My name is Vine Dharawat and I'm at 2732 Bell Drive. Um so as many of them told is the same incident. So but how like so I'm non-immigrant worker. I came from India to I have never experienced this kind of issue. My family is totally terrified now. So we have a 4month old baby and uh so I woke up and it's like 2:30. I mean I've never I didn't sleep.

3. Staff M&C Agenda Items to Review Andrea Worthy, Economic Development Director, explained that Luis Calvo from MKSK is joining virtually just in case there are any questions concerning the presentation that will be presented at Monday’s Mayor and Council meeting. Councilmember Travis Lindley stated that a couple adjustments were made to the presentation to have a broader and clearer narrative on the types of housing and the general plan from Church St. to Atlanta St.
That would mean that we would if someone else came before us, we would have to do the same consideration and doing all these changes of variances and then the future um land use we would be ignoring for the whole area. It's almost like it's if we do this then it's a whole precedent of changing the whole plan. So can you tell me why we should do that? Yeah. So I I would make the argument that there is precedent for having residential here and that's proof of the Highlands View Town Homes and the West town homes. So this area does have residential Mr. W to Miss Hines I I understand your situation too, but we're I mean and we're facing another similar situation where we have residential properties against industrial and type properties. But in this case, we we would have a property. They're going to know what's on either side. I mean, it's established. And that would be my answer to it. Wilson. Thank you, Mayor. Um, so I have a couple of questions. Um I think there's uh u in the documents 2500 square feet of retail. Correct. Um can you pull up the site plan again? Um sure. Okay. Thank you. And as far as where that um retail will be and will it also will the the uh the rental offices be at part of that space that 2500 square? No. So, if you look at the site plan here, there's a shaded SH section which is the leasing amenity and then a crosshatch section which says retail. Um, a little bit hard. I don't know if you see my cursor. That's where the retail will be. Um, the retail square footage is separate from the leasing and amenity space. Okay. Um, and again, you know, we're intending and envisioning this to be neighborhood focused retail.

Um is that the case or do you have that decided at this point? So I've got the applicant here with me who can answer that question. Do we are we using Hardy Plank on the side? Come on up. This is my client. His name is Andy Kumar. He'll be the developer. He just wanted to make sure that we're not seeing that from the road. Yeah. Yeah. It's facing I I guess it's it's not North Cooper Lake. That's Cooper Lake. Oh, so Cooper Lake down here. Will this be Hardy Plank on this side? Uh we haven't really decided on the exact material and stuff. Whatever the recommendation for the TD zoning is, we'll comply with those particularly and then any improvements on that, we'll probably talk with them and make sure that they they recommend. All right. So from from our stand, from my standpoint anyway, u I would like to require that none of the end of those buildings be solid hard. Yeah. Okay. Yeah, that sounds good. Thank you. Um what is the price point you're looking at? It's a great question. So, it's hard to nail down a price given the economic climate today um with things kind of coming online and going offline. Um that being said though, we're looking somewhere in the realm of 700 $800,000 potentially higher if things uh change. It's in line with what is in the market. So we kind of studied what is around there and keeping the price point around that and if the you know what's going on in the market with materials and labors and stuff. So things change then we have to adjust accordingly. If approved how long uh until construction begins and what do you how long do you expect the project to to take to build? Well um we generally uh estimate projects like this to be 18 months to 24 months.

We're going to retain quite a few trees along the backs of these lots. So we will actually meet base density. We won't even have to plant trees to meet the base density. However, there are a couple of large trees that will need to come down. So there is going to be some specimen recompense involved. So we will end up planting a few trees. Um, see what else I can tell you. Uh, we're going to be doing some fairly traditional things that we've done on these other lots with, uh, probably underground detention systems involving gravel and tying the down spouts in and that sort of thing. Uh we did meet with staff uh at least one time uh Bo and uh the transportation engineer and we worked out some details about where these uh driveways and such would would hit and where specifically very specifically we would put in and how we would put in some of the uh utilities in especially the sewer. Uh because it turns out the sewer line in front of the far right number four is about 18 feet deep out there in the road. Um, so we almost couldn't make this project work. We had to really work out some fine details to try to make this make the numbers work because the cost of tying into that sewer was going to be quite considerable to dig 18 ft deep out in the road and then possibly have to replace some asphalt and things like that. So, just wanted you to know that we did work with your staff and uh went through a number of comments and and dealt with all those amicably. Um, so that's all. Anybody have any questions? Any questions of the applicant? Miss Wilkinson? Thank you. Um wonder if um our city clerk elevations again. Oh, I'm sorry. I just asked for the elevations to be pulled up.

So that's the location of the town home building. um twocar garages on each unit with two parking spaces in front of the garages and seven guest parking spaces. The access drive will be on Argo as south of the property as they can make it away from the intersection. The storm water detention area has been moved further away from Woodenbrook and there's sanitary sewer line. um mail kiosk and the open space has been moved to the northwest part of the site or southwest. There will be installing a 5ft sidewalk and two foot grass strip on Camp Highland and Argo. They're proposing well they're committed to uh [snorts] putting in a raised crosswalk and flashing beacon to cross over Camp Highland and to act as a traffic calming measure. Um so the two um variances are the front setback along Camp Highland from 25 ft to 10 ft and the front setback reduction on Argo from 25 ft to 20 ft. between um the meeting on the 13th with the planning and zoning commission and uh they have revised the renderings to have three stories facing Camp Highland and four levels on the back of the property where the garages will be accessed. The top portion of the rear will be um deck area so it's not heated floor area. These were the original elevations. Um, the community had a lot of opinions about the appearance, so they tried to make them more traditional looking. They did do a traffic study. Um the traffic study estimated that they would have 3 am peak hour trips and 3 pm peak hour trips with 42 2-way 24-hour trips. Um along with the level of service analysis, uh this development is not proposed to make any um change to the level of service for the intersections that were studied. These are examples of the finishes they're proposing um the subject property and some adjacent properties.

You go a little bit further and you see a Woodland Brook, our development with 166 units. All single family homes, stucco, stone, all brick. Camp Highland Road is a delineator between us, Woodland Brook to the left, to the south, and Highlands Overlook to the right. It's a beautiful little town home community was just built a few years ago. So, there's this delineator of a road. One aesthetic look on the right, another aesthetic look on the left. Now let's put it in reverse and come off of East West Connector again onto Camp Highland Road. Only now this structure is there again. Beautifully to the left is Westchester Comets. You start coming across the bridge that goes over the Silver Comet Trail. Boom. There's the three-story building. It looks kind of like the one on the right except it's another story higher. Now, the delineation between town homes on the right and single family dwellings on the left has been destroyed. All you're going to see is this huge structure as you go across the bridge, and it just doesn't fit. It's surrounded by sing older single family homes to the left on Argo, 25 year old beautiful homes again, brick, stucco, stone to the right. They surround this big structure. And also imagine being at the bottom. That is a very, very steep slope. Claybrook Drive. I would tell you right now, which is just to the right of this property, is like a black diamond ski slope. It I wouldn't even attempt to ride my bike up. It's that steep. And I ride a bike pretty nicely. And I just don't see how this is going to be managed on such a steep slope and make it work. It I'm sorry. I just can't see it. It's out of place. It's out of character. town homes on the right, single family homes on the left, totally destroyed.

3. Review of Current M&C Agenda PRE2026-022 Review of the July 20, 2026 Mayor and Council Meeting Notice and Agenda Mayor Norton reviewed the July 20, 2026 Mayor and Council Meeting agenda. Z26-004: Russell Martin, Community Development Director, gave a brief background. Mayor Norton explained that it had initially been denied by Planning & Zoning Commission, but the applicants made several significant changes based on public comment. They went before Planning & zoning Commission again, and the vote to approve was 3-1. Mr. Martin further explained that the public asked them to move the dog park and move the detention pond. The opposition is rooted in not wanting townhomes there. There are townhomes across the street. This is currently zoned GC which allows for many different commercial properties as well as the proposed townhomes. Joey Staubes, Planner II, explained the new elevations show three stories from the front and four stories on the back. The updated information will be presented in the presentation tonight. ATH2026-093: Councilmember Welch said that he did not receive the background information he was looking for. On the rear of the property, on the rear of these units, you've got two patios and then uh one on the front as well off of the primary bedroom. Um, so I appreciate um Mr. Stabs going through all of the conditions. I included them here just to let you all know. We appreciate you not going through them again. I'm not going to do it again. I just brought him here to say we agreed to each and every one of these. Uh it was it was a little back and forth there for a second, but we have landed on something that we all agree on and we are good to go for each and every one of these. Um I think I'll end by saying I was really happy to see that recommendation of approval from the planning staff as well as from the planning commission. Uh while I'm not sure if they're here this evening, we did have a couple of folks speak in support at the planning commission. I was really happy to see that as well. Um so with that, I'll reserve the rest of my time and if you'll have any questions, I'm here to help. Any questions of the applicant? Yes. What What do you think? Welch. Oh, sorry. Welch, you're recognized. Um, a couple of questions. Can you pull back up the the plan B first? I think this one. The plan B. The plan. Yeah. Um, it's showing on my screen. You see? That's close enough. I I just want to make sure the elevations look very nice. You got a front and a rear elevation. Nothing on the side. I just want to make sure and I have nothing against Hardy PL but I just want to make sure that we don't have one full side of that building that is nothing but hardy planks.

Um so you know this solution really allows you to keep things like on street parking um outdoor dining and still have the street function for the businesses that are there. Folks told us that it very much matched the vision for the site about for the for the corridor about eight out of 10. So we heard quite a bit uh from the community through this process toward the end of the third phase. You know, some of the things that I want to leave you all with as we as you all move toward um you know, working with a development partner is one, retail and restaurants. That is crucial. We heard this over and over again. Folks really want to see that type of uses in in the redevelopment. Number two, housing and having a balance of housing. People really want you all to work with the development community to have uh for sale products and for rent products as a balance. Three, traffic and parking. That will continue to be a concern. Um, you know, that's something that you all can ensure is well designed uh so it doesn't overwhelm your transportation. And fourth, you know, people really want to see investments like the Jono Mayo and the green spaces as part of this. This is what brings life and character to the development so it doesn't feel like it's generic or could be anywhere in the metro area. This is something that will really make it feel like it's only here in Smyrna. So with all the inspiration, um I do have to leave you with a little bit of an action plan to bring the inspiration and make it a reality. So the last few uh pages in the plan are what we're calling the action plan. This is your implementation section. It is a little drier than the rest of the plan.
