Uh another thing that's been brought up uh along the way has been potentially receiving complaints um from residents. And one of the great things about multif family development uh is that most concerns or complaints are handled internally. We have on-site property management. We have on-site maintenance. Uh and they are responsible for handling those concerns uh or complaints. So to summarize, uh this is sensible growth in a great location. Uh and with that, I'll open it up for any questions. Questions? Thank you very much for being here. Thank you. Um Mr. Moore as well. Um you have a lot of things that you would like for us to consider and um in considering them I have some questions if you could uh help with why should we ignore our future land use study. Um so with respect to what we're trying to develop here um I don't believe that industrial is something that specifically works here. If you look at this site plan, this will be much more um of a burdensome and a nuisance to the existing residents and the businesses in this specific area. Yes, maybe as you go further down Highlands Parkway, it makes more sense, but this here truly makes sense uh to redevelop as a a multif family opportunity. When you speak of existing residents and you talked about the town home uh communities, have you spoken to those town home communities? Unfortunately, I have not. Um I tried um Councilman Olesby tried to reach out to them and set up a meeting with them. Um the community manager that runs that um property and asset unfortunately would not facilitate that meeting. U but we did try not facilitate it because they didn't like the idea of it. Uh correct.

Pre-Council Meeting

Summary in the published minutes, not a verbatim quotation.

The zoning proposal meets most of the zoning requirements of the MU zoning district. Based upon the review of the development by the Transportation Engineer, the city supports the proposed traffic signal at Davis Road and Windy Hill Road. Davis Road will be widened to meet city standards and improved with curb, gutter and sidewalk. The developer will be responsible for all traffic improvements associated with the development. Mayor Norton added that the section designated as a civic building would be a great spot for a future civic project in conjunction with this development. He also stated that this does not commit the city to purchase the land without a vote. The civic building portion is merely conceptual at this point. The apartments would rent at market rates. Councilmember Wilkinson expressed concern about pedestrian traffic from the development to the shopping center across the way. Eric Randall, Public Works Director, explained that there is a safe and easily accessible crosswalk for pedestrian traffic. Discussion took place regarding which schools this development would be districted to and the parking ratio. Community Development was assured that the schools this development could possibly feed are underpopulated and can handle more students. The ratio for parking per unit is 1.5/unit. LIC2025-003: This item is to be tabled to the January 21, 2025, council meeting because the applicant is unable to attend the meeting tonight. Discussion took place regarding “gaming” as it is part of the name of their business. Mr. Martin stated Community Development would reach out to them to get a definition and find out if there is an age- restriction. ATH2025-001: Andrea Worthy, Economic Development Director, explained that the City requested proposals for an update and expansion to the Smyrna B.O.L.D. Downtown Master Plan. Fifteen (15) proposals were received on Friday, July 12, 2024, and evaluated by staff from Economic Development, Parks and Recreation, Community Development, Public Works, Community Relations and selected Smyrna residents.

Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM

Summary in the published minutes, not a verbatim quotation.

Councilmember Oglesby mentioned that having a traffic light added will help with traffic flow. Mr. Brady stated that after speaking to Councilmember Oglesby, they will set aside five affordable units with rents at 80% area median income. The property is located within the Highlands Parkway Property Owner’s Association. The Highlands Parkway Board recommended approval and ownership overwhelmingly supports this development with 18 ‘yes’ votes out of 24 total members. Councilmember Hines recommended that the presentation be handled on Monday. Z25-013: Russell Martin, Community Development Director, explained that Arrow Waste has applied for a special land use permit to allow a modular office and storage container at 6310 Riverview Road. A 6,000 gallon above ground fuel tank will also be utilized which has received approval by the City and State Fire Marshal. The fuel tank is not part of the Special Land Use permit. The Planning & Zoning Commission voted to approve the request by a vote of 4-1 at the October 13, 2025, meeting. The subject property is 2.06 acres in area and is zoned HI (Heavy Industrial). The subject property is used for storage of commercial and passenger vehicles for a waste company. The adjacent properties to the north, south, east and west are zoned MU (Mixed Use). The property to the north is occupied with townhomes and multi-family to the east. The property to the west is vacant, and the property to the south is occupied with a parking facility. Arrow Waste provides dumpster rentals for residential and commercial companies and stores commercial and passenger vehicles on site. The business is requesting approval of a 60’ by 12’ modular office, a 6,000-gallon fuel tank, and a 40’ x 8’ storage container. There are no stream buffers that enter the subject property, and the property is on the northwest side of Riverview Road. The applicant does not intend to create any additional land disturbance on site, and the parking area consists of gravel.

I think the initial application was 16 town homes, a small town home development. Community meetings were held, discussions, and so forth, eventually leading uh to the approval that was in December of 21, which is the site plan that's before you tonight that's shown for reference purposes, where it was reduced to 12 single family detached homes. It was important for the community that it not be town homes at this location. They wanted detached homes in a smaller number and 12 was the the final number for that in a detached single family arrangement. So that's the level of community engagement that had occurred up until the end of 21 when it was approved uh by US city council. And now coming forward I know it's some four years later the applicant the application purchased the property carry it through engineering design and has developed it according to exactly what was approved uh by this council. Triton Homes now comes to uh seeking and would like love to build uh their homes on this on this property. Uh Triton uh has been here for over 50 years in Cobb County, the locally owned uh building homes in Cobb County, building homes in city of Smyrna and other cities here in Cobb and has done a fabulous job and they intend to do that same thing here at this location. This offers an opportunity. It's a small really an enclave uh but has great visibility on Atlanta Road at Campbell Road intersection. Uh as you can see from the pictures, there's a there's a great uh you know community gathering spot that's already now been developed and constructed at the intersection. But looking at this and this is kind of one of those instances that you see when you have something that's conceptual uh in design finally gets to detail design and what needs to come of it and there's some slight changes that need to be made from that evolution of the project.

I mean it would depend on their site plan. They may need variances, but it would be an allowable use under the zoning ordinance. Okay. Thank you. Any other questions of Joey? Okay. I'd like to invite the applicant up now. Hello. Hi. You need to swear her in. Okay. Hi. Good evening. You'll just state your name for the rest. Yes. My name is Melissa Marilla. Um, thank you everyone for your time here. Uh, the soccer team is a hard act to follow. [laughter] Um, as Joey explained to everyone, uh, since our project was submitted the first time, we've made several, uh, significant changes. And I won't go through everything in in detail. Joey's covered a lot of things. Um, here on our first slide, we basically show the first uh, site plan that was submitted and our final site plan. All of the changes that we made are represented by the um the green check marks here. This is the final site plan that shows the uh dog park that was moved to the uh western side of the um of the development and the detention pond moved to the lower southern side. Uh we led the corner of um Argo Road and Camp Highland um an empty space so that there's plenty of visibility there um since traffic was a big concern of everyone. This is uh our fire truck um turn exhibit just showing how the um the southern entrance on Argo Road allows for the fire truck to have um plenty of room to go in and turn around and come out. Um, following the discussions with the city staff and and also considering public input, we re we relocated the playground and the dog park, as I mentioned, to the um to the western side of the development and the detention pond to the southern side.

They are installing a 10-ft sidewalk with two foot grass strip along Cumberland Boulevard and they're adding an additional entrance um with a del lane to the north of the property. Storm water detention will be um contained on the site and there will be a four-level parking deck that's within the multif family development, 675 parking spaces. So they'll be broken down for the multif family and the hotel use. There's five variances requested to allow an increase in the maximum 20 foot side setback of the hotel building. Two, to allow an increase in rental units exceeding 15% of the total number of residential units. Three, allow an increase in res residential density from 25 units to 70 units per acre. for to allow an increase in building height from 66 to 150 ft and five a reduction in the minimum front setback from 50 feet to 15 ft. Staff supports all those variances. These are some rending renderings just to provide scale of the property. And um some renderings of the property and then these are the elevations they've submitted with the application from all sides. These are pictures of the subject property as it currently is. and some adjacent properties along Cumberland Boulevard. Staff is recommending approval of the reszoning from tourist services to mixed use for the mixeduse development with 212 hotel rooms and 328 multif family units. We believe it's in line with the Spring Road LCI study that was adopted by council. I'll summarize these conditions because there's 32 of them, but 1 through 12 are standard conditions regarding the architectural components and tree plantings, um, decorative street lights. 11 is are the special conditions regarding the setbacks for the buildings. 12 through 15. They will have to meet fire, water, and sewer uh sew storm water and traffic improvements. They'll be um at the developer's expense. As mentioned, they will install a diesel lane.

These changes create a safer amenity area and they improve storm water management and they better integrate uh the features into the development while maintaining the enhanced landscape buffers. [clears throat] As I mentioned, safety has been a big concern of everyone's. Uh with that in mind, we preserve the visibility triangle at the intersection of Camp Highland and Argo Road by limiting landscaping to low height plantings and maintaining un unobstructed sight lines. In addition, we are proposing with the city's recommendation a raised pedestrian crossing with the flash and beaking signage to improve pedestrian safety and increase driver awareness. Another change to the uh project was the enhancement of the landscape buffers. We increased the side buffer from 25 ft to from 20t to 25 ft and the rear buffer from 25 ft to 30 feet to provide greater privacy and visual visual visual separation for neighbor neighboring properties. We also eliminated the requested side uh setback variance on the western side. The landscape plan includes green giants along with the with complimentary landscaping and we'll continue to work closely with city staff during the final landscape review to ensure that the selected plants meet the city standards and provide an attractive long-term buffer. We also refined the architectural design throughout the process since the original design that was proposed uh met a little bit of push back. It was a little bit too modern. Uh brick was added to the facade. Uh the monument sign was relocated to improve visibility at the corner and the overall design was refined to better complement the surrounding neighborhood while maintaining the character of the project. Another big topic has been parking. Um, each town home provides four dedicated off- streetet parking spaces. Two inside the garage, two in the driveway, and then the development also provides seven visitor parking spaces, which gives a total of 31 spaces or just over five parking spaces per home.

But just just ballpark the multifamily component will likely take 36 months in its own to build out. Thank you. Other question Mr. Welch? Yeah. I think based on what you're telling us now. You don't know the answer to my question about where the trash is going to be. Um, but you have a limited area. I mean, you're the front of that property is the only place where you can put compactors. My only my only requirement or request for for that would be that of course they be enclosed and not be visible from the street. But you're you're pretty tight on the front. You've got a service area back there that is probably the the location to put them, but you're in concept design right now, I think. And absolutely, you really don't know where they Absolutely. Generally, that northwest corner uh makes the most sense. And we do typically tuck our compactors out of sight. Absolutely. And sometimes even underneath little awnings in our buildings. I'm going to ask a question of Rusty. Rusty, is it a requirement that those compactors be enclosed? Yes. Yes, sir. That's part of our requirements for zoning. They're not. I'm done. Well, we'll make sure it's got a wall. Put the site plan back up again. Uh, is this is the site plan that I have up? Well, is this site plan? Okay. There we go. Is it showing now on your screen? Yes. Okay, great. I just wanted to see where you were talking about the west part of it be the area to the on the top left corner up there where you see the large gray area. I mean you can't go back to the apartments because you've got a you got a 10% or at least in concept you got a slope right going down there and so keeping it on that higher you don't want a big truck going back there.
