Summary in the published minutes, not a verbatim quotation.
5. Other Business / Staff Comment Councilmember Oglesby – Public Art Committee has an RFP out for public art to be in every ward. It will close in mid-August. The local youth track team just participated in the US National Championships at Savannah State. Many Smyrna athletes are All-Americans (at least number 8 in the entire nation). Councilmember Pickens – Has a meeting with Mark Wolff about traffic calming tomorrow. And he is going to get updates about the shooting that occurred in Ward 1. Councilmember Lindley – The next public engagement roll out will be August 18, 2025 at 5:30 PM. The concepts will be presented, and the public can provide feedback about what they like and do not like. There are also some trips to Trilith, Duluth, Chamblee, and Alpharetta being arranged for tours. Councilmember Lindley asked if it would be possible to get a list of code violations per ward. Russell Martin, Community Development Director, stated he will get that to the council members. Mayor Pro Tem Gould – Has a meeting with Russell Martin, Community Development Director, tomorrow to discuss code enforcement. Mike Jones, City Administrator, provided the following: • Project list is not ready yet, but it will have all the information for each project. • Chief Zgonc and Sheriff Owens will meet to discuss Smyrna’s jail. • A meeting will be held with the Chief, Deputy Chief, Fire, etc. regarding 911. • A bollard plan for street closures for all events is in final draft – accommodating all festivities – 6-8 permanent spots and the remaining would be temporary barriers. Councilmember Lindley mentioned that at the retreat there would be a 30-day plan to alleviate the homeless situation. There have been rumors that one in particular might have a firearm. He would like this back on the Mayor’s radar and Chief Zgonc’s radar. 6. Executive Session (As Needed)

Uh I do this in a lot of jurisdictions. Do not find very often where you have that level of responsiveness to to community members uh from uh you know local staff. And I just wanted to say that because it was it caught me uh and you should know about that if you don't already. Um this particular application uh as Mr. Martin has expressed does come to you uh as a request for minor modification to the zoning that was originally approved by city council in 2021. little historical context uh which I think is important just um not necessarily that it lends itself to the particular issues in front of you tonight but just as kind of a recollection this particular property which is 2 acres at Campbell uh road and Atlanta road this property was zoned neighborhood shopping and had been for years and years and years neighborhood shopping commercial category allows drive-through restaurants and so forth and so on that could have gone here all along but it was that type of use was not supported uh by by the residents and community that immediately are in this area of Campbell Road who as you all know were very engaged uh in their community. Uh one of the first applications that I was involved with uh was one for a large medical office building uh at this location. Uh that never really came before you because uh the engagement with the community at that time, this is prior to 21, was not supported at all. And so that was ultimately withdrawn and we gained a better understanding of what what was the community looking for and their kind of hot button issues. Ultimately uh the current owner and applicant in the application that was approved in 21 came forward uh with an application for town homes at this location.

and then through the development. The commercial development has the following setbacks. Minimum front of zero, side of zero, and a rear of 20. And then a maximum of 95 ft and a side maximum of 20. And these are associated with what the MU zoning district um allows. Um with this, we're modifying the maximum to allow the building to be pushed off uh the road. It is a 5,000 square foot drive-through restaurant uh with indoor dining as well as 67 um associated parking spaces. All the queuing and everything will be located on this site um to be able to handle um service from this site and not back out into uh South Cobb Drive or Hookale Road. There's a detached canopy and menu board. Um and then the trash enclosure is located here and storm water. Um in this location with this there are several uh traffic improvements. There's a deceleration lane along with a full access drive on Oakdale Road and then a full access drive and a deceleration on um South Cobb Drive. not shown on here, which the applicant has agreed to, is to provide a um pedestrian crossing somewhere on Oakdale Road where appropriate. Um that'll be a hawk system. So, it'll be the flashing lights with a marked uh crosswalk. Um and that'll be determined if this gets approved during the plan review uh process in coordination with um SimRNA and if it's if it would be located in uh the area in J Cobb County's jurisdiction then we'll coordinate with them as well with this request. There's several landscape buffers, 10-ft landscape buffers between um the commercial property and adjoining residential. And this also has the sidewalk connections um for the property. With this request, there's five variances um associated with this. Uh the first is to allow a reduction in the side step back from 25 ft to 12 feet for for the town homes.

To require this many variances just seems odd. In my opinion, this development just does not fit. The application for resoning should be denied. Thank you for the opportunity to speak to you all tonight. There anybody else who wants to speak for or against this item here tonight? close the public hearing and this is in ward seven. I'll turn it over to Councilman Oglesby. Thank you, Mr. Mayor. I would like to make a motion to approve this development based off the recommendations by the staff if approved. Say that one more time. Mr. Obsby, I would like to make a recommendation to approve this development with the recommendations set forth today by the staff. which includes the traffic sentinel, the low in the the low income home apartment complexes to name a few. As presented as presented. We have a motion to approve uh by Councilman Oglesme. Do we have a second? Second by Mr. Welch. Everyone, please vote. Just Mr. Pickkins is left now. So I think they bear with us just a moment. Having technical issues. All right, that is that motion fails. Five to two. Right. Move on now to item D. Oh yeah, that's true. That that has I do I have to have a motion to deny that was that motion to approve was okay. All right. So asking me to ask for a Okay. So that so that failed. So I need a motion to deny that. Okay. So moved by Mr. Lindley. Second by Mr. Gold. Everyone, please vote. So the motion to deny is approved 5 to two. Now we'll move on to item D. This is a public hearing special land use permit to allow a modular office and storage container on Riverview Road. Mr. Jones, the background, please. Mayor Arowways has applied for a special land use permit that would allow a temporary modular office, a 6,000 gallon fuel tank in a storage container at 6310 Riverview Road.

If you do have a great uh mixeduse development, you can see that you know about 30% of anticipated trips can be non-motorized because you've got residents, you've got office visitors, you've got visitors from on the hotel. You know, all of those folks won't necessarily need to drive in uh to access some of these businesses as well. Lastly, I do want to talk about a couple of your key streets that you want to make sure you invest on. Um, one of which is Church Street. Uh, as an east west connector, um, toward Atlanta Road, you know, Church Street will, you know, see a lot of infield development with the site. Um, and it will also see potentially some stress in your transportation, especially as you get closer to the intersection with Atlanta Road. You want to consider some of this traffic and you want to continue to have a great walkable church street to take some of those elements on King Street that I mentioned and make sure they're incorporated along um Church Street so it continues to feel like a walkable road and not like a southern edge. You don't want your downtown to end at Church Street. You want it to feel like it's a great connector. And lastly, um, from the very first meeting, people told us about not having an old downtown and a new downtown. The easiest way to feel like you have a dated an old portion portion of downtown is by not investing in some of your um more mature portions of your of the district. And that is really West Spring Street. You have a really great corridor with restaurants, businesses, and people who have been there uh quite a bit of time. you know, how do we make um the West Spring Street feel like it's better connected to the new investments on the south?

That that means that the bid package was was effects were put out. Well, um if there's no discussion, I'll entertain a motion. Motion do pass by Mr. Lindley. Do I have a second? Mr. Pickkins beat you to Mr. Oglesby and seconded that. All in favor, please vote. That's approved. 70. Item I, approval of the dedication of Concord Linear Park. Dr. David Martin. This is the park right over by um Zoya, the old the old Wes. Um Lenley, anything you want to say on this? Uh yeah, thanks, Mr. mayor and thanks to Richard Garland and the parks department for helping sort of shepherd this through. But uh in uh I guess late August uh Smyrna lost one of its pillars and David Martin uh who was active in many things, the Optimus Club uh his church and uh was known throughout Smyrna for beautifying Smyrna every day by picking up trash on thorough affairs throughout the city. Ironically, I would always see them on Concord Road. Um, so we thought it fittingly appropriate to name the park uh in his memory. Uh, we'll have a dedication and a monument sometime. Uh, it sounds like in early February, so we'll we'll be back and hopefully make that a big community event. That motion do pass. Thank you, Mr. Lindley. Second by Miss Hines. All in favor, please vote. Fitting tribute. And that's approved 70. And then the last item under formal business is item J, which we voted to add at the beginning of the meeting. This is approval to close King Street between Bank Street and Powder Spring Street indefinitely, effective November 21st, 205 between the hours of 3 p.m. Friday and 6 p.m. Sunday. allow pedestrian traffic during peak hours of use at the village green space. Really glad we're doing that.

So that all is a good thing. Hopefully we can find another location because I do understand that you don't want that right in the front of your uh new house there. So um but anyway, thank you. And um and part of what makes me more comfortable is because that one lot uh lot number one does meet the requirements for an R15 and I know that there's R15 on both sides and um and the neighbor that's in the middle. Um you know her her lot is quite large as well. Um she did want to be here tonight but she had communicated with me earlier that she was having to work late. Um the one thing she also communicated and I believe she may have talked to you too. Uh she was was hoping to that you could plant some kind of a landscape buffer between um maybe between some of the properties may uh you know maybe where the town homes are or the I mean I'm sorry with the three from the uh commercial. I I did speak to Cindy on Saturday and uh we talked through it and I as I I'll say to you what I told her that we're going to probably planting some trees regardless because we're going to have to remove some trees unfortunately. And I'm happy to locate those on on some of them at least on on the side if it doesn't impact the root zones of existing trees. Okay. And we want to leave enough room for a fence. Also, if a future homeowner wants to install a privacy fence, they can do that, too. So, okay. We're we'll certainly willing to consider that. Okay. Thank you. I really appreciate it. And I'll add if you look at the site plan that I thought through that when we did the site plan.

There will be a signalized crossing on Oakdale Road. There is a sidewalk all the way around with connections. Councilmember Oglesby said the biggest concern for those he represents are the lights Councilmember Welch asked if fast food drive-thrus are allowed in a mixed-use development. Mr. Martin stated that permitted uses are outlined, and drive-thrus are prohibited. That is why the applicant is requesting this variance before Mayor and Council. Mayor Prto Tem Gould asked about the exteriors of the townhomes. Mr. Martin stated that no hardi-plank siding is to be visible from the roadway. Discussion took place about traffic flow, entrances and exits, deceleration lane, etc. Mr. Martin stated that it still needs to go through Smyrna engineering, GDOT for the state, and through Cobb County because of where it lays in conjunction with a state route, County road, and Smyrna road.
