A. COW2026-022 Review of the March 16, 2026 Mayor and Council Meeting Agenda Z26-100: Joey Staubes, Planner II, provided the following background: The applicant is requesting approval to subdivide two lots into three lots while retaining the existing R-15 zoning category. The property was previously approved for a four-lot subdivision with a side setback reduction from 10 ft. to 5 ft. and a lot width reduction from 85 ft. to 50 ft. The new subdivision request will allow three new single-family detached homes to be built on three separate lots utilizing the variances previously granted in V20- 073. The Planning & Zoning Commission recommended approval by a vote of 6-0 at the March 9, 2026, meeting. V26-019: Joey Staubes, Planner II, provided the following background: The applicant is requesting approval to subdivide property at 2773 Mildred Place into two (2) single-family residential lots. The applicant plans to subdivide the property within the requirements of the R15 zoning district, so no rezoning is required. The subject property is 0.89 acres with a proposed density of 2.24 units/acre which is within the Low Density Residential land use classification (under 3 units/acre). The proposed subdivision will result in two (2) lots being 23,408 sq. ft. and 16,793 sq. ft. in size. The existing home will remain and one (1) new lot will be created. The new lot (Lot 2) meets most of the R-15 zoning requirements, however, one variance is requested to reduce the lot width from 85’ to 75’. The Planning & Zoning Commission recommended approval by a vote of 6-0 at the March 9, 2026, meeting. Ordinance Revisions: Scott Cochran, City Attorney, explained that there are going to be a total of five ordinance revisions, including updates for mobile food vendors, bail bondsmen, tattoo establishments, precious metal dealers, and the film industry. The updates include standard application processes, appeal rights, and procedures for suspending or revoking permits.

How do you vote, Mr. Lindley? I understand Mr. Lindley's joined us. Yes, sir. I'm in the affirmative. That be Yep, that'd be 70. Okay, that's been I should I should have mentioned this at the beginning. Um, Mr. Lindley's uh going to join us remotely. We have Judge Cawthorne here uh to help us with our meeting tonight. Thank you, Judge, for being here again. Yeah. All right. Item B is zoning amendment Z25-010. This is the old Kins Corner Grill site. And Mr. Jones, any background you'd like to add before Rusty's presentation? Okay, Rusty. Good evening. I'm Rusty Martin, community development director for the city of Smyrna. Um, this request is a zoning amendment to the subject property. Uh the applicant is requesting to modify the building elevations and site plans and the zoning stipulations associated with the original zoning of the property. Um LG Community Credit Union is the applicant. Um these building elevations and site plans went be before the urban design commission back on September 19th. Um the UDC recommended approval at that meeting. Um, and then you guys will hear it tonight for a final action. Um, just a little bit of background on this request. Um, back in 2022, uh, this property was reszoned from general commercial to mixed use for a 36,000 square foot mixeduse building. Um, of that 36,000 square feet, 9,000 9500 was uh commercial use and that was the bottom floor of that um mixeduse building. um that the applicant is requesting to uh modify that building and and reduce the square footage and change elevations um to it. Um as well as reduce the the size of the lot that that's incorporated in that and I'll show I'll highlight that in a in a moment for you. Um this is a zoning amendment. It's not a reszoning. Um, so we are just modifying the building on the property.

Yes. For the most part it'll be um brick and then board and batten from my understanding. Um, but everything visible from the front and the sides. There will be no lap siding on those elevations. Good. So, it'll be in accordance with the town home standards. Thank you. Any other questions? I know one of the questions I had asked in our meeting the other night was about the dumpster and where it's located. Can um can you point that out on this thing this uh map that's here? The Yes. Uh you see the the hatch section sort of in the middle uh landscape island in the middle uh in front of the Chick-fil-A building. That's where the dumpster enclosure will be. So you would enter the site and if you were entering from South Cobb Drive, it'd be the first driveway and then they'd pull in there to access it and then pull around um all the way around and back out. Mr. Jones, did you have a comment or question? Yeah. Um Rusty, taking a look at the way this property is currently zoned um versus what's being asked for today. It is this a in your opinion is this a less intense use than what's already zoned that could go there today? Yes. This the zoning is not changing but from an intensity standpoint in our minds it's a down zoning of the property. Okay. is that you so you you went from 160 apartments to 45 town homes, but you've also added a a Chick-fil-A, which is going to be a little bit more intense probably than whatever was you went from 163 units down to 453 units. And then you went from 20,000 square feet of commercial space down to five, which if you know, looking at the 20,000 square feet under the first, you you might have had two or three restaurant spaces in those buildings.

Regarding area support, the developer stated that they've gone down Highlands Parkway and met with all businesses they could possibly meet with to gather support signatures for their intended development. There were 13 on the list as of the revision. Uh that's considerably more than 13 businesses on Highlands Parkway and I'd imagine that the low quality of signatures or quantity of signatures is likely parallel to the support. Regarding affordable housing, the developers August 21st Crawford Conditions letter to you all stated that they would provide five affordable units with rents set at 80% of AMI or area median income. According to HUD, 80% of that would be considered low income. Five units out of 250 is only 2%. That concession would not be enough to say that this proposed development should be one that addresses affordable housing. 2% does not even move the needle. Lastly, the May 7th traffic impact study stated that the impact of the proposed development would be minimal. I welcome the author of that study to tell that to the people that drive on that road daily. I believe they would respectfully disagree. If for some reason this is approved, would the developer be willing to install a separate pedestrian activated flashing crossing as currently installed on South Cob Drive at Novvice Apartments? Would the developer consider an overhead crossing like the one at Glock just up Highlands Parkway? A proposed 395 bedroomedroom development housing 400 to 800 people dwarfs what Glock employs in Smyrna on Highlands Parkway. Would the developer consider what sort of precedence this would set in the area? And if the coffee shop fails, will there be restrictions on what sort of retail can go in a limited 2500 foot area when there's 395 bedrooms available? 395 units, pardon me, or excuse me, bedrooms available. In other words, as a member of the planning and zoning commission said, if it doesn't work, it doesn't work.

Allow reszoning from GC to TD conditional for the development of six single family attached dwelling units at a density of 5.71 units per acre 1.05 acres land lot 606 4691 Camp Highland Road. Melissa Mario and Joey you going to handle the presentation for us? Yes sir. This is reszoning case C26-00004. Um, prior to the May 11th planning and zoning commission meeting, the applicant met with the community. Um, the recommendation from the planning board on the May meeting was to deny five to zero. The applicant had another meeting with the community between that and the next hearing which was July 13th and the planning and board recon commission recommended approval 3 to one. This shows the location of the property. It's at the intersection of Camp Island and Argo Road, specifically 4691 Camp Island Road. It's 1.05 acres. um is currently vacant and they're proposing six town home units. The existing zoning is general commercial. Uh most this area used to be zone general commercial and some of it's been reszoned for residential. The future land use is medium density residential which is up to six units per acre. So it is under that uh six units per acre cap. This is the original site plan that uh the first planning and zoning commission saw. It had the open space dog park area at the intersection. It had the detention area adjacent to Woodland Brook. um they heard a lot of comments about relocating the detention pond and the proposed um open space and that is shown on the next uh revision. So uh originally they did need a a side setback reduction between this town home unit number one and Woodenbrook. So they have shifted it to meet that setback. They've pulled it up to Camp Highland uh 10 feet from the property line and the front setback on Argo is 20 ft. They meet the side setback um requirement of 25 ft and the rear set back of 30 feet.

We're recommending approval from the reszoning to GC to TV conditional with the standard conditions and special conditions regarding the setbacks. They're responsible for fire, water, and sewer and storm water improvements. They will install the five- foot sidewalk and two foot grass strip along the road frontage. They will have a minimum of seven parking guest parking spaces. They'll have a maximum of six town homes with two car garages. Uh rightway dedication on Argo Road. They will provide the raised crosswalk with the flashing beacon along Camp Highland. and this condition to the submitted site plan elevations provided with the application. I'll be happy to answer any questions. Can you say any questions? Any questions of council? Yeah. Okay. Mr. Yeah, just a few. Uh thank you Joey for your uh presentation. Are are the developers here today? Yes, they are. Will they be able to answer some questions? Yes. Okay. Uh, I'll hold my questions for question. Mr. Gold, uh, Joey, we few years ago put a lot of work into town home standards. Yes. And it's a kind of more updated modern look, but does it meet all the town home standards? It does. So, architectural dimensions and all the things that require maintain high quality. Yes, they are compliant with that. Mr. Mr. Mayor, I do have one question for Joey. Currently, it's uh zone GC. Correct. Correct. Uh can you let our audience who may not be well verssed in that what GC means to us currently as a city? General commercial is the most um allows the most uses in our zoning ordinance. Um it is mostly audio auto oriented uses, retail, um landscape contractors. There's about a hundred over a hundred different uses that are allowed in GC. All right. Quick trip racetrack. Yep. Okay. What happens if uh say a cry trip wants to move into that space tomorrow?

There's underground uh storm water management system that'll be in the in the drive on the south side of the building. And then there is proposed inner parcel access should that property to the south redevelop. So they'll have connectivity between the lots and access back to um Church Street. There's a right in right out at uh a right in and right left out at Church Street and then a right in right out on Atlanta Road. There's a 10-ft sidewalk, two-ft grass strip along Atlanta Road and a 5-ft sidewalk plan for Church Street. These are the proposed uh building elevations. This is the elevation for um Atlanta Road, the elevation for uh Church Street, and this is the rear elevation uh that faces the the church and then the southern elevation um that faces the office building. and then your floor plan. And with this request, there is one um variance uh request that's associated with it under uh section uh 720.9 of uh the zoning ordinance. It requires that um all non residential uses not exceed 50% of the gross floor area um of the development. And obviously this is all commercial use. So they need a variance from that request picture of the subject property and then the adjacent properties to give you a little context of the area. Um, Community Development is recommending approval of the zoning amendment um to allow a new site plan and building elevations for uh 36 or 3600 foot uh credit union. The standard conditions that were approved in the original zoning will uh still apply. There are some modifications through this where we eliminated the zoning stipulations that pertain to uh the residential uses and um the building and site plan and we modified those to uh reflect the new building and site plan. So we'll go through this and we'll talk about the changes.

Any questions of Rusty? Have no questions. I'd like to invite the applicant up. Evening, Mr. Mayor, uh, council. Kevin Moore here on behalf of the applicant EIB properties in this application. Um, and I'll I'll be brief tonight. This is a smaller project, uh, but one we think that starts to fill in a gap that's located there on Bell Drive and Woodland Terrace. Um, I think Mr. Martin did an excellent job of uh reviewing the zoning application, the particulars and the technical aspects of it. Uh but this uh application is for seven detached homes uh in this uh property that's just over an acre. Uh the property is really surrounded by uh town home developments because this particular area of Bell and Woodland Terrace uh has been redeveloped uh over recent time uh as you're coming uh away from 41 uh on spring and then turn off in this area. It's been very much redeveloped uh largely with town homes and very nice town home developments. Most of them exceeding 10 or 12 units per acre and it looks it looks very very good. has been an excellent development, excellent community. Uh in this particular instance, uh these remaining properties, uh there's actually remaining five properties, three of which simply aren't available uh right now. They are those particular owners are waiting uh for long-term leases that they've had long-term tenants for. Uh they want to don't want to kick them out of their house. Uh and so is one of them. Another one simply wants to continue to own it and live there. So those will come available. uh but just not available right now. These two properties though are uh and in looking at uh the development arrangement here uh with uh with these properties, we did not believe town homes would be the right way to go here that we felt like detached homes would finish this off very nicely uh provide for a different home product.

A. Z25-005 Public Hearing - Zoning Amendment - Z25-005 - Allow changes to the currently approved site plan as well as an increase in building heights – Land Lot 700 – 1.95 acres – 3400-3420 Archerfield Way – Traton Homes Ward 3 Councilmember - Travis Lindley Councilmember Glenn Pickens recused himself and left Council Chambers at 7:19 PM. Joe Bennett, City Administrator, provided the following brief background: The subject property 3400 - 3420 Archerfield Way (Archerfield Subdivision) was rezoned from NS (Neighborhood Shopping) to RDA-Conditional in 2021 (Z21-006) to allow a subdivision with twelve (12) single-family detached homes. The site work for the development has been completed and the applicant is requesting a zoning amendment to allow an increase in building height as well as reductions to driveway length and building setbacks to build the new homes. Russell Martin, Community Development Director, provided the following background: The applicant is requesting a zoning amendment for an increase in height, as well as setback and driveway length reductions. Community Development has reviewed the zoning amendment request considering the following changes to the original zoning approval (221-006): 1. Allow an increase in building height from 35 feet to 38 feet for Lots 1-12. (Staff Supports) 2. Allow a front setback reduction from 20 feet to 17 feet for Lot 1. (Staff Supports) 3. Allow a front setback reduction from 20 feet to 19 feet for Lot 2. (Staff Supports) 4. Allow a reduction of the minimum driveway length from 22 feet to 20 feet for Lots 1-3. (Staff Supports) 5. Allow a rear setback reduction from 10 feet to O feet for Lots 1-12. (Staff Supports) The zoning amendment does not require modification of the Future Land Use Plan from MEDR (Medium Density Residential). Community Development has reviewed the proposed zoning amendment and believes the changes meet the intent of the plan approved for rezoning and should have no negative impact to the adjacent properties. Additionally, the setback reductions are necessary due to the right-of way dedication required for the lots facing Campbell Road. Community Development Staff is supportive of the zoning amendment request. Community Development recommends approval of the zoning amendment to rezoning case 221-006 for an increase in building height as well as reductions to setbacks and driveway lengths with the following conditions: Standard Conditions (Requirement #2, 8, 16 and 17 from Section 1201 of the Zoning Code is not applicable}

A. COW2025-111 Review of the November 17, 2025 Mayor and Council Meeting Agenda LIC2025-037: Russell Martin, Community Development Director, explained this is application for an already approved license for fall/autumn items, and now she wants to add Christmas trees. LIC2025-039: Russell Martin, Community Development Director, stated that Smyrna’s code requires 1,000 linear feet distance between other pawn establishments. There is another title pawn location within 850 linear feet. The applicant is arguing that if one were to take direct path of travel it is 1,044 feet, but that is not what code says, so staff is recommending denial. There is no provision in the ordinance to allow for this as reviewed by counsel. Z25-007: Russell Martin, Community Development Director, explained that the applicant is requesting a rezoning from OI to MU-Conditional for a mixed-use development with 250 multi-family units and 2,500 sq. ft. of retail. The future land is Industrial and a land use change to Mixed-Use is required. Community Development is not supportive of the change in zoning from OI to MU- Conditional and the accompanying land use change from Industrial to Mixed Use. No land use changes have occurred to the surrounding area since the adoption of the 2040 Comprehensive Future Land Use Plan, thus, there are no changing conditions to support the proposed zoning and land use change. A rezoning to MU-Conditional is incompatible with the surrounding uses and the MU- Conditional zoning does not provide greater benefit to the city compared to the current OI zoning. Additionally, Community Development has concerns with the introduction of multi- family units along the Highlands Pkwy corridor which is occupied with commercial. Both the Planning and Zoning Commission and Community Development recommend denial of the rezoning from OI to MU-Conditional at 0 Highlands Pkwy. The next major Comprehensive Plan that is done every ten years has to be completed by October 2027. Blake Brady with Wood Partner presented brief highlights.
