Community development is recommending approval of zoning uh to revise the site plan and elevations of reszoning KZ21-014 um in the mixeduse uh conditional zoning district at South Cobb Drive and Oakdale Road for 45 town home units at 10 units per acre and a 5,000 square foot drive-through restaurant. We've kept most of the we've kept all the standard stipulations from section 1201. Um we have modified the the special conditions from uh zoning case 21 from the zoning case 21. We've added the setbacks requested uh for the town home units in stipulation number 10. And then um everything from the previous request is staying the same. any transportation improvements on South Cobb Drive will be reviewed uh by uh G DOT prior to any development permits being issued. Um and then you have, you know, requirements for storm water improvements, water and sewer and fire access. Then we move further. We've eliminated the request some of the stipulations that were no longer applicable and modified the rest of them. And I'll get to the end here where we um we we modified the site plan stipulation and the ele elevations stipulations to reflect the dates of the elevations and site plan submitted for this request. And then we tied the the town home elevations to the standards established in section 501 which are the new uh town home requirements which require some articulation uh varying roof types and so forth. So those will all be applicable um to those um town home designs. 41 allows for the mixed use or allows for the drive-through restaurant. 42 um allows lanes to be located between the building and the adjacent street. 43 allows for the additional accessory structure. 44 um requires the allows for the the dumpster to be visible provided it it's in a three-sided brick enclosure. And 45 uh the developer shall replace the existing curbs within certain city's jurisdiction with with highback curb and gutter.

Uh I do this in a lot of jurisdictions. Do not find very often where you have that level of responsiveness to to community members uh from uh you know local staff. And I just wanted to say that because it was it caught me uh and you should know about that if you don't already. Um this particular application uh as Mr. Martin has expressed does come to you uh as a request for minor modification to the zoning that was originally approved by city council in 2021. little historical context uh which I think is important just um not necessarily that it lends itself to the particular issues in front of you tonight but just as kind of a recollection this particular property which is 2 acres at Campbell uh road and Atlanta road this property was zoned neighborhood shopping and had been for years and years and years neighborhood shopping commercial category allows drive-through restaurants and so forth and so on that could have gone here all along but it was that type of use was not supported uh by by the residents and community that immediately are in this area of Campbell Road who as you all know were very engaged uh in their community. Uh one of the first applications that I was involved with uh was one for a large medical office building uh at this location. Uh that never really came before you because uh the engagement with the community at that time, this is prior to 21, was not supported at all. And so that was ultimately withdrawn and we gained a better understanding of what what was the community looking for and their kind of hot button issues. Ultimately uh the current owner and applicant in the application that was approved in 21 came forward uh with an application for town homes at this location.

Um and 15 uh limits the maximum height of the the homes to 35 ft. And then 16 and 17 tie the zoning of the property to the site plan and building elevations that you've seen here. Um, with that being said, I'll be happy to answer any questions for you. Any council members have questions? They're minimum 50 foot. The the two to the north are probably 50 feet and the one is the one to the south is a little bit larger. besides and and Rusty, this may be more of a a question um for the developers um because I think I remember this of course from before and there was a concern from one of the neighbors. I just want to know if there's been any outreach for this area that's being redeveloped or being the request for the three. Have has there been any outreach of any neighbors around in that area? There was nobody at the PNZ meeting and I don't I don't in talking to Joey I don't think there was any uh we didn't receive any calls or emails regarding this resoning and and I have not either. I just want to make sure that we if there was anything or if if anybody addressed any of those possib as far as the you'd have to ask the developer what they did and they'll be they'll be coming up in just a second. Yeah. before this to uh let let the neighbors know and get their concerns. Any other questions or comments? Miss Wilkinson. Um for clarification, um so the lots meet the standards for R8. Is that what she said? And so there's no variances with no variances requested with this and no land use change. Okay. Right. And if there's no other questions, I'd like to invite the applicant up. Come on up. Be sworn in by a city attorney.

Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM
Summary in the published minutes, not a verbatim quotation.
A. COW2025-099 Review of the October 6, 2025 Mayor and Council Meeting Agenda Z25-010: Joey Staubes, Planner II, provided a brief background as follows: LGE Community Credit Union is requesting a zoning amendment of Z22-014 for 2934 & 0 Atlanta Road to amend the site plan, elevations, and zoning conditions for the development of a 3,605 sq. ft., credit union with 25 surface level parking spaces. Being within the Urban Design District approval is required by the Urban Design Commission. On September 19, 2025, the Urban Design Commission voted to approve the application. Community Development recommends approval of the zoning amendment to amend the site plan, elevations, and zoning conditions on 0.65 acres for a one-story, 3,605 sq. ft. credit union, including the variance supported by staff. Z25-009: Joey Staubes, Planner II, provided a brief background as follows: The applicant is requesting to rezone the subject property at 2351 Benson Poole Road from OD (Office-Distribution) to GC (General Commercial) to allow additional uses for potential tenants in the existing building. The property is occupied with an 1,800 sq. ft. building previously used for an office. The applicant has no plans to redevelop the property and will utilize the existing building and parking facility as-is. ATH2025-152: Kristin Robinson, Deputy City Administrator / CFO, provided the following background: Citywide signage updates was a line item in the FY 2025 Adopted Budget and was anticipated to be awarded in FY 2025. This project was not awarded until August 2025, and the FY 2026 Adopted General Fund Budget did not include funding in the Economic Development budget. We need to increase the departmental budget to cover the expense that was approved. It will be a one-signed amendment which means it will be covered by General Fund Balance. The City also received the LMIG Safety Grant from the State in the amount of $424.400.00 that was not included in the Adopted Project Length budget in the 2022 SPLOST fund. These grant proceeds are used for traffic calming. We need to increase that project budget and also the revenue budget to account for this grant receipt.

2. Allow drive-thru facilities and associated queuing lanes be located between the building and the adjacent street. (Sec. 720.8.11) 3. Allow an additional accessory structure (Sec. 501.11) 4. Allow a garbage dumpster visible from the public street. (Sec. 717.81 (c)) and (Sec. 717.82 (a)). The City Engineer has reviewed the proposed rezoning with respect to transportation. The City Engineer has requested a sidewalk along S Cobb Drive and Oakdale Road for the length of the project, as well as connections to the buildings. Additionally, decelerations lanes are proposed for right-turns into the restaurant property on Oakdale Road, and deceleration lanes are proposed for right turns into the restaurant and townhome property along S Cobb Drive. Any improvement along S Cobb Drive will require Georgia Department of Transportation (GDOT) approval. The applicant is proposing two below ground stormwater management facilities for the townhomes and restaurant within the development. The City Engineer takes no exception to the stormwater management concept as shown. The design submitted during permitting will take into account site constraints such as topography, utilities, and tree/landscaping requirements. The site will be required to meet all the requirements of the City’s Stormwater Management Ordinance. Community Development has reviewed the proposed plan against the requirements of the Zoning Ordinance with regards to setbacks, building height, building separations, parking requirements, buffering and landscaping. The zoning proposal meets a majority of the zoning requirements of the MU zoning district. In addition the variances previously approved the applicant is seeking the following variances: 1) Allow a reduction of the external side setbacks from 25 ft. to 12 ft. for the townhome units. 2) Allow a drive-thru restaurant in the MU Zoning District (Section 720.2.11) (Staff Supports) 3) Allow drive-thru facilities and associated queuing lanes be located between the building and the adjacent street ( Section 720.8.11) (Staff Supports) 4) Allow an additional accessory structure (Section 501.11) (Staff Supports) 5) Allow a garbage dumpster visible from the public street (Sections 717.81 & 717.82) (Staff Supports).
And we know this because we have conflicts with the existing industrial uses out there with the surrounding single family uh uh single family homes that abut these um uses. Uh modifying the land use category of one property from industrial to mixed use on Highlands Parkway would be inconsistent with the intent of the comprehensive plan and future land use map. This would be a mixeduse zoning dropped in the middle of an industrial classification that is surrounded by office and industrial uses. Um, next, the addition of 250 residential units on Highlands Parkway create conflicts with the existing industrial businesses and and associated heavy freight traffic that travel the corridor. And finally, the mixeduse um land use and zone zoning district is intended for pedestrianoriented developments within the designated activity centers. And obviously, this is a a suburban design where the building is pulled off the street and surrounded by surface parking. These are pictures of the subject property. Community Development is recommending denial the reszoning from OI to mixed use conditional and the land use change from industrial to mixed use at zero Highlands Parkway for a mixeduse development with 250 hotel rooms and uh 2500 square feet of retail at a density of 38 units per acre. Um the PNZ board, they also recommended denial and they voted at 70. With respect to that, should the council uh believe that um approve this request, we'd make one recommendation that you guys um add three zoning stipulations and two of two of them are related to the the site plan submitted and the the elevation submitted. if you guys hold them to that if you decide to approve this. And number three, the applicant has profered two um stipulations related to providing five uh units at affordable rates, which is 80% of the area median income and that they'll fund the installation of a traffic signal at Highlands Parkway and Lakeidge Drive.

All those in favor of the motion to deny will raise their That's a unanimous vote. 70. That application is denied. We'll move on now to item C. This is a public hearing zoning- 007 uh reszoning from O and I to MU conditional for mixeduse 250 multi-unit multif family unit development on Highlands Parkway. Mr. Jones, any background, please? Mayor, the applicant is requesting to be reszoned from O andi to MU conditional for mixeduse development with 250 multi- family units and additional 2500 square feet of retail. Uh the future land use for this area calls for it to be industrial and the land use change from mixed use is required uh which is the purpose of this zoning hearing. Uh the planning and zoning commission has reviewed this and has voted to deny the request by vote of 70 at their August 11th meeting. Martin. Yes, sir. Uh, this request went to PNZ on Octo August 11th. Uh, it's been tabled subsequently since that date. Uh, you guys will hear tonight and make final uh, action on it. The subject property is located at uh, Highlands Parkway. Um, it's vacant track. It doesn't have an address. Um, but it's pretty much right across from Technology Court in uh, Highlands Parkway. It's a it's almost seven acres in size. Uh, currently the property is being used as overflow parking facility for the Fountain's office buil building. Um, the applicant is proposing a mixeduse development with 250 multifamily units um, at 38 units per acre and 2500 square ft of retail with in that uh building. The request is to go from OI office institutional to mixed use condition conditional. The zoning map reflects um OI zoning on either side of the property.

But given that the traffic regularly backs up where I cannot even get into my own development because that traffic lights only time for eight seven to eight seconds, I strongly urge you to not develop that land at all because it's just going to add more pain to the residents who live there. In addition, do do our schools have the capability to handle all these kids that are that we continually we build here, we build there, we build everywhere. Where's Cobb County schools? Have do we talked to them? Hey, we want to build 100, you know, 163 units, possibly 320 kids or more. Can the schools support it? And my answer is no. Because I see when I see a temporary classroom, landscaped in so it lives permanent. I'm thinking we really need to check ourselves and figure out, are we doing what's best for our children? So, I'm I'm on record. I'm opposed to both parts of this. And, you know, if you want to develop stuff, go into older neighborhoods and develop houses one for one. Bring those land values up, which will bring property taxes up, which may support our current school, but building more and more houses will not pay for new schools. You know, impact fees pay for new schools. So, thank you for your time. And again, I'm opposed to both parts of this. Thank you. Thank you. Last person signed up is Lauren Morris, 2199 Misty Lane. And and after Miss Morris, was there anyone else who had come up to be sworn in that that are not on the list? Okay. Good evening, Mayor and Council. Thank you for the opportunity for me to state my opposition to this proposal. Um, I like my many friendly neighbors here are concerned about the traffic, that fiveway intersection, the outflow of cars onto Oakdale just creating even more havoc at that intersection, plus all of the pedestrian and kids and bikers.

And that's my understanding that's the part of the property from what I was hearing. Yeah. Thank you. And and just not to beat a dead horse or anything, but with respect to Oh, it's been beaten with the with the with the with the with the with the with the with the with the with the with the respect to the storm water management, this is has a GC zoning C uh zoning designation. If they came in with an entitled project that didn't require reszoning, they would still have to go through all this storm water review and have to do the same thing as well. So, um, this that's going to be whether this is a town home development or if it's commercial development or whatever it it it's an issue that the city is going to address during the development process for this. Any other questions, comments, or anything for the applicant? Okay. Uh, we'll close the public hearing now, and this is in Ward 7. I'm going to turn it over to Mr. Oglesby for a motion. Yes, Mr. Mayor. Thank you. Uh I'm going to recommend uh that this is approved based off the updates that were given at the last zoning meeting. Uh so I do recommend approval here. Like a second, please. Okay, we have a motion to approve by Mr. Oglesby and a second by Mr. Gold. Everyone, please vote. And that's approved. 70. Thank you and I appreciate everybody coming out tonight. Um I want to thank the residents for the for speaking and also to the developer for the applicant for working with the community. I know you had two community meetings made a lot of changes. Um and so hopefully this will be a successful project. Yeah. All right. We'll move on now. We don't have any privilege, license or show cause hearings. We'll move on to formal business. We have six items on formal business. Uh the first

Uh in addition uh by having town homes, we were concerned with having more driveways out onto Bell and Woodland Terrace. It wouldn't just it wouldn't sit right with the way the rest of that uh redevelopment has occurred. But uh with fewer uh detached homes, we feel it makes for good land use planning. Uh we have submitted home elevations and house renderings to city staff. They're excellent homes that will be built here in keeping with the redevelopment that's already occurred. uh what's proposed is consistent with your future land use plan designation. Uh we have uh presented this to your planning and zoning board and received a recommendation of approval. Uh staff has looked at this and also recommends approval with the list of conditions uh that we have worked with staff on and are in agreement with all of those conditions. We feel like it's a good reasoning. This will set up the remaining three properties so they can all be developed like this in the future hopefully. uh and we'll finish this particular area off for redevelopment uh and do so in a very meaningful quality manner. I'm here and can answer any questions that you may have and appreciate uh your consideration tonight and respectfully request approval uh with staff's conditions. Thank you each. Thank you. Any questions? Mr. Lindley. Thank you uh Mr. more and thank you as always for working with uh not only council member Pickkins but with with staff. Uh what's the timeline and do we have any idea on price point? Sure. Uh timeline is fairly immediate. Uh once if if approval occurs uh they'll move straight into final engineering design and and step forward. So they'll move forward very quickly on this. Uh the price points here will be in the say call it 500s uh which is comparable uh but a little bit more than what maybe some of the town homes may have been going for there because these are detached homes.
