We still have Ford area queens by the way and we have lots of equipment. So we have our own in-house folks who maintain these units. And then twice a year the company actually the machines are actually built in Byron Georgia just south of Mon company called Cooler Ice. So these are actually Georgia produced machines and uh we do preventative maintenance twice a year. Uh they come up that we pay for to make sure the machines are properly maintained and taken care of because obviously it's in our interest to make sure the machine's operating at all times because if it's down obviously you don't make sales. So you know we're our history of dealing with businesses and equipment and stuff. uh we make sure our stuff works. And so yes, to that point, yes, we have someone locally that's maintaining it, keeping it stocked and cleaned. And on top of that, we also put out a trash can out there that's going to get emptied regularly. We're not depending on the property on to do that. We're doing that uh because people, you know, sometimes they'll take a bag or leave it, but we make sure plus we put up cameras to on all these locations. So we are monitoring it with high definitionition cameras all the time. So to your point, yes, the machine's taken care of and maintained regularly. Oh, is it also available like 24/7? Correct. Yes. People want to get ice. Okay. And the other thing is making sure, you know, they already have lighting on the property, but we want to make sure it has good lighting, you know, for safety purposes, too. Any other questions? Thank you. Thank you. Appreciate it. This is a public hearing. I'd ask now if there's anybody who wishes to speak for or against this item to come up and be sworn in by our city attorney.

It merely asks them to seek a tenant or use that does not violate your own code or policy statements on the very definition of mixed use. You are being asked to approve a highintensity commercial use at a constrained bus intersection with a high volume of traffic accidents. This is a foreseeable hazard and the city owns the dirt on both sides of this Oakdale curb cut. You are inviting municipality risk and it would occur after this council was placed on notice tonight of the risk. Someone please make a motion to deny or at a minimum remand this to add conditions like a Cobb DOT sign off, pedestrian safety analysis, line of sight studies, and a meaningful buffer that will actually protect us. Thank you. We appreciate your hard work. Thank you for being here. Uh, next we have Glenn. Is it Paritch? Yes. Got it. Yes. Welcome. Good evening, Mr. Mayor and board members. I have lived at 2159 Oakdale Estates since June of 2006. So, I have 20 years of experience with Oakdale Road and the intersection with South Cobb Drive. And on the best of days, it's misery because the light only changes and allows five vehicles at a time from Oakdale Road to go either north or south on South Cobb Drive because there's no additional turn lane at that point. That wasn't really what I wanted to speak to you about tonight, but it's important that you understand the dynamics of Oakdale Road prior to the inclusion of all the cars that are expected to go to the Chick-fil-A for either in in restaurant service or for the drive-thru, which I understand it's going to be a double lane drive-thru, which is typical. Um the the traffic intensity study would appear to comply with the industry standard. The 5,000 square foot restaurant is expected to generate about 2300 additional vehicle tricks per day.

Um, but that's just me. Um, I I mean, and the site plan on this thing, it's a tough site plan. I, you know, I'll say that about it. I don't do traffic engineering. I don't do site plans, but but it it's got a lot going on. But still, that is not the way I would not go out on Oakdale Road and and try to get across the righthand turn lane into the lefthand turn lane with these people coming down Oakdale Road that aren't going to let me in. I'm going to go out on South Cob Drive. Right. That's why that was the first option that I went. Mr. Ogles will be next. Mr. Lindley. Hey, thank you. I I want to thank you for being here today. I I have to say this. I'm really disturbed that you all didn't do a traffic study. I stay in this area also. Uh that's really disturbing. What is your busiest time of the day currently for the current location? What are the busiest hours? Mr. Mayor, can I ask Daniel Lomax, who's the operator, to come forward? Sure. Do you need to swear him in too, Scott? Sorry, Scott. Thanks, guys. I wasn't planning on speaking today, but long-term Smyrna resident. We built a house right behind Market Village, so I walked over here. Um, I've been the owner operator of the Chick-fil-A since uh 2012. Been with Chick-fil-A for 25 years. So, Lo is above my pay grade. I just sell the chicken. Um, but I can tell you um just a little bit about the volume if that kind of helps. We're about twothirds the volume of the one that's closer to downtown Simrna and they just built one in Mapleton that took about 20% of my volume on top of that. So in retrospect of other Chick-fil-Ass we are below average volume.

May 22nd, 2026 for the installation of newly purchased traffic ballards around the green space at three locations and to authorize the mayor to sign and execute all related documents. This has been a long time in the making. you know, we've had to put those barricades out and back and it's a lot on our staff and these will be a lot safer for the folks who are using the green space. Mike, any background, please? Uh, yes, sir. So, the the as you said is the these are more permanent sturdy safety control for in the for traffic in the village green space. Uh, so there'll be two locations along King Street and there'll be one located on village uh green circle. U the requested length from May 20 from May 11th to May 22nd is based on the required installation specifications from the manufacturer and staff is recommending closure as requested. Pre-Council Meeting

Summary in the published minutes, not a verbatim quotation.

We have determined the most cost-effective solution is to treat the surfaces with a tinted coating, though this product has a higher unit cost because coverage is not as broad per gallon as the clear coat. The net increase in unit cost is $0.59/gallon. He stated that because of the cold weather, asphalt plants are not open. Realistically, this project will be substantially complete (finish work still being completed but open to traffic) by summer. CHOR2025-002: Mr. Randall also explained that after the pedestrian speed table was installed on the eastbound lanes at the westerly bridge of the Windy Hill Road project and the lane reopened to traffic, there was an apparent and obvious concern that the approach to the speed table was too steep and created a hazardous condition for drivers. City staff reviewed the conditions and design drawings and found that while both are consistent and within guidelines provided by the Georgia Department of Transportation, drivers have become accustomed to traveling faster than the design speed. This has created a potential safety hazard and liability. Working with the contractor we have developed a proposed solution to lengthen the approach ramp from 6’ to 10’, reducing the slope by 4% from 8.33% to 5.00%. Further, to reduce the time for which the lane will be closed to through traffic, the contractor proposes temporarily opening the right-hand eastbound through lane and closing the eastbound local lane from Friday, January 17, 2025 at 8 pm and reopening the local lane by 5 am on Monday, January 20, 2025. Council expressed skepticism that this needed to be done because the construction is not complete, and drivers are not adhering to the reduced speed limit and damaging their vehicles. Mr. Randall explained that if there is an unsafe condition in the roadway, the city could be held liable. Asst. City Attorney Jeffrey Tucker stated that the ambiguity of the Milton case makes this issue a little more complicated. The ideas of more signage, rumble strips, and Georgia State Patrol were mentioned. It was suggested that this be tabled indefinitely. AGR2025-001: Mr. Randall explained that with AGR2023-015, the City entered into a Framework Agreement with Cobb County DOT to administer the plan development process for the South Cobb Improvement project until such time as Smyrna attains its Locally Administered Project certification. The City has now attained that certification, and will start administering the project directly with the commencement of the Preliminary Design Phase of the GDOT Plan Development Process. This agreement is to complete the tasks that have not been started under the Cobb County DOT oversight phase. The funds are part of the 2022 SPLOST project list.

So with that I Mr. Welch. Thank you Mr. Mayor. I also want to thank our staff for doing all the cleanup work and setup work for the birthday celebration this weekend. They they do a fantastic job and really can't say enough about how how good of a job they do. We the council appreciate it and also want to mention on Saturday before the birthday celebration, the Smyrna Historical Society had an open house, both the Reed House and Taylor Bronner and I I worked the Reed House and I I estimate we probably hadundred people that came in just to see those facilities. So, we appreciate all y'all coming out. I think the plan is to try to do it again. I don't think we uh I think we purposely don't rent that facility or e either of those facilities that day. and um we'll try it again next year just to bring awareness to the great public facilities that we have for events and thank the city for allowing us to do it that I miss Wilson. Um I want to reiterate what my fellow council members have said thanking the staff for all their uh the work that they put into the birthday celebration. lot of people came out and thank the staff for all their work. Mr. Gold, thank you, Mr. Mayor. Just a couple of quick things. Uh to echo what Travis said, we had a very productive ward meeting uh here yesterday. Appreciate our folks coming out. Kind of a rainy rainy day. A lot of good input and questions. And then this afternoon we had a trafficcoming meeting and uh gota give staff a lot of credit for the work they're doing throughout the city being creative and come up ways to help ensure our roads are safe and usable and neighborhoods and are comfortable and all that with traffic and pedestrian safety.

But given that the traffic regularly backs up where I cannot even get into my own development because that traffic lights only time for eight seven to eight seconds, I strongly urge you to not develop that land at all because it's just going to add more pain to the residents who live there. In addition, do do our schools have the capability to handle all these kids that are that we continually we build here, we build there, we build everywhere. Where's Cobb County schools? Have do we talked to them? Hey, we want to build 100, you know, 163 units, possibly 320 kids or more. Can the schools support it? And my answer is no. Because I see when I see a temporary classroom, landscaped in so it lives permanent. I'm thinking we really need to check ourselves and figure out, are we doing what's best for our children? So, I'm I'm on record. I'm opposed to both parts of this. And, you know, if you want to develop stuff, go into older neighborhoods and develop houses one for one. Bring those land values up, which will bring property taxes up, which may support our current school, but building more and more houses will not pay for new schools. You know, impact fees pay for new schools. So, thank you for your time. And again, I'm opposed to both parts of this. Thank you. Thank you. Last person signed up is Lauren Morris, 2199 Misty Lane. And and after Miss Morris, was there anyone else who had come up to be sworn in that that are not on the list? Okay. Good evening, Mayor and Council. Thank you for the opportunity for me to state my opposition to this proposal. Um, I like my many friendly neighbors here are concerned about the traffic, that fiveway intersection, the outflow of cars onto Oakdale just creating even more havoc at that intersection, plus all of the pedestrian and kids and bikers.

definitely the response time. Um the next day as we drove by a lot of neighbors were pulling together but there was like no coverage I guess you know media coverage is not always good not always bad but it's there's no awareness to the situation. Um, we didn't see any police presence even throughout the day like drivebys. Even today as I kind of took a couple walks around, didn't see the same thing. And I think that's very important because everyone looks towards HOA or leaders of the community to kind of fix it or do something about it. And as much as we can do, we can also do little, right? Um, some of the neighbors that did have bullet holes, and I'm not sure if uh one of our neighbors was able to speak, but they were luckily out of town when they came home. They saw a hole right above a five-month-old crib that shot through their home. Um, I don't know if those houses the doors was knocked, people were checked on to see if they're alive. I can imagine living single and some happening to me, maybe not having the awareness there. Um, but I know there was a lot of surveillance footage and this kind of streamlines into a little bit of my next point and I'll watch my time, but in living here for about two years, my interaction through a lot of situations that we've had in our neighborhood such as multiple incidents of car break-ins where we were we put in the report, we have v video footage because our neighborhood has cameras everywhere. Um, and we'll put the report in, but there's never like an aftermath. There's no heightened patrol. There's nothing that we visibly see happening after these reports are put in. Um, we've called for non-residents, teenagers hanging between our residents.

Committee of the Whole Meeting - A. MAX BACON CITY HALL, HR TRAINING ROOM

Summary in the published minutes, not a verbatim quotation.

The zoning proposal meets most of the zoning requirements of the MU zoning district. Based upon the review of the development by the Transportation Engineer, the city supports the proposed traffic signal at Davis Road and Windy Hill Road. Davis Road will be widened to meet city standards and improved with curb, gutter and sidewalk. The developer will be responsible for all traffic improvements associated with the development. Mayor Norton added that the section designated as a civic building would be a great spot for a future civic project in conjunction with this development. He also stated that this does not commit the city to purchase the land without a vote. The civic building portion is merely conceptual at this point. The apartments would rent at market rates. Councilmember Wilkinson expressed concern about pedestrian traffic from the development to the shopping center across the way. Eric Randall, Public Works Director, explained that there is a safe and easily accessible crosswalk for pedestrian traffic. Discussion took place regarding which schools this development would be districted to and the parking ratio. Community Development was assured that the schools this development could possibly feed are underpopulated and can handle more students. The ratio for parking per unit is 1.5/unit. LIC2025-003: This item is to be tabled to the January 21, 2025, council meeting because the applicant is unable to attend the meeting tonight. Discussion took place regarding “gaming” as it is part of the name of their business. Mr. Martin stated Community Development would reach out to them to get a definition and find out if there is an age- restriction. ATH2025-001: Andrea Worthy, Economic Development Director, explained that the City requested proposals for an update and expansion to the Smyrna B.O.L.D. Downtown Master Plan. Fifteen (15) proposals were received on Friday, July 12, 2024, and evaluated by staff from Economic Development, Parks and Recreation, Community Development, Public Works, Community Relations and selected Smyrna residents.

Second. Second by Miss Wilkinson. Everyone, please vote. Miss Hines affirmative. Almost there, Miss Hines. Almost. That's approved. 6. Now we're on to item R. Um, we had a presentation on Thursday and there's been an agreement in the works and this I'm excited about this because this is going to make uh city of Smyrna residents safer. Um, this is authorization to enter into an agreement with Flock Group, Flock Safety. um for subscription to to flock safety, the safe city program to include unmanned air support service addendum, the drones law enforcement product addendum and safe city program addendum. Um together with the integration and implementation services for a cumulative total amount of $5,717,500 to be paid over a 10-year period with the right to terminate if the city so chooses. So, we're not hamstringing future councils. Um, and this is a tiered uh tiered contract where we we pay a little at the front and then it goes from there. Um, this is from the uh 2026 adopted general fund budget and we're increasing the police administration departmental budget in the amount of $123,500 which is the amount due at signing. This is also from general fund. Mr. Jones, background please. Mayor, you use the word excited and certainly we are. Uh we've we've had flock come in. They've given us multiple presentations. There's there's amazing examples of how this will be used. We currently using the service and they're expanding it by about 70 additional camera and license plate. We have 11 I believe today. So, um, to give you an idea of how that compares, the city of, uh, Dunwoody has about in place. Uh, so we're getting there. This will also, um, allow two remote launched aerial drones to provide oversight coverage uh, to incidents, whether that be fire, um, civil discourse, police events.
