And Rusty and Joey, I trust I trust y'all and this and this staff to give us great recommendations, but I just don't feel like we have the information on this traffic side of things. What What date would you like? March 16th. March 16th. Yes, sir. And if if we find that we can't get it done in time for another two, we'll certainly let folks know, but we'll push as hard as we can. Then I'll entertain a motion to um table this until the March 16th. So move meeting of the mayor and council. And we have a second uh by Miss Hines. Everyone, please vote. Miss Hines and Miss Wilkinson, we're waiting on How do y'all vote? Oh, you did. Okay. Okay. There we got it. We got it now. Uh, that's been tabled unanimously. Uh, and we look forward to seeing more from y'all. Thank

Thank you, Jennifer. Um I guess a couple things for you. Lieutenant, could you address the once once the investigation's over? Um my recommendation on that would be to keep that as soon as the investigation is finalized. have additional questions, he would be the one. I'm very familiar with him. He's excellent. Yeah, he's upstanding. Thank you. And then on the trafficcoming issue, um, couple things. We have a a trafficcoming committee that, uh, Council Member Lindley chairs and I'm on it and so is Council Member Wilkinson. And to address many of these issues, one thing on the staff, I I think I mean for our city, I think our staff does a great job being responsive, right? Some obviously sometimes it doesn't always work. So, but totally understand but um but this has been years in making and I've gotten no response. Okay. So, we will have that on the list and we will definitely circle back with uh with some response on that. So, should I give my information to someone or and you're in W one, right? Can you uh send me an email and then I can connect you with Mark and we can go from there. We'll sort it out. Excellent. That'd be wonderful. I appreciate that very much. Yeah. And always a always a good uh rule is or thought is if you can't you know if you waiting for staff you're just not working for whatever reason reach out to any one of us and and you know help facilitate. And look guys we're we're doing a thousand things in once every day. I don't think it was deliberate to be honest with you, but I just like to get this finally resolved and and because it's becoming such a thing where, you know, we have people with babies, right? You know, walking around and and animals and humans, so that'd be greatly appreciated.

And we know this because we have conflicts with the existing industrial uses out there with the surrounding single family uh uh single family homes that abut these um uses. Uh modifying the land use category of one property from industrial to mixed use on Highlands Parkway would be inconsistent with the intent of the comprehensive plan and future land use map. This would be a mixeduse zoning dropped in the middle of an industrial classification that is surrounded by office and industrial uses. Um, next, the addition of 250 residential units on Highlands Parkway create conflicts with the existing industrial businesses and and associated heavy freight traffic that travel the corridor. And finally, the mixeduse um land use and zone zoning district is intended for pedestrianoriented developments within the designated activity centers. And obviously, this is a a suburban design where the building is pulled off the street and surrounded by surface parking. These are pictures of the subject property. Community Development is recommending denial the reszoning from OI to mixed use conditional and the land use change from industrial to mixed use at zero Highlands Parkway for a mixeduse development with 250 hotel rooms and uh 2500 square feet of retail at a density of 38 units per acre. Um the PNZ board, they also recommended denial and they voted at 70. With respect to that, should the council uh believe that um approve this request, we'd make one recommendation that you guys um add three zoning stipulations and two of two of them are related to the the site plan submitted and the the elevation submitted. if you guys hold them to that if you decide to approve this. And number three, the applicant has profered two um stipulations related to providing five uh units at affordable rates, which is 80% of the area median income and that they'll fund the installation of a traffic signal at Highlands Parkway and Lakeidge Drive.

But it will depend upon how quickly we go through the process of obtaining permits LDP to start with. Build on your question, Mr. Mayor, to make sure. Are will you will your company be the builder? Yes. To sell on the property after it's approved. Uh we don't have that part right now. Like to see it built. Yeah. Okay, great. That's what we intend to do. We're all on the same page then. That's good. Any other questions for the Right. Thank you. Appreciate you being here. This is Are Are you finished with your presentation? Yes, I am. Okay. This is a public hearing. I'd like to invite anybody who wants to speak for or against this item up now. Be sworn in by our city attorney. Come on up. Welcome and thanks for being here. Running away. If you'll just state your name and address for the record. Certainly. It's Rebecca Johnson at 568 Lake View Terrace Smyrna. Um, right down the street from where this development is going to be. So, I'll be very I thank you, Mr. Mayor and Council, for allowing um these these statements. I wish that I had uh been at the earlier zoning hearing, but I didn't know about it. So, um I wanted to make these uh comments um on not officially on behalf of a whole neighborhood, but unofficially on behalf. Um there are really four strong issues that that make us against this development. Um, traffic is, any of you who have been down there, uh, on Cooper Lake Road trying to get on East West Connector, horrendous. It's It's horrendous. Uh, particularly morning and evenings coming to and from work. Um, I mean, we see traffic back up from uh, east west all the way close to a mile up Cooper Lake, past Nicac, over the hill, and it it last and last and last.

There's quite a bit of green space there, just seems to me a good a good fit for that piece of land and a good a good way for us to get some tax revenue and do the right thing at that that corner. Thank you. Anybody else want to speak for against this item? All right, we'll close the public hearing and this is in ward four. I'll turn it over to Mr. Welch. Thank you, Mr. Mayor. Could I call Joey back up for just a minute or just for a question on the um on the site plan? Yes, sir. Was there any question or discussion or consideration given to the traffic and being able to get in and out of this development? I I can understand the the first speaker's concern for pulling out there on the lake. U there's there's ways to assist it, but Was there any discussion during y'all's review? Our transportation engineer has reviewed it. Our fire marshall has reviewed it. They didn't have any major concerns. I I don't think we can do a three-way stop there. Potential to do a two-way stop, but uh anyway, that's that was my question. Um with that, Mr. Mayor, I make a motion to approve item 7BZ25-011, the reasonzoning request as presented. We have a second. Can I ask one question? Are you adding the stipulation? Yes, I I appreciate you mentioning that, Scott. But I do want to add a stipulation that the in buildings contain no more than 50% party product or similar um needs to be a mixed use. Added that to the motion. And did I hear Mr. G? Everybody please vote. Mr. Lenley, how do you vote? I vote yes. That's approved unanimously. Thank you.

And I would like to finish with one final very important point. If we as a city, the residents, the planning council and mayor allow for shoehorning of highintensity traffic drive-thru restaurants that this infrastructure cannot support today, where does it stop? What happens when it is a drive-thru restaurant in your front yards? Who will stop them? This would set a very bad precedence and should not be approved. Thank you for hearing. Thank you. Thank you for being here. Next we have William Schwarz, 2168 Oakdale Estates. Thank you, Mr. Mayor. Members of council, I'm I am very opposed to this because the Odell Road entrance is about 60 feet from South Cop Drive. I walk my daughter that way pretty much every time she drags me that way. So, you're talking about having an inter left, you know, and I see nothing in the plan where they're going to prohibit left turns from Oatdale Road going toward Atlanta road into this facility, which means the travel back up onto South Cow Drive. So the problem you had with the current Chick-fil-A, you're going to have with this Chick-fil-A. Additionally, that is a blind curve and cars because of jurisdiction. I'm not going to argue that now. Between Smyrna and Cobb County, Odell Road is a racetrack. People regularly go 50 miles an hour and they go 50 m an hour up to that traffic light that stays green for about 7 seconds, which gives you time for two cars to get through legally. Additionally, that 60 car drive-thru, how do we know when it first opens? It'll probably be 120 cars, 180 cars. It's going to be a brand new facility. And we they don't know what they don't know. They're speculating as much as anybody is.

pedestrian crossing improvements located at Hawthorne Avenue and Atlanta Road Railroad Crossing with the design work to be performed by CSX Design Consultant in an amount not to exceed $48,500. And this will be funded out of the 2022 Splast traffic calming line item. Mr. Jones. Yes, sir. Mr. Mayor, so this request is based on a need that after review of the safety of the pedestrian access that's located Author Avenue at Atlanta Road Railroad crossing. Um there are some valid concerns that have been brought forward that need to be evaluated and addressed. Uh we've also received numerous citizen complaints, concerns about pedestrian safety at this location. This project will be performed in two phases. The initial phase is design and most of that data has already been collected and then a construction phase will follow. Recommend approval and an amount not to exceed $48,500 to be funded out of the 22. Any questions or comments from council? This is in W three. Mr. Lindley have motion do pass. Do I have a second? Second by Mr. Pickkins. Everyone please vote.

You said twothirds volume and and you know, I want you to be successful, too. But what does that mean for the number of cars coming through there? uh and and how that's going to work, you know, whether it's on I'm not so concerned about it backing up onto South Cob Drive, but how it's going to interact with Oakdale where those where those neighborhoods are concerns me a lot. Um and it might work out fine, but I'd like to see that. Um, I'd like to see some some study that tells me what is twothirds of volume where you know what times a day and what I I just I I don't I don't feel comfortable uh at the moment because I haven't been given the right answer or or an answer okay to my question. Um yeah, our traffic studies typically they'll show us you know car volumes but we don't get a lot into the you know into the nuts and bolts of what go GDOT wants until we get the permit. But you're talking about on South but on but on Oakdale I mean that's gonna it's just it's an odd intersection. It's a significant impact. I just I wish that there was something that I could look at and say okay I understand now how many cars are coming and what how it's going to be dealt with and how it's going to interact with this space but I don't see that. So but but I don't get a vote. So uh okay. Anybody else have any questions of uh the applicant or any concerns? Okay, Mr. Uglesby, I I really think this is something we should table. All right, I think Hey, Mr. Cochran, what what can we do here? You can make a motion to table. You could make a motion to table till our next meeting or for a month.

Well, he's the point of contact for I mean, he's the point of contact for what you're trying to get done or what your what your concerns are, right? So if you are working with him on solutions and you're working with staff, we want to get whatever this whatever the problems are taken care of. So talk about what your issues are other than what you've out I mean is there is there other things that you're concerned about? Um yes, we're the planning and zoning the zoning in our area. We're zone residential then they had something coming up um what is it industrial then we had something coming up mixed use. We have an issue with that. We have an issue with traffic coming. We have an issue with trash in the neighborhood. We have an issue with um poor lighting in the neighborhood. So I think I think on the traffic cal and the poor lighting I think there's a lot that we can do. I think that that area was industrial when it was annexed into Smyrna. And so you you have an industrial and residential mix over there that has been present since that became part of Smyrna. So we're working on those issues. I don't know if you want to speak to what you've been able to accomplish or who you're working with on staff, but I I do know that we are responsive and we take care of the issues that come up from our citizens. So, please explain where we are with this issue. Yeah. So, good to see you here today uh expressing your concerns. I always encourage our uh neighbors to come to city hall and come to our council meetings and speak up. Now, with that being said, uh I do also take issue with uh the statement of city staff not being responsive.

And additionally, um, the claim of the reduction of 163 apartments to 45 town homes does not make sense to me. It just doesn't pencil. While it may mean less traffic from onsite residents, it certainly will not diminish any traffic from people going into a fast food restaurant for in dining room service or drive-thru. Uh I thank you for your time and please uh vote to oppose this. Thank you. Thank you for being here. Um, thank you very much. Next we have uh Debbie Stallman, 2228 Misty Lane. Good evening. Thank you. In consideration of approving this plan and allowing it to go forward, I am adamant that it should not be approved. And here's why. The land is zoned as mixed use and according to code, drive-throughs are not allowed. However, it has been stated that drive-throughs can be deemed design features rather than use features, which I find to be very convenient for Chick-fil-A. Um, I will say it for the record. Chick-fil-A is a restaurant fundamentally built around its drive-thru. It is not merely a design element. It is actually a primary function of the business. And using a turn of phrase like design feature as opposed to use feature is simply a convenient way to shoehorn in a variance that has should have never been approved in the first place. But setting the past aside, we, the residents of a highly residential street of Oakdale, are now faced with the very real and impending consequences of a double drive-thru Chick-fil-A restaurant that for all practical purposes is being plopped directly into our front yards. The very situation that zoning laws are meant to protect protect the residents from. These impacts include, but are not limited to, high intensity traffic that in our existing infrastructure just simply cannot sustain. Increased danger to our children and the pedestrians, disruption to our buses, bus routes, and emergency vehicles, and the inevitable reducing and lowering of our property values.

We'll look How about pictures if you want to see the pictures? Oh, sure. And and after this, if you can hold for a second, I'll give you my email address so you can send that over and um Mark is really really good about trying to get the signs up. We were able to get on the other end and sometimes there are things that stop us from being able to do it, but we're going to see what we can get done and we'll get code enforcement out there. Sometimes you got to do multiple things. He called me back the other day and he said, "I'm working on getting some signs out there." He said, "However, I don't think I can put a no parking sign there at the top of Napa Valley." And that's the most crucial place. So, here's the thing, and and I'll look into it myself. Um, you know, but speaking as a as an attorney on some levels, too. There's certain things we legally can do and can't do. And and I'm sure as our county, our city attorney can tell you that, too. We'll do whatever we can if we can do it within the uh the the code to be able to get it done or whatever we can do to help out. We want you to be able to uh be okay when you're at home and not having to worry about the traffic. Since she's had a little bit issue with or perceived issue with staff can let's let's coordinate with Mike and get and Mr. Jones, our city administrator. He handles the dayto day and um we'll coordinate and and get you out. I would be glad to meet with you out there. Just like I told Mr. Marwall, I said, I will meet you in my neighborhood and show you exactly what I'm talking about.
