I will say that I did reach out to Chick-fil-A. I know that there were some concerns about the right turn onto Odell and they have said that they're looking to that. I'm not sure if they'll work, not sure if it's going to make things better in that area. As I see the administrator mentioned the uh the proposed road has been closed off now. That's no longer part of the plan. That was news to me today. So, it's good to hear that. Uh South Cobb is a it's a little bit of a spaghetti junction. We know that. Uh, and we're all working hard with Cobb County and the state figure out ways to make it better and hopefully we will in the future. With that, I yield back. Mayor, um, and thank you everybody for being here. Uh, you definitely alerted us to some issues that maybe we hadn't really thought about as much. And so, I'm happy we got the traffic study because that's definitely a concern for me. um what we've learned and thank you so much uh Mr. Jones for talking about it, which is something that has been an ongoing thing that I've kind of we already know South Cobb is an issue. Um that's that goes uh without saying and then to see the report giving even more um illumination to that issue. Um I I we don't have the ability to take care of some part of that issue which is um understandable. That's something under the county. Um, what I would ask and going back to Mr. Martin if I could ask this question again so I can make sure I understand this correctly. Those issues with regard to South Cobb and some parts of uh of that I guess is also DOT as in the state or whatever.

[applause] Yeah, man. I think for this picture caught him in the dog pile. Make sure you can see the camera. If you can't see the camera, it can't see you. All right. Down in front. Kneel down in the front. Maybe that's okay. Colton, you're in the back, right? Good. Good. Look forward. Colton, look forward. We good. Y'all, we got a special thing going with Lily right now and all our youth sports in. Congrats [applause] again, boys. [applause] Fun stuff. Thanks, guys. Yeah, man. All right. So, this is we we have a couple of more u recognitions, but I know that these boys, some of them have been at flag football practice already tonight. I know that they're all some of them are going out to dinner and and got school tomorrow. So, we're going to say congrats again and we're going to let you all go. Go ahead. [applause] Thank you, coaches and parents. We're going to take a little pause in the action and let these state champions leave the building. I was wondering if y'all were going to stay sitting in the back all by yourselves. Man, it's a lot quieter in here, isn't it? Those boys played their and girl played their hearts out. Uh and pretty fun stuff. All right, so we'll move on. Now we have recognition of the Smyrna Historical Society's Our City Through Your Eyes Art Contest winners. And I'd

Even if we have more than 60 vehicles, if you look at the site plan, and is it possible to pull this up? Thank you. If you look at the site plan, you see particularly like South Cobb Drive, that entrance has a significant amount of of of storage area, if you will, as people approach the site. So, in the rare event and the unlikelyhood that the drive-thru were to back up, there's still plenty of room on site uh for additional vehicles. Um the sidewalks uh as staff mentioned we're required to put sidewalks uh on the frontages of of the property where they do not exist today. Uh and um condition number 49 uh that we uh that we've agreed to with the developer uh and in consultation with with u your staff uh both in terms of the planning staff and the engineering staff uh installing the pedestrian beacon uh on Oakdale at a at an appropriate location uh that we're going to work closely with your staff to determine where that is. Uh, importantly, all of these will uh will go through an additional uh review, extra sets of eyes at at Georgia DOT, and we believe we meet all the DOT standards now. Uh, but they will officially look at the plans and and uh have to sign off on them before we get our permits. Um, even post opening. Um, uh, Kendra with Interplan is our engineer. She's here. She's had conversations with your city engineer, Mr. Wolf. And after the Chick-fil-A were opens, uh, they're going to look at the signal timing at the Oakdale and South Cobb Drive intersection to make sure that works uh, works effectively. So, in closing, uh, working, excuse me, working with Aeros and your staff, we believe we've worked in good faith, uh, to address the concerns about traffic, uh, pedestrian safety, visibility.

You have streets that go through you um you know what you want to maintain is um a street grid where you don't put all of your inbound and outbound trips to one single road. So you don't want to have a superb block type of development and you funnel all your traffic to Atlanta road. You want to make sure you have internal streets and internal alleys that connect folks from your from Concord and Atlanta down to, you know, through your redevelopment and uh well placed uh through um to your parking structures. Parking, you know, as we see it has to be accessible from two different locations. Has to be visible but screened so it doesn't feel like you're just driving through a parking district. I don't know about you all, but when I visit a great place, I don't really remember how easy it was to park. I remember how great the space was, but I do remember if it was really tough to park. There's a little bit of a balance. But the main element here in a mixeduse development is the fact that, you know, it's not encouraging you to drive, it's encouraging you to walk. And that's one of the the key drivers here in in our concept is the idea of the Jono mile. the fact that you're having a mix of uses. Uh, and all of this is to encourage folks if they're driving to drive and park once and then walk through your entire downtown. And you can do that if it's a good environment. You know, feasibly if you come in and visit the site, you could park in one of the parking garages here and it is a five-minute walk to the village green. Similarly, if you're parked northern on downtown, five minute walk. What doesn't encourage that walking is if you have a poor pedestrian experience where that's not an intuitive walk or if the walking experience is not great.

Um and also the reasonzoning amendment application does not honestly answer the analysis questions. Chick-fil-A the proposed Chick-fil-A is not compatible with the surrounding neighborhood and will be a nuisance. This parcel cannot be compared to the commercial industrial area where the Chick-fil-A is now. There are no drive-through restaurants on this side of South Cub Drive. It will also be a nuisance because people lord around the dumpsters at Crystal and the Chick-fil-A at night and that transferring those people over to our residential areas not a safe environment. Also, with the fast food parcel having a driveway on the Oakdale Road will cause additional traffic concerns at the five-point intersection at Church Road, Kenwood, Oakdale. More town homes would be agreeable to that area and they've been very successful in that area. So, I request that you deny the Chick-fil-A portion. Thank you. Thank you. Next, we have Mike Kennedy, 5003 Oakdale Road. Good evening, Mayor and members of council. Thank you for the opportunity to speak tonight. Um, I want to be clear about why I'm here tonight. Uh, this is not opposition to Chick-fil-A as a business. It's a request that this specific site be approved with conditions that reflect how it will actually operate once it opens. Um, if the location is approved and it's busy, that won't be a surprise. High demand is expected. And when demand is high, operations matter. The site is at a nonround five-point intersection very unique to Smyrna at Oakdale Road and South Cobb Drive. The visual the visuals before you show the existing traffic movements and crossing conflicts at this intersection and operates with a limited margin of error. Five-point intersections are more complex than standard intersections. They work safely only when nearby uses behave predictably. This proposal adds a high throughput drive-thru immediately adjacent to that geometry. That means peak hour queuing, stopand go movement, idling engines, and exterior speaker activity.

We're hoping that it helps the department with the workload that they're currently experiencing which is quite heavy for for all of them. and then to help the department just become more efficient in handling these uh risk management things which have become uh more and more and just to kind of coordinate those things uh and improve improve those processes for them. And then for parts facility we are recommending a parts maintenance tech one. This is mostly going to be situated downtown to help we're adding a bathroom. We're adding more things. We need to make sure that we're keeping that area clean for our citizens that come and want to enjoy our downtown area. So that's what that position will be mainly focused on. And then in times when the downtown isn't as occupied, they'll be helping in the community center, keep that clean, help however they need to, whatever they need to do there. We did have five other full-time positions and one part-time position that were requested but are not recommended for this year. Those total about 453,000 for annual impact. We have about 10 reclassifications uh that we are recommending as well. As we go down uh quickly here, I'll read them off. I won't spend too much time on them. For community development, we are recommending that we reclassed planner one to a land development services coordinator. This was really meant to be an entry- level position. It's progressed far beyond that. So, we're reclassing that position. And you'll see some of these to the right for the budget impact have no budget impact. They're really just title changes. That's the case for two of our engineering positions for traffic signal tech to traffic signal tech three, two, and one. This is really just reorganizing the department to make sure that these employees have a way to progress in their career as they're moving up, getting more training, more education.

I'll say um the inspiration belief comes before ability. Uh these boys did not have the ability to win state when I started working with them four years ago. We we over time we built the uh the ability but they never lost belief. uh they kept the belief and um by the time we played Atlanta International School this senior year this year we were the better team, weren't we boys? Yeah. And then that was tantamount to us beating the uh the Soviet Union on in Lake Placid on 1980 is after after that we weren't we weren't going to lose the final match. So um now these these boys are awesome. They have great parents, great schooling uh and we're all very blessed. So thank you. Uh Mayor come down and get a photo. Let's get Let's get a picture. We'll do We'll do like that. Yeah, y'all. All right. Does this look okay? Carson, what do we need to do? Tell them you direct traffic here. These all these stipulations stay the same. We're eliminating uh stipulation 15 which deals with the floor area of the individual residential units. 16 is being removed because that deals with the um parking and the parking deck that was associated with the original plan. 17, 18, and 19 all stay the same. 20 and 21 uh remain the same except for 21 has been modified to include a left out. 22 has been removed and that's um dealing with the turning radius for an entrance off of Atlanta Road on the previous plan. and a 23 um also deals with queuing and turn lanes off Atlanta Road which aren't needed on this plan anymore. Uh 24 was modified to eliminate a section of the of the stipulation that dealt with um the traffic signal in uh at Atlanta Road in Church Street and 25 and 26 remain the same. 27, 28, and 29 all deal with the residential uses that were associated with the previous plan. And um 30 deals with the residential units. 31 deals with the building height. 32 um deals with the exterior of the parking deck and the decorative um brick to screen that. and that's no longer needed because there's no parking deck associated with this. Um and then third 33 eliminates the screening of the loading area. Um there's not a loading area with with this plan. Uh 34 um eliminates the requirement for 73 parking spaces because this is much smaller building and 35 um eliminates the uh requirement for parking in of the required minimum um to be porous concrete or grass. 36 remains the same and then um 37 remains the same and then 38 39 are adjusted to the site plans that you guys have seen today. So with that, I'll be happy to answer any questions for you. Questions for Rusty? questions. Thank you. Mr. Lindley, anything you want to add?

Because demand is expected to be high, peak hour vehicle activity will concentrate at the most constrained parts of this intersection. Oakdale Road serves the nearby homes, including the 45 additional town homes proposed in this application. Uh carry school bus routes and function as an emergency access corridor. Each of those functions depend on a predict on predictable operations, not assumptions. The planning and zoning board recommended approval by a nar a narrow 3 to2 vote. That matters. It shows that concerns remain unresolved. staff has recommended approval subject to 49 conditions and that work is appreciated. But under the zoning ordinance, the the restaurant use is permitted, but the drive-thru is a design element approved through conditional zoning. That gives council the authority to require operational safeguards. What those conditions do not address is how the site will operate once it's once it's open. The original 2021 zoning included a traffic impact study, but the analysis was not updated for this high throughput drive-through request. There's no requirement to verify that these cues stay on site. No prohibition on spill back into the intersection. No post occupancy operational review. And no requirement to address ongoing operational noise, including sustained exterior noise above approximately 55 dB. State and county agencies will review driveway access, and that's appropriate, but they do not evaluate drive-through Q behavior, noise, neighborhood noise, or postoping performance. I'm speaking tonight as a nearby resident who has reviewed this proposal carefully. These impacts are foreseeable, not speculative. This is not about trusting the applicant. It's about how the operational risk is managed once once approved if it's granted. But once this site is built, the location, the layout is fixed. If problems arise, the city's op options become reactive instead of preventative. So tonight, we respectfully ask for one of two outcomes.
