I I question for Scott. Uh, I don't remember this having come before us. Uh, and does that require a reasonzoning for that parcel? So, we'll we'll take a closer look at that. Okay. Okay. That's what I thought. Okay. Yeah. From what I understand, it's properly zoned, but we're hoping for some kind of variance where the neighbors can come and speak up. So, okay. Thank you. Thank you very, this is in W five. Uh this is property that uh is in W five and it is uh zone general commercial. So, it may not even come to us unless they uh ask for a variance or something. But Rusty did tell me earlier this evening that this issue that you've spoke about with the the entrance uh on Daniel and how close it is to um Atlanta road, it will be reviewed by the county also because uh I guess Daniel is in the county and and Atlanta that part of Atlanta road where the dividing line. So, this also keep in mind is the very first property of the city of Smarter. So, if you're coming down Atlanta Road, this is the first thing that we're going to see right here. Um, right. It is the first one right there in the city. Thank you for coming. Thank you. Bye. That was the only person signed up tonight. Is there anybody else who had any comment they wanted to make this evening? Okay. All right. We'll move on now to ward and staff reports and we'll start tonight with Miss Antonia. Had the opportunity with uh Mayor Pro Tim uh Tim Gold and the chair of the Fanny Williams Legacy Project to be at the uh Cobb Landmarks um presentation of um in recognition of our efforts on behalf of that and um which is really nice.

Uh community development recommends approval of the proposed uh zoning amendments and all the zoning conditions from resoning case uh Z21-00006 uh are being carried over. There are some changes in yellow that you'll see through there that we've added to those conditions to address um the requested changes. Um first is they would like to use some uh Hardy plank sighting on the exterior for some of the elements. Um they'll have a mixture of brick and hardy. Um so we modified that request to make sure they have the opportunity to do that. um facing Campbell Road. Uh the rest of the stipulations are all remaining the same. Uh I think down all the way down to 37. Um these are all existing conditions. Obviously 35 uh we changed the plan that was associated with that for the site plan to highlight the new site plan with the requested setback variances. 36 is to amend the building elevations to reflect the new building elevations that were submitted. Uh 37 is the requirement for the additional evergreen trees within the landscape buffer. 38 um deals with the driveway length reduction for lots one and three. 39 uh increases the building height to 38 ft. And then 40 uh requires that each home have a covered deck on the rear with a brick uh support post on the bottom. And then uh 41, the external side elevation for lot six should be all brick. That's the lot that faces Campbell and Atlanta intersection. And then the internal the external side elevations for lots 7 and 12 have shall have a minimum of one story of brick. Uh 42. The HOA shall maintain the the landscape buffer adjacent argal states free from bamboo. Um the current uh developer has uh worked on remediating a a bamboo issue within that uh area. They've chopped it all down.

Allow reduction of the minimum rear setback from 30 ft to 25 ft. and to allow an increase in the maximum lot coverage from 35% to 45%. Those are the same variances that we granted the the resoning from last year for the seven homes. This is just an example of showing the four lots and then the seven lots currently entitled to that property and the storm water management facility at the the lower part of the development. These are the proposed elevations subject property and adjacent properties. Staff's recommending approval of the reasonzoning from R15 to RMC8 conditional for four single family homes at a density of 7.54 units per acre. The following conditions, standard conditions regarding the architectural components of the building. um they'll have to meet our tree ordinance, landscape plans. Special conditions are the variances that I uh discussed, installation of sidewalk, rightway dedication where required and this would be condition to the site plan and elevation submitted with the application. Be happy to answer any questions. Thank you, Joey. Joey, what's the lot width? 49.6 49.6 49.6 Can you bring back up the elevations we were looking at? Okay. Um, one question I had, were we u requiring a sprinkler all these to be sprinkled? No, they have will have a minimum 10 foot separation. So I thought that was when we did Belmont Hills. That was one of the requirements. Those were like three feet of separation. Sorry, the detached units were like 3 ft apart. Belmont if they're less than 10 ft apart. They're required to have sprinkler if it's less than 10 ft. Um Okay. I don't have any other questions. It's developer in any other questions for anybody. We're good. Is you have a question? I'm sorry. So, is there the width to build these homes? Is that what you were asking, Corki?

But the simple explanation is it's simply being reduced so that you can accommodate what really is a I think an increased level of architectural interest on the rears uh and actually uh makes it look better from all sides not just simply one side without impacting externally the community whatsoever. In addition uh Triton has agreed per staff's recommendation in our discussions and all of those came from those discussions uh that the pillars that would support that would be brick pillars. So it again creates a better look throughout the community to match the architecture that you've seen uh at that location. Uh Drayton has also agreed to supplement the buffer plannings that was something the community had asked about too of whether that could occur and they happily have have done that. We therefore we're just bringing you this request we think so that the product that needs to be built there, the homes that need to be built there, these adjustments and revisions and requests would need to be made to the original zoning. They are minor uh but they really just a matter of kind of some math to ensure that what was really discussed with the community all along is what is ultimately delivered to them in terms of the finished product in terms of the finished homes and enclave that this will be. So again I'm here I can answer any questions you may have and happy to do so along with Mr. Cliff Poston and we appreciate your consideration here tonight. Thank you. Thank you for your presentation. I can I'll say just personally I appreciate y'all's outreach to the community both recently and when this was reszoned first time and and even when I was a council member in ward one and we were talking about that medical building and that's right um goes back a long way and lots tons and tons of engagement.

And one thing you'll notice is there's a lot more room on the left side of lot three, I'm sorry, on lot two than there is on the right side. And that's so that we could provide more of a buffer against her. And then of course lot one is is it's a huge lot. So the house is pretty far. So there's lots of room. In fact, lot one there's going to be quite a few existing trees saved. I don't think there'll be a whole lot saved along the side a lot too, but when we go to plant, we'll put them on that side. Um, you know what? I I actually noticed that too, that you had that distance there, and I appreciate that as well. Thank you um so much. And um I think Oh, I do want to ask another question. The driveway of of lot one, and I know that's it's a difficult place to put the driveway, but that is that curve and the the sign that's on Woodland Trail. It's It's a little awkward, so hopefully it'll out, but I'm sure you get out with the staff and everything that And you and I, we talked about this on the phone, so I'm want to show this picture because this kind of helps explain it, but the picture with the little trash can there is a power pole um is to the left of where the driveway is on lot one. And there's a guy wire and there are requirements that you can't do you can't excavate next to a power pole too close because it could make the power pole fall over. We have to run the sewer right into the right of this power pole. So then we need to be 10 feet away from the sewer with our driveway. So that basically dictates the driveway be about 20 feet from this pole over to the right.

It just doesn't belong there. It's out of place, out of character. And I'll ditto everything Dylan had to say, too. Person who preceded me. So, I think that covers all that I have to say. So, I respectfully ask that you reject this development. Thank you. I I have a question of Joey. No, and Rusty. Five spaces per per unit. That seems that seems like more than we normally do. Is that is that for a unit like that? There's usually two spots. Yeah. For single family developments, code requires two two off streetet parking spaces. Okay. So, and for town home development, it's one it's a guest space for every for 25% of the development. So with respect they have two garage spaces, two driveway spaces and then they have seven guest parking spaces. So they have plus one guest space per every unit. So they from what's required with respect to code they're they're they're over park at this point. Almost double. Okay. All right. Thank you. And then if I would no I'm g what's that? Yeah. you can sign up. I want to bring the engineer back up. Can you address if you wouldn't mind? Um, we can do this at the end or we can do it now. I might as well do it now since it's fresh. Talk about the detention retention. Talk a little bit about and I know you'll grade that site and can you give a little bit of little more specificity to how you're going to deal with the water and the impervious surface? Yeah, sure. Jill or whoever, can y'all put that site plan back up there? I just just since it was mentioned on the um about storm water runoff and detention, I just want to get a clear idea of how that's being dealt with. and also u educate us on how that system works.

conditional for a mixeduse development with 212 hotel rooms and 328 multif family units at a density of 70 units per acre. This is 4.66 acres at 2771 Cumberland Boulevard. PEG Smyrna Property LLC. This is the property just north of the um you got the QT the storage unit and then it's the it's redoing it's proposed redoing that whole res hotel there. Any other background you want? All right, Joey. All right. Good evening. Joey Sabs, planner 2 with community development. This is reszoning KC25-008. The applicant is Peg Smyrna Property LLC. They're also the property owner. The planning board heard this in July and they recommended approval 50. The subject property is 2771 Cland Boulevard 4.66 acres. As uh we mentioned it is a existing residence in with 130 rooms. The proposal is for mixeduse development with 328 multif family units and 200 up to 212 hotel rooms. The existing zoning is tourist services. This would require a reszoning to MU mixeduse conditional. The future land use for the property and the surrounding property is regional activity center. So that is appropriate land use category for the mixed use zoning. I'll just go over the site plan that was submitted. There's basically two components, a hotel and a multif family. The um first component is a hotel. It will be eight stories with 212 rooms. The first floor will have restaurant, retail, lobby, and the eighth floor as a fitness center. The multif family is um 12 stories with 328 units. 56 will be studio, 110 will be one bedroom, 142 will be two bedroom and 20 will be threebedroom. First floor has a leasing office and the third floor has amend and courtyard pool area and that will be wrapped around the parking deck which I'll go over. The two you two units are combined with the courtyard with hardskate materials that connect the two uses.

The first being um to increase the maximum front setback from uh 20 feet up to 115 feet. Um to allow an increase in the maximum side set back from 20 feet up to uh 95 ft and then allow an increase in the residential density from 25 units per acre up to 38 units per acre. Uh number four, to eliminate the requirement for that there be consistent building edge along public sidewalk. In number five, um to eliminate the requirement that the off off streetet uh surface parking shall be prohibited uh between the building and the adjacent street. And then number six um to allow more than 15% of the uh of the units to be rental units. Um typically when you're um giving variances, there's either a hardship or your your plan is meeting the future land use plan and you're there's slight uh design and development issues that you're trying to overcome. In this case, this doesn't meet the city's future um uh land use plan and you know in the in design is going against what is requested from the mixeduse standpoint. These are the proposed elevations of the building. The city's uh future land use map uh calls this out to be industrial land use. And as you can see on the right hand side of the screen, uh it lists the appropriate land uses that that are um appropriate for this uh land use designation and the corresponding zoning districts. And as you can see, uh mixed use is not an appropriate uh zoning district in this. With respect to the land use analysis, Highlands Parkway is a corridor with many properties within the industrial land use designation and is a major industrial employment center for the city. Um the industrial land use designation is characterized by manufacturing distribution facilities and equipment that are often disruptive to uh residential properties.

It makes up about 61% of our total revenues this year. Typically, it's about 65% or that's what it was last year. Uh the reason that's decreased a little bit is we have a smaller than usual increase in our real property taxes based on the the value of homes in the tax digest. It's only about 1% this year. Uh as everybody knows, the housing housing market slowed down a little bit, but um so but we feel good about that number. As we go down charges for services, this is about 14% of our total revenue. These services are things like sanitation, prisoner, housing, accident reports, commercial recycling revenue we get from parks. Other taxes, this is things like insurance premium tax, financial institutions tax, u just those types of taxes that aren't necessarily services that we're providing. And then as we go down interfund transfers, these are transfers in that we get which we'll speak on in a few minutes from the hotel motel fund and the water sewer fund. They transfer certain percentage of their revenue to the general fund. License and permits. This is mostly what Rusty's department collects over in community development for business licenses. Permitting they do fire does some of this as well. Intergovernmental is the revenue that we receive from Cobb County. the House Bill 489 for services provided by the city that would otherwise fall under the county domain. So, they pay us for that. Fines and forfeitures, this is mostly municipal court. There's some other things that fall in there as well, court fines and fees. And then miscellaneous is just kind of anything else. Uh revenue sources that don't necessarily fall in one of those other categories. Kind of grouping our expenditures as well by uh by function here. As we look at public safety at the top, that's our biggest. Uh this is police, fire, um jail, things like that.
