And I know you've got school tomorrow. So, this is your chance to leave and not have to sit through the rest of this meeting. So, parents, boys, thank you for being here and we'll see you later this week. Y'all, y'all dismissed. All right. Next, we're going to move to our um proclamations and presentations. And we have two very special proclamations tonight. The first in recognition of breast cancer awareness month and the second in recognition of domestic violence awareness month. and and Councilwoman Hines is going to handle both of these and I'll turn it over to you now. Thank you, Mayor. I greatly appreciate it. So, the first proclamation that we have is going to be the proclamation for breast cancer awareness month and um and I thank you, mayor, for supporting these very very important causes um because it affects uh so many not just in the city of Smyrna, not just in the county of Cobb, the state and um the the country and the world. So in recognition, we have a proclamation by the mayor of the city of Smyrna in recognition of breast cancer awareness month October 2025. Whereas national breast cancer awareness month is observed in October each year to promote screening and prevention of breast cancer and whereas this observation uh provides a focused time to support patients and families facing a breast cancer diagnosis. educate people about breast cancer risk factors. Emphasize the importance of regular screening starting at the at an age that's appropriate for their personalized risk and to fund raise for breast cancer research. And whereas awareness starts the conversation, but action saves lives. This year's theme from the American Cancer Society is every action counts and shows that together we can turn awareness into action and in breast cancer as we know it for everyone.

Whereas in 2025 over 316,000 women in the United States are expected to be diagnosed with invasive breast cancer and with an additional 59,000 new cases of non-invasive breast cancer. Breast cancer is the most common cancer in American women except for skin cancers. And it is estimated that one in eight women will be diagnosed with breast cancer in their lifetime. And whereas many organizations continue to search for a cure through vital research and physicians, public health professionals and advocates continue to educate our community about their awareness and innovative advancements in early detection and treatment. And now therefore, I, Derek Norton, mayor of the city of Smyrna, Georgia, do hereby proclaim October 2025 as breast cancer awareness month and urge all citizens to observe this month by recognizing the trauma breast cancer brings and join in activities that will increase awareness of what Americans can do to prevent and control branch cancer and pay tribute to those who have lost their lives to this disease. Um, and this is this proclamation today on the October 6, 2025. And I'm so uh very pleased to be able to have Chris Delaney, who is with um Cobb EMC, uh, vice president there with marketing, be here to do this and and receive this proclamation. Uh, she is a dear friend also, um, one of my leadership Cobb sisters. So, thank you so much for being here, and if you could just say a few words about some of the things that you guys are doing as well. Thank you so much and I'm so happy to be here. Uh I am a breast cancer survivor. When I first started at KBMC, I had just finished my treatment, but I didn't realize I was going my treatment wasn't quite done. I still had to do radiation. So I had kept my battle very private. I didn't want pity.

I was just kept it very private. But um my uh CEO encouraged me to share with my team the importance of early detection. So I did. And uh as a result, one of my colleagues made her appointment that day. She was overdue and she's convinced I saved her life. So we shared our story with the whole company that October for breast cancer awareness. And in a way to make it more fun, we had it a breast fiesta. We threw a party and uh three women that day after they heard our story made appointments and we saved their lives as well. So early detection is so important. So, we tried to figure out a way to make it a fun way to remind people to make those appointments and just general awareness. And who doesn't love a flamingo? So, with that, let me introduce my colleagues, Jennifer Paneed and Christa Williams, who will be distributing some information and flamingos for you. So, we started a project that we call Pink Power. So you can go to our website and you can flock someone's yard and we have a army of volunteers that stuff their cars with pink flamingos and signage and we will go to someone's house and plant them in the yard. When they wake up in the morning they have a yard full of flamingos which is just fun whether you're taking your kids to the bus stop or just going out to get the mail. And uh we've gotten to the point now, this is our sixth year, we have over a thousand flamingos flying all over Cobb County every night for the month of October. And it's just a fun way to remind people that it's important to make those appointments. So all of the money that we raise, which is now over $10,000, goes to survivorship programs.

So um on the card you can, uh see the web address if you would like more information. Um but we hope that uh you share the keychain and share the message. Thank you. Thank you so very much. And um I'm going to read the other proclamation and then can we take photos right after? Thank you so much for being here and sharing. Um it's it's so important. That's the reason why it's important for us to talk about um breast cancer detection and prevention um because you can save lives. So that's a wonderful thing. Speaking also of another um another topic that's very very important and um saving lives. Uh as a prosecutor who's a person who's been a prosecutor for over 20 years and uh one of the most um disturbing and and and hardest is dealing with uh domestic violence victims. Um because it affects everybody in the family. um all of all of the family the the the trauma is a very ongoing thing and um for some of you who may remember we even had a member who of the Cobb Judiciary who was trying to prevent a domestic violence uh incident and was killed um a few years ago and that was Raj and um so it's important that we always remember uh domestic violence has no um it doesn't matter your class it doesn't matter doesn't matter how much you make or what color you are. It doesn't matter your gender. Um you can be a victim. So uh once again, I'm very thankful to the mayor for um allowing us to bring awareness to this very important cause. So we have a proclamation by the mayor of the city of Smyrna in recognition of domestic violence awareness month October 2025. Whereas home should be a place of warmth, unconditional love, tranquility, and security, the family is the foundation of a safe and healthy community.

And it is a goal of this administration for communities to be safe. And whereas domestic violence is more than the occasional family dispute. And the problems affect all citizens of Georgia, crossing all fa racial, social, religious, ethnic, geographic, and economic groups. And whereas millions of Americans face physical and emotional abuse at the hands of their significant other each year, and whereas in a lifetime, one in four women and one in seven men have been victims of severe physical violence at the hands of an intimate partner. And whereas organizations like Live Safe Resources are committed to providing safety and healing to those impacted by domestic violence and sexual assault within our community by providing emergency shelter, transitional housing, counseling, legal advocacy, a 24-hour crisis line, and many other services to empower those we serve to rebuild their lives by raising awareness and fostering support. Liv Safe Resources is dedicated to building a community free from domestic violence, sexual assault, and elder abuse. And whereas organizations across Georgia are working to end domestic violence and provide support survivors um support survivors need to find their voice while law enforcement remains committed to ensuring justice is served to individuals who harm those who trust them. Now I uh now therefore I Derek Norton, mayor of the city of Smyrna, Georgia, do hereby proclaim October 2025 as domestic violence awareness month and urge all citizens to observe this month by becoming aware of the tragedy of domestic violence and supporting those who are working towards towards its end and participating in community efforts. Um, and this pro proclamation is here on the 6th day of October, 2025. And I'm so very happy and honored to be able to have Lisa Melo here, who's the executive director with Live Safe Resources um, to come and accept this proclamation and tell us a little bit about some of the things they're doing and observe it.

Thank you. Thank you very much for allowing me to be here again this year. As news from last year, we have officially opened our pet shelter. Our PE shelter is one of which that when we shared last year, we were in the middle of constructing the resources to be able to help those who are leaving their abuser but feel that they could not do so without the ability to bring their their pet who is like their child. And so the ability to us to be fully functional and open and have four spaces where we can house pets of of those who are seeking safety where they have nowhere else to go is really critical and one of the first in the state of Georgia. I really do appreciate the ability to be able to share the resources for our community in Cobb County alone in 2000 2024. We helped over 2,000 individuals whether it was answering questions, creating safety plans or providing them safe shelter and services that they need every to make their next steps to become safe in their in their lives. In 2024, we helped over 3600 unique individuals from 78 counties in the state of Georgia and six other states. As we all know, the metro Atlanta area allows people to come through our community to seek other resources away from home. And that's where we are a resource to them to be able to seek that safety and provide those services to them. So being able to have our events, being able to honor those and be able to remember those uh who have come before us or who have been able to not get away from their abuser. Tomorrow night we will be down at the uh in the Marriotta Square at Glover Park for our annual domestic violence vigil.

We invite everyone to come out and help us remember the 119 individuals who lost their lives last year to domestic violence as well as the five individuals from Cobb County who lost their lives from domestic violence last year. On a happier note, we will be doing our annual um Q and Brew event. While this year it may not be at Taylor Bronner, it is going to be in Governor Barnes parking lot off of the square. Taylor Bronner was booked already. I will say um but we do hope that people will come out and enjoy a fun day of barbecue and uh their beverage of choice whether that is alcohol or non-alcoholic. Um and if you're interested in doing an amateur barbecue team, we invite you to join us because this year it's amateur teams that are competing for bragging rights as to who has the best ribs and the entry fee is zero. We have it covered by one of our sponsors. So, we hope to see some people from Smyrna there. So, thank you. Thank you again and thank you for all that you do. And mayor, if we could take a photo now. 1 2 3 1 2 Thank you. Thank you. Thank you all for being here and thank you Miss Hines for bringing those proclamations forward to council. All right, move on with the rest of our agenda. We have three community development items. Um all public hearings. First one, item A is uh zoning request Z25- Z007. This is a 250 multi-unit development, but it's uh been requested to be tabled to the October 20th, 2025 mayor and council meeting at request of the applicant. I guess I need a vote to table that. So, I'll take a motion now to table that to the 20th. So, move second. I have a second by Mr. Welch. All those in favor, please vote.

How do you vote, Mr. Lindley? I understand Mr. Lindley's joined us. Yes, sir. I'm in the affirmative. That be Yep, that'd be 70. Okay, that's been I should I should have mentioned this at the beginning. Um, Mr. Lindley's uh going to join us remotely. We have Judge Cawthorne here uh to help us with our meeting tonight. Thank you, Judge, for being here again. Yeah. All right. Item B is zoning amendment Z25-010. This is the old Kins Corner Grill site. And Mr. Jones, any background you'd like to add before Rusty's presentation? Okay, Rusty. Good evening. I'm Rusty Martin, community development director for the city of Smyrna. Um, this request is a zoning amendment to the subject property. Uh the applicant is requesting to modify the building elevations and site plans and the zoning stipulations associated with the original zoning of the property. Um LG Community Credit Union is the applicant. Um these building elevations and site plans went be before the urban design commission back on September 19th. Um the UDC recommended approval at that meeting. Um, and then you guys will hear it tonight for a final action. Um, just a little bit of background on this request. Um, back in 2022, uh, this property was reszoned from general commercial to mixed use for a 36,000 square foot mixeduse building. Um, of that 36,000 square feet, 9,000 9500 was uh commercial use and that was the bottom floor of that um mixeduse building. um that the applicant is requesting to uh modify that building and and reduce the square footage and change elevations um to it. Um as well as reduce the the size of the lot that that's incorporated in that and I'll show I'll highlight that in a in a moment for you. Um this is a zoning amendment. It's not a reszoning. Um, so we are just modifying the building on the property.

The use and everything that they're proposing with respect to the credit union is allowable under the mixeduse uh zoning classification. Um, so at this point we're just we're we're dealing with zoning stipulations on the on the original zoning request. Um, and like I said before, due to its location in the downtown area, that requires that it be uh reviewed by the Urban Design District, and that was done on uh September 19th. This request is really applying to the Ken's Corner Grill property and the vacant lot uh in between Ken's and the office building. Um the office building property will remain mixed use. Um if they decide to redevelop that property at a later date, then um that'll come back through uh the zoning process to do that. Did you say when they wanted to redevelop that or if when or if when? Um so at that point they'll come back and and reszone that property that's not part of this uh reszoning or zoning amendment at this point. So the property is going to remain mixed use with respect to this zone zoning action. The future land use has a mixeduse uh future land use designation that is remaining unchanged as part of this as well. Here's the site plan. So, um we're looking at about a 3600 foot building that'll front on uh Atlanta Road and Church Street with the entrance being at the intersection of Church Street and Atlanta Road. Um you'll have uh a front set back of zero feet, a side set back is zero, and a rear set back of 20. These are in compliance with the mixeduse uh zoning district. No variances needed here. Um obviously it's a 3600 square foot building with a covered ATM and Taylor access for drive up uh service. There are 25 parking spaces on the property.

There's underground uh storm water management system that'll be in the in the drive on the south side of the building. And then there is proposed inner parcel access should that property to the south redevelop. So they'll have connectivity between the lots and access back to um Church Street. There's a right in right out at uh a right in and right left out at Church Street and then a right in right out on Atlanta Road. There's a 10-ft sidewalk, two-ft grass strip along Atlanta Road and a 5-ft sidewalk plan for Church Street. These are the proposed uh building elevations. This is the elevation for um Atlanta Road, the elevation for uh Church Street, and this is the rear elevation uh that faces the the church and then the southern elevation um that faces the office building. and then your floor plan. And with this request, there is one um variance uh request that's associated with it under uh section uh 720.9 of uh the zoning ordinance. It requires that um all non residential uses not exceed 50% of the gross floor area um of the development. And obviously this is all commercial use. So they need a variance from that request picture of the subject property and then the adjacent properties to give you a little context of the area. Um, Community Development is recommending approval of the zoning amendment um to allow a new site plan and building elevations for uh 36 or 3600 foot uh credit union. The standard conditions that were approved in the original zoning will uh still apply. There are some modifications through this where we eliminated the zoning stipulations that pertain to uh the residential uses and um the building and site plan and we modified those to uh reflect the new building and site plan. So we'll go through this and we'll talk about the changes.

These all these stipulations stay the same. We're eliminating uh stipulation 15 which deals with the floor area of the individual residential units. 16 is being removed because that deals with the um parking and the parking deck that was associated with the original plan. 17, 18, and 19 all stay the same. 20 and 21 uh remain the same except for 21 has been modified to include a left out. 22 has been removed and that's um dealing with the turning radius for an entrance off of Atlanta Road on the previous plan. and a 23 um also deals with queuing and turn lanes off Atlanta Road which aren't needed on this plan anymore. Uh 24 was modified to eliminate a section of the of the stipulation that dealt with um the traffic signal in uh at Atlanta Road in Church Street and 25 and 26 remain the same. 27, 28, and 29 all deal with the residential uses that were associated with the previous plan. And um 30 deals with the residential units. 31 deals with the building height. 32 um deals with the exterior of the parking deck and the decorative um brick to screen that. and that's no longer needed because there's no parking deck associated with this. Um and then third 33 eliminates the screening of the loading area. Um there's not a loading area with with this plan. Uh 34 um eliminates the requirement for 73 parking spaces because this is much smaller building and 35 um eliminates the uh requirement for parking in of the required minimum um to be porous concrete or grass. 36 remains the same and then um 37 remains the same and then 38 39 are adjusted to the site plans that you guys have seen today. So with that, I'll be happy to answer any questions for you. Questions for Rusty? questions. Thank you. Mr. Lindley, anything you want to add?
