You are looking at the front of someone's house. So, it looks like it's nice and inviting. Uh there's lots of pathways that connect to the sidewalk. So, uh if you were visiting, you could even walk right into someone's front door and say hello. Uh our point of ingress and egress is right off of North Cooper Lake Road. We've only got one of those. And then we've got 17 um guest parking spaces, so folks won't be clogging this uh street. They'll have a dedicated place that they can go. Uh we mentioned these elevations a little bit. So at the top left, this is kind of what you'd see if you were standing on North Cooper Lake Road looking at these units. Uh to the right of that, that's what's on the back side. So there's a drop in grade. You go in, you can park. You won't see those garages from the street. And then down here at the bottom, you've got an idea of the types of finishes that we're talking about. High-end um using brick and other high quality materials. Uh here are some example floor plans for you all. Uh this is a really cool out in my opinion because here on the left you can see that ground level. Uh there's the garage but then there's uh one of the bedrooms. This is a bedroom but you know in my opinion I think I would convert that to an office. Maybe use it as a form of you know to work get away from everybody. Get down there and and get some work done. Uh whereas on the main level in the upper floor you've got your living room, kitchen, dining room, two more bedrooms uh as well as you know a couple of patios. Um, you can really see them here on this on this cutaway.

The recommendations uh from the traffic study was just to make sure that we have one entering lane and one exiting lane, the stop controlled um driveway approach on Argu Road and provide and confirm adequate sight distance. Again, this is an updated rendering that shows from the Camp Highland side. it will appear more as a three-story building. And from the rear view, you can see where we have retaining walls and the building is um cut more into the grading. And this is an aerial view where you can appreciate the buffers. Um thank you for everyone's time and we're available to answer any questions. Any questions of the applicant? Yes. Hey, Mr. Oglesby. Thank you, Mr. Mayor. Uh, thank you for coming today and presenting. Uh, there were some uh additional uh uh promises during the last zoning meeting that was brought to my attention. So, I just want to be sure that we we don't gloss over those. Want to be sure those were taken care of. Sure. Uh and documented. Uh because I don't know the details, uh I won't go too deep into it, but you mentioned changes to the garage or there was a request for that. Can you speak on that a little more clearly so we understand exactly what that change was and why? I'm not the engineer, but that involved um the grading where the garage is basically lowered down using grading so that the the building is not sitting on top of the property on top of the the existing soil and that rendition did show that. Correct. That's what we are trying to show. Yes. Right. Okay. On the elevation and that's why retaining walls would be used. So speaking of retaining walls, uh can you go a little more in depth on the retaining walls and how those retaining walls will be uh or if they will be naturally?

42. The HOA shall maintain the landscape buffer adjacent to Argyle Estates to be free of bamboo. Councilmember Travis Lindley asked Mt. Martin to explain to the public why this did not go before the Planning & Zoning Commission first. Mr. Martin explained that small changes may arise during the design process; however, there are no changes in orientation of the home, the lot sizes are the same, and the original intent of the zoning is in place. Had there been a density change or a change in the orientation in the road, it would have gone back to the Planning and Zoning Commission. They have been working with the adjoining property owners. Kevin Moore, representative of Traton Homes, extended a heartfelt thanks to Mr. Martin and Mr. Staubes for their engagement with the community. He provided a brief historical context: Two (2) acres at Campbell Rd and Atlanta Rd. Shopping could have gone here, but it was not received well in the community. Another application was a large hospital building, but it was not supported by the community. Then came this application with an original 16 townhomes, but after community engagement, it was reduced to 12 detached single-family homes. The price point will be in the high $700K – low $800K. A public hearing was called. and no one came forward in favor of or in opposition to this item. Councilmember Glenn Pickens returned to Council Chambers at 7:45 PM. A. COW2026-056 Review of the July 20, 2026 Mayor and Council Meeting Notice and Agenda Z26-004: Joey Staubes, Planner II, provided the following background: The applicant is requesting to rezone 4691 Camp Highland Road, which is currently vacant, from GC to TD-Conditional for development of six (6) single-family attached dwelling units at a density of 5.71 units per acre. The Planning & Zoning Commission voted 5-0 to deny the application at the May 11, 2026, hearing. Following the vote to deny the applicant held an additional meeting with the surrounding neighbors and modified the site plan and elevations in response to those comments. The Planning & Zoning Commission voted to approve the revised site plan and elevations by a vote of 3-1 at the July 13, 2026, meeting. Neighbors’ concerns originally were the placement of the dog park and the detention pond. Those have been moved. Now their concern is the height of the buildings. The applicant is trying to amend their renderings to show that the front side is three stories and the back side is four stories. Mr. Staubes reminded Mayor and Council that at 5:00 PM on Monday the consultant is coming to discuss the Comprehensive Plan. ATH2026-089: Major Copeland stated that over the last two years, the Police Department has lost nine vehicles from the fleet due to traffic accidents as well as mechanical failures. Seven of the vehicles were marked patrol vehicles that are necessary for the continued service provided by the Police Departments to the City of Smyrna. The loss of these vehicles has left the department short of the necessary fleet needed to provide both emergency services and routine response required. Due to this shortage, other vehicles have had to be kept past the City’s established replacement schedule, leading to increased mechanical failure in the fleet which has led to operational downtime as well as increased vehicle repair costs. The total cost to purchase (4) Dodge Durango Pursuit vehicles will cost $270,989.60 under the Georgia Statewide Contract to be funded by the Emergency Vehicle Replacement Fund, with vehicle outfitting to be funded by the Asset Forfeiture Fund. CON2026-018: Paul Osburn, Interim Public Works Director, stated RFP 26-019 was let to rebid and award a 3-year contract for Fire Systems Inspections and Maintenance citywide. The city received five responsive bids that were evaluated by an appointed evaluation team. The evaluation team evaluated based on outlined criteria on which the determination was made to award the contract to Cliff’s Fire Extinguisher.

Well, he's the point of contact for I mean, he's the point of contact for what you're trying to get done or what your what your concerns are, right? So if you are working with him on solutions and you're working with staff, we want to get whatever this whatever the problems are taken care of. So talk about what your issues are other than what you've out I mean is there is there other things that you're concerned about? Um yes, we're the planning and zoning the zoning in our area. We're zone residential then they had something coming up um what is it industrial then we had something coming up mixed use. We have an issue with that. We have an issue with traffic coming. We have an issue with trash in the neighborhood. We have an issue with um poor lighting in the neighborhood. So I think I think on the traffic cal and the poor lighting I think there's a lot that we can do. I think that that area was industrial when it was annexed into Smyrna. And so you you have an industrial and residential mix over there that has been present since that became part of Smyrna. So we're working on those issues. I don't know if you want to speak to what you've been able to accomplish or who you're working with on staff, but I I do know that we are responsive and we take care of the issues that come up from our citizens. So, please explain where we are with this issue. Yeah. So, good to see you here today uh expressing your concerns. I always encourage our uh neighbors to come to city hall and come to our council meetings and speak up. Now, with that being said, uh I do also take issue with uh the statement of city staff not being responsive.

So, you know, there there's some offset with respect to what the change is between the plans on that. Yes, you're going to gain more vehicular traffic from the Chick-fil-A, but it may not amount to a net positive or a net plus change in in total traffic volume for the site. Okay, any other questions? Hey, Rusty. Mr. Pickicket. Um, are there any stipulations for making sure the site work is done simultaneously for both sections so we're not maybe stuck with one part of it and then we don't get the other or vice versa? I believe the plan is to have all the site work done for the site um at one time. Okay. But you can have the applicant verify that. With that, it might be time to invite the applicant up. Please come up. You need to be sworn in. Okay. Let our city attorney swear you in. No. Uh first of all, thank you all for the time uh tonight. Um, to answer uh your question, uh, Council Member Pickkins, yes, it will be all done at the same time. I mean, the topography of the site, you have to have to do it all at once. Sorry. Maybe better. I missed your name. I'm sorry. Uh, my name is Park Lambert with Aerys. Uh, we're the we're the owner of the property and developer. Um, and as as Rusty mentioned, um, we are uh the request is to to change the mixeduse zoning to amend it. uh from 163 multif family units and 20,000 square feet of commercial down to 45 town homes which will be fee simple um owner occupied and 5,000 square feet of um class A restaurant drive-thru space. Um we've you know we've owned this property since 2021. Um we have diligently pursued financing and equity options for this this project uh as it stands now.

Uh but bamboo is tricky and so uh it's a very steep slope and so what I don't understand quite yet is uh are they leveling in the middle of the property and letting the rest of it grade down or is the whole property going to be leveled to the back um you know to where the tennis court in my property will be and am I going to be looking at you know a five foot retention wall, a two-ft retention wall or a 15oot retention wall. Uh that's one question also that um I would ask. Um, and then finally, just for the record, I don't know if this is the appropriate place to bring it up, uh, but in the renderings of the crosswalk, uh, I think that's a good spot for a crosswalk, but if we're going to add one there, we should probably also add one, uh, that crosses Argo Road because you're not going to go anywhere um, if you're trying to get to the Silver Comet Trail through that one crosswalk. So, there should be one going this way, too. And I think that's all I have. Thanks. Thank you. Hey. Hey, Mr. Mayor. Mr. Oglesby. Is uh Mark here? Hey, can we bring Mark up? Hey, Mark. Sorry, I didn't see you over there. Um Mark Wolf for the engineering department. I have questions about the drain in my neighbor's backyard near his debt that he spoke on. Uh how does that work? How does the city protect neighbors or homeowners who have these type of drains in their yard currently with respect to new developments in the area? How do we protect the what's the current uh protocol here? What will what will be the protocol for the developer if this is approved? So they will need to comply with our ordinance which which um requires a downstream analysis of their from their site.
