1. Approval is conditioned upon substantial compliance with the elevation and site 
plan submitted with the variance application. 
2. A plat shall be submitted to the City for approval and subsequently recorded with 
the Cobb County Superior Court to show the extension of the undisturbed buffer 
and impervious surface setback prior to issuance of the building permit. 
Dustin and Sara Mackarvich, homeowners, came forward. Mrs. Mackarvich explained that 
the applicant, Kodell Jackson, is their contractor. Board Member Jones mentioned to the 
owners that there is a sewer line that runs in front of and across their front driveway. Mr. 
Mackarcvich stated that they will be aware of the sewer line and use the appropriate lift for 
that situation.   
  
A public hearing was called, and no one came forward in favor of or in opposition to this 
item.   
 
Board Member Andrea Worthy made a motion to approve item V25-033; seconded by 
Board Member Bo Jones. 
 
The motion to approve carried with the following vote: 
 
Aye: 3 –  Chairperson Garland, Board Member Jones, Board Member Worthy 
Nay: 0 –  None 
Recuse: 0 –  None 
 
 H. V25-034 Public Hearing - Variance Request - V25-034 - Allow encroachment into the 
City's 50-foot undisturbed stream buffer - Land Lot 488 - 1071 Bank Street - Kodell 
Jackson 
Ward 3 Councilmember - Travis Lindley 
 
No further information was provided. The homeowners understand and agree to the 
stipulations read into record.

item. 
 
Board Member Bo Jones made a motion to approve item V25-034; seconded by Board 
Member Andrea Worthy.
